HomeMy WebLinkAbout70-21THE CORPORATION OF THE TOWN OF BOWMAANVILLE By -Law No. 70- 21 A by -law to provide for the inspection of plumbing and the enforcement of the regulations respecting plumbing (plumbing code) made under the Ontario Water Resources Commission Act. WHEREAS pursuant to the aforesaid Act, the Ontario Water Resources Commission has, with the approval of the Lieutenant - Governor -in- Council, made regulations published in Ontario Regulation 471/60 respecting plumbing (Plumbing Code), as amended from time to time; AND WHEREAS the Council of the Corporation of The United Counties of Northumberland and Durham has been requested to provide by by -law for the appointment of an Inspector or Inspectors under the said Act to carry out the inspections prescribed by the said Act and Regulations and to enforce the said Act and Regulations on behalf of the constituent municipalities of the said Corporation of the United Counties of Northum- berland and Durham; AND WHEREAS the said Regulations provide that an inspection shall be made within seven days after notification in writing to the municipality or its authorized agents that the construction, repair, renewal or alteration is ready for inspection; AND WHEREAS by the said Regulations it is provided that where plumbing has been constructed, repaired, renewed or altered, the plumbing shall not be put into use until it has been inspected and found to conform to the said Regulations; AND WHEREAS by Section 47 (b) of The Ontario Water Resources Commission Act, S.O. 1961 -62, Chapter 99, the Council of this municipality is authorized to pass by-laws providing for the inspection of plumbing and related matters; NOW THEREFORE it is enacted by the municipality of the Corporation of the Toem of Boernanville as a by -law of the said Corporation as follows: 1. This by -law shall apply to plumbing as defined in the said Regulations, other than plumbing constructed, repaired, renewed or altered for the sole purpose of industrial processes, but includes the connection of plumbing that is subject to the Regulations with plumbing that is not subject to the Regulations. 2. This by -law shall not apply to: a) the repairing or replacement of a valve, faucet or fixture; or b) the repairing of a leak or forcing out of a stoppage. - 2 - 3. In this by -law (a) "Inspector" means an inspector appointed or authorized by the Council of the Corporation of The United Counties of Northumberland and Durham to carry out plumbing inspections and related duties as provided for in this by -law; and this Council hereby adopts and ratifies any and all such appointments, (b) "Treasurer" includes any person authorized to act on behalf of the Treasurer or Clerk of this Municipality. 4. Any person who intends by himself or through others to construct, repair, renew or alter any plumbing in commercial, industrial or institutional buildings or premises shall, before the commencement of such work, produce to the Inspector plans of the plumbing that is to be constructed, repaired, renewed or altered and of the location of drains, pipes, traps and other works or appliances that are or are to be part of or connected with the plumbing, and shall pay a fee, for the inspection by the Inspector of such plans and of such completed work, fixed in accordance with the schedule hereto annexed. If additional inspections other than the two referred to in the schedule are required, the person requiring such inspection shall pay in advance a further fee for such additional inspections, as set out in the said schedule. 5. Upon approval of such plans, the Inspector shall issue a permit certifying to such approval. 6. Without such Permit, no such plumbing may be constructed, repaired, renewed or altered, and no person shall do, nor permit or cause to be done, any such taork without such Permit. 7. Any person who intends by himself, or through others, to construct, repair, renew or alter any plumbing other than in commercial, industrial or institutional buildings or premises, shall before the commencement of such work, notify the Inspector of such intention, and pay a fee for the inspection of such work by the Inspector in accordance with the schedule hereto annexed. S. No person shall use nor permit or cause to be used any plumbing until it has been inspected and found to conform to the said Regulations. 9. The Inspector is her # appointed as an agent of the municipality for the purpose of receiving notification in isiting that the construction, repair, renewal or alteration is ready for inspection in accordance with the Regulations. 10. The fee or fees required by this by -law to be paid may be paid by the owner or accupier of premises for whom the work is to be done or by the person who intends to do the work or cause it to be done. Payment by one of such persons shall relieve the other or others from responsibility for payment. - 3 - 11. The fee shall be paid to the Treasurer who shall prepare, in triplicate, a written acknowledgement of payment thereof, showing the name of the person intending to do the work, the name of the owner and of the occupant of the premises and the address or location of the premises. The acknowledgement shall be signed by the Treasurer, 12, The Treasurer shall deliver one copy of the acknowledgement to the person paying the fee and shall forthwith deliver, or send by mail, the second copy of ttn acknowledgement, to the Inspector, and shall retain the third copy of the acknowledgement in his records. 13. Any person who contravenes this by -lair is liable to a fine of not more than THREE HUNDRED DOLLARS ($300000) upon summary conviction. 14. By -Law No. 1794 of the Toem of Bowmanville is hereby repealed. WHEREAS, with the approval in writing of the Ontario Municipal Board, the P✓lsnicipal Council of the Corporation of the Town of Bo-'-Manville has passed Construction By -Later No. 69 -30, authorizing the construction of the works described in it as reconstruction of certain streets, the estimated cost of which works is $187,500, copies of which by -law and approval are annexed hereto. AND WHEREliS it is desirable to agree with a bank for temporary advances to meet the cost of the.said works pending the completion thereof. BE IT THEREFORE ENACTED by the said Council as follows: 1, The Head and Treasurer of the Corporation are hereby authorized to obtain from the Bank of Montreal temporary advances at a rate or rates not exceeding 82 per cent per annum represented by a promissory note or promissory notes or by way of overdraft or otherwise not exceeding One Hundred And Eighty Seven Thousand, Five Hundred dollars to meet the cost of the said works pending the completion thereof. 20 A promissory note or notes or other vouchers, sealed with the Corporate Seal and signed on behalf of the Corporation by the Head and Treasurer thereof, for the advances from time to time obtained under the authority hereof and interest thereon, may be given to the said Bank providing for the repayment of or representing the said advances with interest thereon as aforesaid, 3. The Treasurer of the Corporation is hereby authorized and directed to apply first in payment of such advances with interest thereon as aforesaid all moneys borrowed on the credit of the Corporation to repay such advances and to defray the cost of the said works and all moneys from other sources properly applicable to the cost of the said works.
