HomeMy WebLinkAbout1901THE CORPORATION OF THE TOWN OF BO ANVILLS BY -LAW No. /17,0/ A by -law to allow encroachments of the Bowmanville Hotel on King andDivision Streets. WHr3RBAS a survey of theBowmanville Hotel formerly known as the Balmoral Hotel being lot 32 in Block "R" according to Grants Plan at the corner of King and Division Streets has revealed encroachments of a cement entrance veranda and steps, the brick pillars and balcony, and the roof covering that part of the said and balcon veranda /on King Street, and certain window walls on Division Street. AND WHERSAS the said encroachments have occurred inadvertently and have in fact been established for many years. AND WHIRSAS Thomas Maryglad and Theodosia Maryglad, the owners of the Bowmanville Hotel have requested the Town of Bowmanville to pass this by -law authorising the said encroachments, NOW THSRSFORR the Council of the Corporation of the Town of Bowmanville pursuant to the Municipal Act R.S.O. 1960 t apter 249 Section 379 (1) paragraph 94 H&RIBY ENACTS as follows; 1. That the said Thomas Maryglad and Theodosia Maryglad or the owners or occupants from time to time of the said Bow - manville Hotel being situate on lot 32 in Block "R" at the corner of King and Division Streets be allowed to main- tain and use the said hotel building and premises and the following encroachments as they now exist on King and Division Streets 'whhdrt asp shown outlined in red on a copy of a plan of survey made by Donovan and Fleischmann, dated April 29, 1961, annexed hereto and marked as Schedule "A". (1) On King Street the cement entrance veranda and f stepso the bricit Pill art and balcony and the root covering that part of the mad yerands. and balcony which encroach on Kung Street (2) Olk Division Street that part of the wind walls shown as aneroachind an the attached plan of sur"r. That the owners of the said hotel property pay to tb lows of Bowen villa an annual too of # % • ° —° in addva �e for the right to maintain and use the said eneroachments.
