By -Law No. 72 -29
Being a By -law to authorize the obtaining
of a re- conveyance of certain lands from
Detta Borgardt
WHEREAS by By -Law No. 70 -25 passed the 1st day of June, 1970,
the Council of the Corporation of the Town of Bowmanville, did
authorize the sale to Detta Borgardt, of certain lands in Township
Lot 8 in the 1st Concession of the Town of Bowmanville, for the
establishment of industry;
AND WHEREAS by instrument number 45481, registered on the 5th
day of June, 1970, the Corporation of the Town of Bowmanville did
convey the said lands and premises to Detta Borgardt, upon the condition
that she construct a building therein suitable to carry on business
operations, before the 15th day of May, 1971;
AND WHEREAS the said Detta Borgardt has not, nor has any person
or corporation on her behalf constructed such a building for business
operations;
NOW THEREFORE the Council of the Corporation of the Town of
Bowmanville, HEREBY ENACTS as follows:
1. That Detta Borgardt, having failed to construct a building suitable
for the carrying on of her business operations by the 15th day of
May, 1971; the Town invoke the provisions in the said By -law and
Deed, whereby the lands and premises are to revert to the Town of
Bowmanville.
2. That the Mayor and Clerk be authorized to execute all documents and
do all things necessary to obtain a re- conveyance of the said lands
and premises :and /or have the title to the said lands and premises
revert to the Corporation of the Town of Bowmanville.
READ a First and Second Time this 4th Day of July, 1972.
READ a Third Time and Finally Passed this 4th Day of July, 1972.
