HomeMy WebLinkAbout1726Being a by -law for the submission to a vote of Questions 7 and 8 as set out in Section 69(1) pursuant to Section 24(1)(a) of The Liquor Licence Act. WHEREAS pursuant to Section 24( 1)(a) of The Liquor Licence Act, the Liquor Licence Board of Ontario shall not issue a dining lounge or a lounge licence to hotels, inns or taverns in a municipality in which such licences have not been issued heretofore unless or until an 'affirmative vote has been taken on Que stions 7' and 8 as set out in Section. 69(1) of the said Act. AND WHEREAS under Section 69(1) of The Liquor Licence Act, the Council of a municipality may sub; mit to a •vote of the persons qualified to be enter e d onthe Vote r s List and to vote at Ele ctions to the As s e'mbly in the muni - cipality any questions set forth in The Liquor Licence Act, AND WHEREAS the Council of the municipality did deem it expedient and desirable 'to submit to a vote of the persons qualified to , vote thereon as afore-' a aid, the following questions among others: - Are you in favour of the sale • of ' liquor under a dining lounge licence,. for, consumption with meals on licensed premises ? Are you in favour of the sale of liquor under a lounge licence for consumption on licensed premises ? AND WHEREAS the Council having requested the Board to fix a day, for the taking -of a vote on the questions, the Board, fixed Wednesday the" 19th day of November, 1958. AND WHEREAS the Council of the Municipality on 'the 2nd day of ' September, 1958 passed By -Law No: 1691 which said by -law submitted to the persons, qualiftVd to vote thereon the following questions among others under The Liquor Licence Act, - Are you in favour of ,the, sale of liquor under a dining lounge licence for consumption with meals on licensed prexnises'2 - w. Are you in favour of the sale of liquor under a lounge licence for consumption on licensed premises ? AND WHEREAS the vote on the said questions was held on the 19th day, of November, 1958. in accordance with said By-Law No.. 1691., AND WHEREAS His Honour J. de N. Kennedy, Judge of the County ` 4 Court of the United Counties of Northumberland and Durham by an Order dated the Und day of ,April, 1959 set aside and declared invalid the vote on the said two , questions. a AND WHEREAS the Board has been requested by the Municipal Corporation of the Town of Bowmanville to set a date for a re -vote under the pro - visions of The Liquor Licence Act upon the said two questions. AND WHEREAS the Board has fixed Wednesday h e ay t e awl day of September, 1959 as the day upon which the vote on the said questions shall be taken and has notified the Clerk to that effect.
