BY -LAW NO. 'j d
A By --Law to stop up and close the Easterly 4 feet of
Division Street running Northerly from King Street for
a distance of 168 feet 3� inches and to provide for the
sale thereof to the abutting owners.
WHEREAS it has been established by survey that the
building known as the Bowmanville Hotel situate at the North East
corner of King and Division Streets in the Town of Bowmanville encroache..
on Division Street and the owners of the said a lands and premises have
requested the Council of the Corporation of the Town of Bowmanville to
close and sell to them as abutting owners the Easterly 4 feet of
Division Street running Northerly from king Street for a distance of
168 feet N inches.
AND WHEREAS the Council of the Corporation of the
Town of Bowmanville deems it advisable to pass a by -law to close the
said part of Division Street and provide for the sale thereof to the
abutting owners.
AND WHEREAS Notice of such by -law was published
in the Canadian Statesman, a weekly newspaper published in the Town of
Bowmanville in its issues dated the 5th, 12th, 19th and 26th days of
February, 1964.
AND WHEREAS no person will be deprived of the
means of ingress and egress to and from his land or place of residence
by the passing of this by -slaw.
AND WHEREAS no person or corporation claims that
his or its lands will be prejudicially affected by the passing of this
by -law.
NOW THEREFORE the Council of the Corporation of the
MWwn of Bowmanville pursuant to the Municipal Act R.S.O. 1960, Chapter
249, Section 459 (1) (c) and (d) and Section 477 (1) HEREBY ENACTS as
follows:
1. That the easterly 4 feet of even width throughout of Division Street
in the Town of Bowmanville, running Northerly from Ring Street for
a distance of 168 feet 31 inches and being more particularly
described in Schedule ..A.. hereto be and the same is hereby closed
and stopped up.
2. That the said part of Division Street hereby stopped up and closed
shall be offered for sale to Thomas Maryglad and Theodosia Maryglad,
the only abutting owners thereon at a prise of $1.00.

a conveyance of the said stopped up part of Division Street in
favor of the owners and impress the corporate seal thereon.

and finally passed this day of March.. A.D. 1964.

All and singular that certain parcel or tract of land and premises
situate, lying and being in the Town of Bowmanville in the County
of Durham and being the Easterly 4 feet of Division Street running
Northerly from King Street for a distance of 168 feet 3� inches
according to a Plan of the Village of Bowmanville on file in the
Registry Office for the Registry Division of the West Riding of the County
of Durham which plan was made by John Grant, P.L.S. and was registered
on the 20th day of April, 1852, the said part of Division Street
being more particularly described as follows:
COMMENCING at the South West angle of Lot 32, Block '.R.' according to
the said Grants Plan of the Village of Bowmanville;

or less to the North West angle

THENCE Westerly in the estension Westerly of the North limit of said
Lot 32 a distance of 4 feet;

a distance of 168 feet 32 inches to a point in the extension westerly of
the south limit of said Lot 32;
THENCE Easterly in and along said extension of said Lot 32 a distance of
4 feet more or less to the South West angle of the lot and the Point
of Commencement.
