A by -law respecting parking meters on
highways in the Town of Bo-vmanville
The Council of the Corporation of the Town of Bowmanville HEREBY
ENACTS AS FOLLOWS:
1. In this by- lati•T:
a) "parka' or "park ing" when prohibited, means the standing
of a vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
b) 'sparking meters means an automatic or other mechanical
device, with the necessary standard for same, for the purpose
of controlling and regulating the parking of any vehicle in a
parking space and measuring and recording the duration of
such parking;
c) 'sparking spacer' means a portion of the surface of the
roadway the use of which for parking vehicles is controlled
and regulated by a parking meter;
d) "vehicle" includes a. motor vehicle, trailer, traction
engine, farm. tractor, road- building machine and any vehicle
drawn, propelled or driven by any kind of power, including
musc4lcr pourer, but does not include a motorized snow
vehicle, the cars of electric or steam railways running only
upon rails;
e) -.,There any expression of time occurs or where any hour or
other period of time is stated, the time referred to shall
be standard time except in periods when daylight saving time
is in effect, in -which periods it shall be daylight saving
time.
2. inhere in this by -law a fee is stipulated for a given parking
period in a parking space, the fee shall be paid for that period or my
portion thereof, and the period shall be as measured by the parking meter
controlling such parking space.
3. The erection, maintenance and operation of parking meters on the
highways, at the sides and between the limits set out respectively in Columns
1, 2 and 3 of Schedule "I," to this by -law for the purpose of controlling and
regulating parking during the days and hours set out in Column 4 of the said
Schedule and the designation of parking spaces in connection with such :peters,
is hereby authorized.
4. Notwithstanding the provision of any other by -law where parking
meters have been erected under the authority of Section 3 hereof, no person
shall park any vehicle in a parking space on any highway, at the si a and
between the limits set out respectively in Coium -is 1, 2 and 3 of the said
Schedule "All hereto during the days and hours set out in Column G of the said
Schedule unless the meter controlling such parking space is used and a fee is
deposited therein_ in accordance with the rate set out in Column 5 of the said
Schedule.
5. Where parking :peters have been erected under the authority of Section
3 hereof, no person shall park any vehi._1e. in a parking space on any high,,,
at the side and between the limits set out respectively in Columns 1, 2 and 3
of the said Schedule "AP hereto during the days and hours set out in Column 4-
of the said Schedule for a longer period than that set out in Column 6 of the
said Schedule.

60 Where parking meters have been installed under the authority of
Section 3 hereof:
a) if parallel parkin- is permitted, no person shall park a
vehicle in a par ?_ing space unless the front -hecls of such
vehicle are opposite to the parking meter provided for such
space except that, in any case when two meters are mounted
on the same standard, the rear of the forward vehicle shall
be opposite to or as close as is practicable to the forward
parking meter and the front of the rear vehicle shall be
opposite to or as close as is practicable to the rear rceter;
b) if angle parking is permitted, no person shall park a
vehicle in a parking space unless the front of such vehicle
is as close as is practicable to the parking meter for such
space;
c) if a parking space has been designed by lines painted on
the roadway, no person shall park any vehicle in such a manner
that it is not wholly within the area designated as a parking
space unless such vehicle is of such length as to render it
impossible to park it in one parking space in which case the
adjoining parking space shall, in addition, be used, and the
necessary deposit of coins shall be made in the parking meters
provided for both parking spaces.
7. I--o person shall deposit or cause to be deposited in any parking meter
any slug, device or other substitute for a coin of the Dominion of Canada or of
the United States of imericao

No person shall deface, conceal, injure, tamper -,with, open or -,:ilfully
break, destroy or impair the usefulness of any parking meter erected under t ?:e
authority of this by -law.
9. The provisions of this by --lc7u shall not, if coiaplianc.^_ therewith iT011ld
be impracticable, apply to vehicico actually engaged in works undertaken for or on
behalf of the Town of Bo�-mlanvillc, the Public Utilities Commission of the To -,, �n of
Bowmanville, ambulances, Fire or Policc Department vehicles.
10. Any person violating the provisions of Sections 4, 5 and 6 of this
by -lau shall be subject to a penalty for the -first offence to a fine of not less
than $5,00 and not more than $50 and for any subsequent offence to a fine of not
less than $10 and not more than $100, and in addition, his licence or permit may
be suspended for a period of not more than thirty days.
llo Notwithstanding all other provisions of this by-law in respect to
penalties for violation of the provisions of this by -iavT, any person may, upon
presentation of a parking violation tag issued by the Bowmanville Police Force,
or By -Law Enforcement Officer, alleging conraission of any of the offences under
this by -law set out in Sections 4, 5 and 6 hereof, pay to the Municipal Treasurer
or other municipal employee designated by him at the Town. Hall, the sum of $1000
as a penalty for and in full satisfaction of such violation, within forty -eight
(48) hours of the time when notice of sucz violation was affixed to the vehicle
(exclusive of Sundays and Holidays) and such Municipal Treasurer or other municipal
employee is hereby authorized to accept such payment and to furnish an authorized
receipt therefore.
12. Any person_ violating -b-he provisions of Sections 7 and 8 of this by -law
shall be subject to a penalty of not more than $10000 for the first offence and
not more than $50,00 for any subsequent offence, exclusive of costs and all such
penalties shall be recoverable under The Summary Convictions Act,
13. Nothing in this by -law shall permit a driver to stop or park at any
location -,,There, or at any time when, stopping or parking is otherwise prohibited.

14. L"4otv7iths tazc'ing anything to the contrary contained therein, the Chief
of Police, during any emergency or special circu.stances deemed sufficient there -
fore, may b-; the use of appropriate signs or signals suspend the movement of any
or -Ii traffic on anv street or portion thereof covered by this by -law and /or any
parking thereon may be suspended by authorizing the affixing of "I,o Pa r'_:irg"
signs to each parking meter provided furt er that during such emergency the Chief
of Police i_.ay declare that sny vehicle already perked within the said arc,_ is being
parked illegally regardless of the time permitted for parking such vehicle under
the provisions of this by -1,w and notwithstanding that the period allowed to the
owner or operator under Section 2 hereof, has not expired, provided ho over in
this event the owner or operator of such vehicle is personally notified by a
Police Officer that parking within this area has been suspended, aLid further
that the owner or operator is allowed a reasonable time to remove said vehicle.
15, That B;7 -Law No. 1663 and By -Law No. 70 -40, and all other by -laws of
the Town of Boirmanville which are inconsistent with the provisions of this
by -law are hereby repealed.
16. This by -law shall not become effective until approved by the Department
of Transport of Ontario.

The Council of the Corporation of the Town of Bovmanville HEREBY
EPACTS AS FOLLOWS:
1> In this by -law:
a) "park" or "parl_ing" when prohibited, means the standing
of a vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
b) '?parking meter" means an automatic or other mechanical
device, with the necessary standard for same, for the purpose
of controlling and regulating the parking of any vehicle in a
parking space and measuring and recording the duration of
such parking;
C) ?'parking space" means a portion of the surface of the
roaduray the use of which for parking vehicles is controlled
and regulated by a parking meter;
d) "vehicle" includes a rotor vehicle, trailer, traction
engine, farm tractor, read- building machine and any vehicle
drawn, propelled or driven an-,,- kind of pourer, including
muscular pourer, but does not include a motorized snow
vehicle, the cars of electric or stea=a railways running only
upon rails;
c) where any expression of time occurs or where any hour or
other period of time is stated, the time rcfcrrcd to shall

20 Where in this by -la,,r a fee is stipulated for a given parking
