TOWN OF BOWMAUVILLE
BY -LAW NO. 71 -21
The Council of the Corporation of the Town of Bowmanville, in
accordance with the provisions of The Planning Act, hereby enacts as follows:
1. Amendment No. 4 to the Official Plan of the Bowmanville
Planning Area consisting of the attached map and
explanatory text is hereby adopted.
2. That the Clerk is hereby authorized and directed to
make application to the Minister of Municipal Affairs
for approval of the aforesaid Amendment No. 4 to the
Official Plan of the Bowmanville Planning Area.
3. This by-law shall come into force and take effect on
the day of the final passing thereof.

AMENDMENT NO. 4
to the
OFFICIAL PLAN
of the
BOWMANJILLE PLANNING AREA
1. Title of Amendment
This text and the attached Schedule 7W' constitute Amendment No. 4
to the Official Plan of the Bowmanville Planning Area.
2. Purpose
The purpose of the Amendment is to redesignate certain lands from
their present conservation and industrial classification to marine
commercial on Schedule "A" of the Official Plan. In addition, the
text of the Official Plan is amended by adding thereto an appropriate
definition and policies.
3. Location
The land affected by the Amendment is located in Township Lots g
and 10, Broken Front Concession, abutting Bowmanville Creek on the
west, Simpson Avenue on the east, midway between West Beach Road on
the north and Second Street on the south.
4. Basis for Amendment
The recreation potential of the Bowmanville lakefront area has for
some time been recognized by the local and regional planning boards.
This is reflected in the draft Official plan of the Bowmanville
Planning Area now in the final stages of preparation, where a
significant portion of the lakefront has been designated for
major open space use. The redesignation of the subject property
to marine commercial would permit establishment of recreationally
oriented marina facilities which would be in keeping with the long
term objective of developing the waterfront area for open space and
recreational purposes.
5. The amendment
Schedule fPAi4 to the Official Plan is hereby amended by redesignating
from "Conservation" and "Industrial" to !°Marine Commercial1B the lands
indicated on the attached Schedule "A ".
Section I of the Official Plan entitled, "Broken Front Section" is
hereby amended by adding to the end thereof the following subsection:

Definition
This designation means that the predominant use shall be for water
oriented commercial and recreational development. Permitted uses
shall include a yacht club, boating and swimming facilities, a
restaurant, the retailing of marine equipment and supplies and a
place of dwelling.

a) No buildings nor the placing or removal of fill of any kind
whether originating on the site or elsewhere shall be permitted
without the written consent of the Central Lake Ontario
Conservation Authority.
b) Development will be permitted only when it has been established
by the Haliburton, Kawartha, Pine Ridge District Health Unit
that the soil and drainage conditions are suitable to permit
the proper siting of buildings and to permit the installation
of an adequate means of private sewage disposal.
c) Development will conform with the regulations and standards of
the Ontario Water Resources Commission, the Department
of Energy and Resources Management and other relevant departments
and commissions of the Provincial Government.
d) The open storage of boats, equipment and supplies will be
controlled by the implementing restricted area (zoning) by -law.
e) All development plans will be subject to site plan approval by
the municipality.
f) Accessory uses necessary to and compatible with the prime use,
shall be permitted in accordance with the provisions of the
restricted area (zoning) by -law, in which the physical relationship
of all uses will be of major concern.

g) That the site be serviced by municipal water.
h) That all sewage be discharged into holding tanks and that the
municipality agrees to empty these holding tanks on a regular
basis. The sewage will be transported by the Public Utilities
Commission of the Town of Bowmanville from the holding tanks to
the municipal sewage treatment plant and processed by that plant.
6. Implementation
The restricted area by -law applicable to the subject area will be
amended to the appropriate classification and standards thereto
shall apply.
Formal steps to amend the restricted area by -law will be taken
on receipt of approval by the Minister of Municipal Affairs under
Section 14 of The Planning Act.

This amendment to the Official Plan for the Bowmanville
Planning area which has been adopted by the Council of the Town
of Bowmanville, is hereby modified under the provisions of
Section 17 of The Planning Act, as follows:
"The Section entitled 'Policies' is hereby
modified by the addition of the following-
(g) That the site be serviced by municipal
water.
(h) That all sewage be discharged into
holding tanks and that the municipality
agrees to empty these holding tanks on
a regular basis. The sewage will be
transported by the Public Utilities
Commission of the Town of Bowmanville
from the holding tanks to the municipal
sewage treatment plant and processed by
that plant." ,
. As thus modified, this amendment is hereby approved
pursuant to Section 17 of The Planning Act, R.S.O. 1970,. Chapter
296 as amended, as amendment No. 4 to the Official Plan of the
Bowmanville Planning Area.

The attached text and map, constituting amendment No. 4 to the Official
Plan of the Bowmanville Planning Area was prepared under the direction
of the Town of Bowmanville Council under the provisions of Section 14
of The Planning Act R.S.O., 1960, Chapter 296.
This amendment was adopted by the Corporation of the Town of Bowmanville
by By-law No. in accordance with Section 11 of The Planning
Act, R.S.O., 1960, Chapter 296 on the 12th day of July, 1971.
