HomeMy WebLinkAbout70-2THE CORPORATION OF THE TOWN OF BOWMANVILLE By -Law No. -40- A by -law authorizing the obtaining of temporary advances to meet the cost of certain works under- taken pending the completion thereof. WHEREAS, with the approval in writing of the Ontario Municipal Board, the Municipal Council of the Corporation of the Town of Bowmanville has passed Construction By -Law No. 69 -6 authorizing the construction of the works described in it as a water filtration plant, the estimated cost of which. works is $450,000.00, copies of which by -law and approval are annexed hereto. AND WHEREAS it is desirable to agree with a bank for temporary advances to meet the cost of the said works pending the completion thereof. BE IT THEREFORE ENACTED by the said Council as follows: 1. The Head and Treasurer of the Corporation are hereby authorized to obtain from the Bank of Montreal temporary advances at a rate or rates not exceeding 82 per cent per annum represented by a promissory note or promissory notes or otherwise not exceeding Four Hundred And Fifty Thousand dollars to meet the cost of the said works pending the completion thereof. 2. A promissory note or notes or other vouchers, sealed with the Corporate Seal and signed on behalf of the Corporation by the Head and Treasurer thereof, for the advances from time to time obtained under the authority hereof and interest thereon, may be given to the said Bank providing for the repayment of or representing the said advances with interest thereon as aforesaid. 3. The Treasurer of the Corporation is hereby authorized and directed to apply first in payment of such advances with interest thereon as aforesdd all moneys borrowed on the credit of the Corporation to repay such advances and to defray the cost of the said works and all moneys from other sources properly applicable to the cost of the said works.:, Passed by the said Council this 'f day of y , 19 7 . I certify that the foregoing is a true copy of a By -Law passed by the Council of the Municipal Corporation of the Town of Bowmanville on the day of ,. , 1976, and that the paper- writing hereto annexed is a true copy of Construction By -Law No. 69 -6, passed by the said Council on the Seventh day of April, 1969. r Y � -- Clerk The Corporation Of The Town Of Bowmanville By-Law No. 69-6 Being a by-law to authorize the construction of a water filtration plant. wHEREAS the Council of the Corporation of the Town of Bo-mmanville deems it desirable to construct a water filtration plant to serve the Town; AND WEREAS the work includes modifications to existing pumping station, a filter plant with a capacity of 2.0 million gallons per day, 800,000 gallon reservoir and a new high lift pumping station; NOW THEREFORE the Council of the Corporation of the Town. of 13owmanville, pursuant to the provisions of Section 379, subsection 1, paragraph 52 of The Municipal Act R.S.O., 1960, Chapter 249, hereby ENACTS AS FOLLOWS: 1. That a water filtration plant be constructed on Smart Avenue at a total estimated cost of $450,000. 2. That the Mayor and Clerk be and are hereby authorized to do all acts and sign all documents and affix the corporate seal of the Town hereto as may be necessary in connection with making cop-tracts and other matters for the completion of the said undertaking. 3. This by-law shall not take effect until it receives the approval of the Ontario Municipal Board pursuant to sections 63 and 64 of The Ontario Municipal Board Act, R.S.O. 1960, Chapter 274 and mr-endments thereto.
