HomeMy WebLinkAbout72-8THE CORPORATION OF THE TOWN OF BOWMANVILLE By -Law No. 72 -8 To authorize the conveyance of a closed part of Brown Street to Mary Viola Connors WHEREAS by Order of His Honour M. A. Miller, Judge of the County Court of The United Counties of Northumberland and Durham dated the 3rd day of July, 1957 and registered the 15th day of July, 1957 as number 4042, all that part of Brown Street lying southerly of Victoria Street and westerly of Liberty Street was closed and stopped up; AND WHEREAS Section 57 of The Surveys Act requires where a street is closed pursuant to a Judge's Order under The Registry Act that a closed part shall be conveyed to the abutting owners; AND WHEREAS Mary Viola Connors is the owner of the lands on both sides of that part of Brown Street more particularly described in Schedule "A" hereto lying between Lot 10 and part of Lot 9 and part of Lot 11, all in Block 16 and the said Mary Viola Connors has requested the Town to execute a conveyance thereof to her. NOW THEREFORE the Council of The Corporation of the Town of Bowmanville enacts as follows: 1. That the Corporation of the Town of Bowmanville execute a conveyance of that part of the closed part of Brown Street lying between Victoria Street and Liberty Street and more particularly described in Schedule "Alf attached hereto to Mary Viola Connors. 2. That the Mayor and Clerk be and are hereby authorized to execute the said conveyance and impress the corporate seal of the Town thereto. READ a first, second and third time and finally passed this 7th day of February, 1972. van M. Hobbs, Mayor 4 • McIlroy, Clerk 5G!FDULE - "A" ALL AND SINGULAR that certain parcel or 'tract of land and ;premises situate, lyin and being, in the Town of Bowmanville, County of Durham, Province of Ontario, and being composed of part of Brown Strut between Town Lot Eleven .(11) and Town Lots Nine (9) and Ten (10), Block 16, on the South side of Victoria Street, according to a plan of the said Town of Bowmanville, made by John Grant, P.L.S., registered on the 20th day of April, 1852, and now on file in the Registry Offic for the Registry Division of Durham =''Test, the boundaries of the said parcel being more particularly described as follows; COMMENCING at the 14orth— Easterly an'r,l�� of said Lot, 10; THENCE North — Easterly along the S oitherly limit of Victoria Street a distance of 5,.12 feet to the North- W- ?sterly angle of said Tom Lot 11; THENCE South - Easterly along the South-Westerly limit of said Town Lot 11, being the North- Easterly limit of Brown Street, a distance of 111.92 feet to a point; THENCE South- V:`esterly in a straight line a distance of 5,',.32 feet more or less to a point in the South - Westerly limit of Brown Street which is distant 107.34 feet measured South- Lasterly therein from the point of 'commencement; THENCE North - Westerly along the last- mentioned limit, being the North- Easterly limits of said :Town 'Lots 9 and 10, a distance of 107.314 feet to the POINT OF COMMENCEMENT.
