HomeMy WebLinkAbout67-26BY -LAW NCB. 1- Being a By -Law to authorize conveyances of the closed parts of certain streets and lanes shown on the Smart Flan of Subdivision of Part of Township Lot 10 in the Broken Front Concession of the Town of Bowmanville, to the abutting owners. WHEREAS by Order of His Honour J.C.N. Currelly, Judge of AND WHEREAS the Surveys Act R.S.O. 1960s Chapter 390, Section 56 (2 ) and (8) provides that the closed part of a street belongs to the abutting owners and directs that the Municipality shall convey such closed part of street to him. ITOW THEREFORE the Council of the Corporation of The Town of Bowmanville pursuant to the Surveys Act R.S.O. 1960, Chapter 390, Section 56 (2) and (8) HEREBY ENACTS as follows: 1. That the Town of Bowmanville convey the closed part of George Street and lane, more particularly described in Schedule "A" hereto, to National Granite Company Limited,the registered owner Of the abutting lands. the.abutting lands. 3. That the Mayor and the Clerk be and are hereby authorized UKM - 2 - to sign and affix the Corporate Seal of the Town of Bowmanville to the said conveyances. Mayor Clerk 40011 J: J , That part of George Street lying between Blocks 1 and 2, and the lane lying between the south limits of said Blocks 1 and 2, the south end of George Street and the Canadian National Railway Right -of -Way contained within the following described parcel which is shown as Parcel 1 on a sketch of survey made by Donevan and Fleischmann which is attached to Instrument number N17581 registered on the 13th day of September, 1962; COMMENCING at the intersection of the Westerly limit of Simpson Avenue of said Town of Bowmanville and the northerly limit of The Canadian National Railway Right -of Way, said intersection being distant south 19 degrees 54 minutes east in said westerly limit, 2,250 feet 10 inches from the northerly limit of said Lot 10; THENCE North 19 degrees 54 minutes west in said westerly limit of Simpson Avenue 511 feet to a point in line with a fence running westerly; THENCE South 70 degrees 36 minutes west in and along said fence 323 feet; THENCE South 35 degrees 36 minutes west in and along said fence 72 feet 7 inches to an angle in fence; THENCE South 61 degrees 06 minutes west in and along fence 60 feet 6 inches to an angle in said fence; THENCE South 39 degrees 57 minutes west in and along fence 102 feet to an angle in same; THENCE South 30 degrees 12 minutes west in and along fence 58 feet 9 inches to an angle in same; THENCE South 12 degrees 55 minutes west in and along fence 177 feet 2 inches to the intersection with a fence marking the northerly limit of the Canadian National Railway Right - of -Way; THENCE north - easterly in a straight line in and along said fence marking the northerly limit of the Railway Right -of- Way a distance of 709 feet 5 inches more or less to the PLACE OF BEGINNING. ALL AND SINGULAR those certain parcels and tracts of lands situate lying and being in the Town of Bowmanville, in the County of Durham and Province of Ontario, being parts of certain streets and lanes shown on the Smart Plan of Sub- division of part of Township Lot 10 in the Broken Front Concession, made by L.H.
