HomeMy WebLinkAbout70-11ITHEREAS Council, be adopting resolution #CW 41 of the Committee of the Whole on February 2, 197 which stated-, d) Expenditures for supplies, tools and materials required for the functional operation of the Department e) All such other costs and expenses which are incidental to and inherent in the operation of the Department and which are of direct benefit to that Department 4) Costs which shall not be included are the following: a) Hydrant Rentals b) Street Fire Alarm System 5) Payment to the Towm by the Township shall be made in quarterly instalments, based on 50Q/ of the actual expenditures during that quarter with a final statement at the end of each financial year on the basis of the proportion as set out in Clause 2 of this Agreements 6) The Town shall submit to theTownship for approval, not later than March 15th in each year, an estimate of the costs of operating the Fire Department. 7) The term of this Agreement shall be from January 1, 1969 to December 31, 1972, or such longer period as may be agreed upon by resolution of both Councils. 8) Notwithstanding the provisions of this Agreement, no liability shall accrue to the Town by its inability to supply the services authorized herein. J/ Clerk £â€¢fEMORANDUM OF AGREEMENT Schedule ".A" To By -Law No. s' B E T W E E N THE CORPORAT IO14 OF THE TOWN OF BOTFMANV ILLE Hereinafter referred to as "The Town" A N D THE CORPORATION OF THE TOWNSHIP OF DARLINGTON Hereinafter referred to as "The Township's WHEREAS it appears desirable that the services of the Staff and equipment of the Bowmanville Fire Brigade shall be available to the Township of Darlington on a shared cost basis; AND WHEREAS the Town and the Township have, by their respective by -laws numbered -7C-e and, ;`J, authorized the entering into and execution of this Agreement; NOW THEREFORE, in consideration of the premises and covenants hereinafter contained, the Town and the Township HEREBY MUTUALLY AGREE AND COVENIVT AS FOLLOWS: 1) The services of the Bowmanville Fire Brigade shall be available to fight fires in the Township when called upon, except that the Fire Chief shall have the right to decide what, if any, equipment shall answer any call. 2) The Township shall, annually, pay to the Town., Fifty Per Cent of the cost of operation of the Bowmanville Fire Department, and in any year in which the number of fires in the Township exceeds f if ty per cent of the total, the Township shall pay to the Town an additional amount in direct relation to the proportion of fires occurring in the Township as opposed to those which occur in the Town. 3) For the purposes of this agreement, costs incurred shall be as follows: a) Capital debt retirement including both principal and interest on acquisition of machinery equipment, buildings or other assets acquired by the Town for the use of the Fire Department over more than one year. In this connection, the present quarters at Church Street, Bowmanville, shall be assessable to the Fire Department at 25% of the total annual charges for the Building. b) Capital Expenditures out of current revenue. Capital Expenditures included in paragraph 3 (a) and 3 (b) shall be subject to approval of the Council's of'the Town and the Township. c) Maintenance and overhead charges.
