HomeMy WebLinkAbout1883A BY -LAW TO REGULATE THE USE OF THE BOWMANVILLE MUNICIPAL DUMP. 'WHEREAS the Council of the Corporation of the Town of Bowmanville deems it is expedient to regulate the land owned by the municipality and used for dumping and disposal of GARBAGE and REFUSE located on Jackman Road. AND It.THEREAS Sec. 397 (1) Paragraph 112 of the Municipal Act R.S.O. 1960, Chapter 249 provides that By -laws may be passed by the Councils of local municipalities for prohibiting or regula- ting and inspecting the use of any land or structures within the municipality or any defined area or areas thereof for dumping or disposing of garbage, refuse or domestic or industrial waste of any kind; AND WHEREAS the Council of the Town of Bowmanville has satisfied themselves that the responsibility of the prevalent fires at the Dump lies with Non - residents of the Corporation; AND WHEREAS the smoke from the fires is deemed a nuisance and injurious to the health of residents of the Town of Bowmanville; NOW THEREFORE pursuant to the provisions of section 379 (1) Paragraph 112 of the Municipal Act R.S.O. 1960, Chapter 249, the Council of the Corporation of the Town of Bowmanville enacts as follows: Lo 1. The Bowmanville Municipal Dump shall consist of land owned by the Corporation bounded on the South by Jackman Road on the East by Barbour's Creek on the West by the easterly limit of the property owned by Rhea Burns, and on the North by the southerly limit of the property owned by The Working Boy's Home of Toronto. •2. NO PERSON shall deposit waste at the Bowmanville Municipal Dump unless he is a resident�'or taxpayer within the boundaries of the Corporation of the Town of Bowmanville. I Lin 2 3. NO PERSONS shall be- allowed -.#we set fire to any garbage or refuse deposited in the Bowmanville Municipal Dump. 4. NO UNAUTHORIZED PERSON shall remove anything which has been deposited in the Bowmanville Municipal Dump. Any person violating any of the provisions of this By- law shall, for each offence be liable to a penalty not in excess of Three Hundred Dollars ($300.00) exclusive of cost, the same be recoveralbe under the provisions of the Ontario Summary Conviction Act. Any By -law inconsistant with the provisions of this By -law are hereby repealed.
