HomeMy WebLinkAbout71-30THE CORPORATION OF THE TOWN OF BOWMANVILLE BY -LAW NO. 71 -30 A By -law to amend Zoning By -law No. 1587. E WHEREAS it is deemed desirable to amend Zoning By -law Number 158.7 as amended, of the Corporation of the Town of Bowmanville; AND WHEREAS it is desirable to further amend the said Zoning By -law No. 1587; NOW THEREFORE the Council of the Corporation of the Town of Bowmanville pursuant to The Planning Act, R.S.O. 1960, Chapter 296, Section 30, and amendments thereto, HEREBY ENACTS that By -law No. 1587 as amended be further amended as follows; 1. That Section 1, Definitions, be amended by adding: "(ze) 'Boatel' shall mean one building or two or more connected or detached buildings used for the purpose of catering to the needs of the travelling public by furnishing sleeping accommodation." "(zf) 'Boat Mooring' shall include docking facilities, mooring slips and boat storage areas." "(zg) 'Marina' shall mean a commercial operation, publicly or privately owned, catering to the recreational boating public." "(zh) 'Marine Service Station' shall mean a place of business constructed and operated at a location bordering on.a waterway to supply gasoline, oil, batteries, lubricants and accessories to boats and ships only, and where only minor emergency repairs are made." - 2 - "(zi) 'Waterfront Parking Space' (vehicular), shall mean an area of not less than three hundred (300) square feet, exclusive of driveways or aisles, for the temporary parking or storage of motor vehicles with boat trailers." E 2. That Section 8, ESTABLISHING OF USE ZONES be amended by adding following subsection 11, subsection Ila; "Ila. Marine Commercial Zone: All that portion of the Town of Bowmanville, boundaries of which are described in schedules hereto:" 3. That Section 10A as follows be added to the By -law; 1110A. MARINE COMMERCIAL ZONE In the Marine Commercial Zone, herein referred to as Zone Ila, notwithstanding any other provisions of this By -law, no building or structure, or part thereof shall be erected, altered, or used, and no land shall be used except for one or more of the following uses -- and only where not prohibited under Provincial Regulations. (a) PERMITTED USES A place of residence,boat moorings and launching ramps; boat storage and parking areas; a marine service station, repair facilities, sales and display offices; a retail marine and snowmobile sales and supply outlet; a boat livery; restaurant facilities; a boatel; locker and locker room facilities; swimming pool and parks, playgrounds and recreation areas. - 3 - (b) AREA REQUIREMENTS Minimum site area - 1 acre Minimum site frontage - 100 feet on a public road Minimum water frontage - 150 feet (c) PARKING REQUIREMENTS For every building or structure erected, altered or enlarged, there shall be provided and maintained, off - street parking in conformity with the following require- ments and each parking space shall be made accessible for ingress and egress by means of a hard surfaced lane or right -of -way or street, at least eight (8) feet in width. Where more than one use occurs, the minimum required parking facilities shall be computed for each different use area. Type or Nature of Building or Use a) boat moorings b) launching ramp c) picnic areas d) swimming pools e) restaurant f) repair facilities g) boat livery h) marine and snowmobile supply retail outlets and sales and display offices Minimum Required Parking Facilities 1.2 parking spaces per mooring 1/2 acre of waterfront parking spaces per lane 1 parking space per picnic table 1 parking space for each 10 persons of permitted capacity of the pool 1 parking space for each 10 persons that can be accommodated at any time 5 parking spaces 1 parking space for each 2 boats kept for rent 1 parking space for each 300 square feet of floor area - 4 - d) YARD REQUIREMENTS For every building or structure erected, altered or enlarged, there shall be provided, unobstructed yards in accordance with the following requirements. That the SCHEDULE OF be further amended b "In the Broken Front following; P°Except: the Marine - 5 - ZONES referred to in By -law 1587 as amended, y (a) adding in "IN TOWNSHIP LOT 101' ConcessionP9 following the last line, the Commercial Zone in .................Zone Ila" (b) adding in B°IN TOWNSHIP LOT 9" "In the Broken Front Concession" following the last line, the following; "Except: the Marine Commercial Zone in .................Zone Ila" 5. That the Roads and Land Use Plan of By -law 1587 as amended be further amended by changing the designation of a parcel of land located in Township Lots 9 and 10, Broken Front Concession and shown on the attached Schedule "AP1, from Conservation -Zone V1 and Industrial -Zone 111 to Marine Commercial -Zone Ila. 6. Schedule t4All attached hereto forms part of this By -law. 7. This By -law shall come into force on the date it is passed by the Council of the Town of Bowmanville subject to the approval OIL the Ontario Municipal Board.
