HomeMy WebLinkAbout67-12THE GORPORATION OF THE TOWN OF BOWMANVILLE BY -LAW N0. 67 -12 A By -law to regulate the setting off of fireworks and the sale of fireworks. WHEREAS it is deemed necessary in the interest of'safety and quietude to regulate the setting off and sale of fireworks; NOW THEREFORE the Council of the Corporation of the Town of Bowmanville pursuent to the provisions of Section 379(1) paragraphs 30 and 31 of The Municipal Act, R.S.O. 1960, Chapter 249, hereby ENACTS AS FOLIOV13 1. No person shall sell at retail in the Town of Bowmanville any fireworks of any kind or description whatsoever at any time during the calendar year with the exception of three business days immediately preceeding the day set by Statute for the observance of Victoria Day and Victoria Day and except the -three business days immediately preceeding the day set by Statute for the observance of Dominion Day and Dominion Day, except by special authority of the Council. 2 No person shall sell by retail in the said Town of Bowmanville any fireworks of any kind or description whatsoever to anyone under the age of eighteen years. 3. No person who proposes to sell fireworks of any kind or description at retail shall exhibit any display of any such fireworks in any display window. This prohibition shall not apply to prevent imitation of such fireworks being displayed provided there is no explosive or chemical contained in such imitations. 4. No person shall fire or set off or cause to be fired or set off any fire ball, squib, crackers or fireworks of any kind whatso- ever within the limits of the Town of Bowmanville except on the days set by Statute for the observation of Victoria Day and /or Dominion Day and then only if on his or her own property. Provided,,if specially authorized by a permit issued by the Council of the said Town of Bowmanville any person may fire Qr iM 5. 6. 7. 2 set off fire works in other places or on other days. Such permits shall define the location where the fireworks are to be set off and shall require that all fire works that may be set off under such permit shall be under the supervision of a responsible person of at least twenty -one years of age* No person shall set off fire works on any public street for roadway within the Town of Bowmanville at any time. All By -laws or parts of By -laws inconsistent with this by -law are hereby repealed. a. Any person who contraygn. - &s t.ny: proviAon of this By -law shall, upon conv�6tion be-'.liable-'to a penalty not exceeding $50.00 recoverable under the Summary Convictions Act, all the provisions of which shall apply except that imprisonment may be for the term of not more than twenty -one days.
