THAT Report PD-217-87 be received; and 2. THAT the proposed amendment to the Town of Newcastle Official Plan to revise the r•equi r•ement for• the pr•epar•ati on and amendment of Nei ghbour•hood Development P1 ans for• the Cour•tice Urban Area not be approved; and 3. THAT Amendment Nos. 3 & 4 to the Cour•tice ulest Neighbourhood Development Plan be * approved and the amending documents, attached hereto as Attachment Nos. 1 & 2, be forwarded to Council far approval; and 4. THAT Amendment No. 1 to the Cour•tice South Neighbourhood Development Plan be * approved and the amending documents, attached hereto as Attachment No. 3, be for•war•ded to Counci 1 for• approval ; and ...2 C~~ REPORT NO.: PD-217-87 Page 2 5. THAT the Region of Durham be requested to approve an amendment to the Town of Newcastle Official Plan to designate a collector road and a Neighbourhood Park in the Cour•tice West Neighbour•hood,~to redesignate a 0.5 hectare site at the southeast corner of Highway No. 2 and Pr•estonvale Road from "Special Purpose Commercial_Node" to "Residential",~ and to delete the collector roads in the Cour•tice * North Neighbourhood 3B, all as indicated by Attachment No. 4 hereto; and 6. THAT the related amendments to the Cour•tice West, Cour•tice South and Cour•tice North Neighbourhood Development Plans, attached hereto as * Attachment Nos. 5, 6 & 7 respectively, be approved and the amending documents for•war•ded to Council for• approval at such time as the necessary Official Plan Amendment is approved by the Region of Durham; and 7. THAT a copy of Council's decision be for•war•ded to the Region of Durham and the interested parties indicated hereto. BACKGROUND AND COMMENT: In accordance with Council direction, a public meeting was held at the Cour•tice Secondary School on June 29, 1987 in or•der• to obtain public input on the proposed amendments to the Town of Newcastle Official Plan for• the Cour•tice Urban Area and the Cour•tice Neighbourhood Development Plans. Staff have the following comments and recommendations to make on each of the proposed amendments. 1. PREPARATION OF NEIGHBOURHOOD DEVELOPMENT PLANS Staff had proposed an amendment to the Town of Newcastle Official Plan to br•i ng the r•equi r•ement for• the pr•epar•ation and amendment of Nei ghbour•hood Development Plans into line with that r•equir•ed for• Bowmanville and Newcastle ...3 ~( ~/ REPORT NO.: PD-217-87 Page 3 Vi 11 aqe. Thi s woul d i ntr•oduce a gr•eater• degree of fl exi bi 1 i ty i nto the development approval process. Comments provided by the public at the Public Meeting indicated a fair degree of support for• r•etai ni ng the requi r•ement for• the prepar•ati on and amendment of Neighbourhood Development Plans. Residents wanted a detailed indication of the future pattern of development in their neighbourhoods. Staff note as well that Neighbourhood Development Plans may be war•r•anted in Cour•ti ce due to a gr•eater• extent of existing str•i p r•esi denti al development and the lack of municipal services. It is ther•efor•e recommended that the proposed amendment to revise the requi r•ement for• the pr•epar•ati on and amendment of Nei ghbour•hood Development Plans not be approved. 2. COURTICE bJEST NEIGHBOURHOOD a) It has been proposed to extend the r•e-aligned Var•coe Road north and east to inter•sert with Tooleys Road, and designate same as a collector. The delineation of the collector road in the Town of Newcastle Official Plan and the Neighbourhood Development Plan is important in that only one option, being a vacant lot on Tooleys Road which is eligible for• a residential building permit, is available for• the connection. It has also been proposed to redesignate a wood lot in the northeast sector of the Neighbourhood from "Minor Open Space" to "Residential", with a small "Minor Open Space" and pedestrian walkway connection being retained to Tooleys Road. The entire site is designated "Residential" by the Cour•tice Urban Area Plan and, at the time of the pr•epar•ation of the Neighbourhood Development Plan, vas identified by the Central Lake Ontario Conservation Authority as being environmentally sensitive. The western portion of the woodlot is the subject of an application by Mssr•s. Schleiss and Holland to amend the Neighbourhood Development Plan to permit the development of Subdivision Plan 18T-86068. An Environmental Study submitted by the ...4 Cp~ REPORT NO.: PD-217-87 Page 4 applicant's consultant states that the woodlot is a seasonal wetland with no i ndi vi dual elements of par•ticul ar• significance or• r•ari ty being found. A number of objections to the proposed r•edesignation have been submitted. Central Lake Ontario Conservation Authority has stated that the presence of many common and some uncommon plant and bird species qualifies the site as an environmentally sensitive area according to Section 1.2.1(b) of the Durham Regional Official Plan. Authority Staff ar•e of the opinion that the integrity of the sensitive area cannot be maintained if development occurs, and disagree with the conclusions of the environmental study submitted by the applicant. Letters from one (1) area resident and from Mr•s. Jane Rowe on behalf of the Cour•tice and Area Community Association expressed a desire to have the woodlot retained as a passive open space. A resident along Tooleys Road, whose pr•oper•ty is affected by the small area of "Minor• Open Space" being retained, has requested an adjustment to the location of same. In view of the residential designation in the Official Plan and the fact that the requested Environmentally Sensitive designation was rejected during consideration of Amendment 19 to the Durham Regional Official Plan, Staff ar•e of the opinion that public ownership is the only means of protecting or• pr•eser•ving the woodlot. Given the proximity of urban development and the existing and potential intrusion and degradation resulting ther•efr•om and, given hi ghee pr•i or•i ti es by the Town and Central Lake Ontario Conservation Author•i ty for• publ i c pr•oper•ty acquisitions, Staff do not recommend acquisition of this area. We do however, support pr•eser•vation of healthy tree specimens wher•ever• possible and feel that control of subdivision design and construction activities will facilitate meeting this objective. With respect to the request of the Tooleys Road resident to the retention of the "Minor• Open Space" or• hi s pr•oper•ty, Staff note the "P~li nor• Open Space" designation being retained coincides with a proposed pedestrian walkway connecting to Tooleys Road already indicated by the PJeighbour•hood ...5 ~~~~ REPORT NO.: PD-217-87 Page 5 Development Plan and was intended to continue a Minor• Open Space System cur•r•ently extending from Nash Road. As well, as shown by aerial photography pr•ovi ded through the Gar•tner• Lee Study, the Minor• Open Space bei ng r•etai ned r•epr•esents a forested link between the existing woodlot and Tooleys Road. However, inasmuch as the amehdment being proposed would redesignate the main portion of the woodlot to "Residential", Staff see no merit in retaining the designation on this smal 1 por•ti on. Accor•di ngl y, Staff ar•e r•ecommendi ng that this area of Minor• Open Space be redesignated to connect with the Var•coe Road extension. This would maintain the intent of a pedestrian walkway connection to Tooleys Road and provide less disruption to the potential residential development of adjacent lands. As a result of this revision, Staff ar•e also proposing a minor revision to the possible road patterns. Accordingly, Staff recommend that Amendment PJo. 3 to the Cour•tice West Neighbourhood Development Plan, attached hereto as Attachment No. 1, to redesignate the "Minor• Open Space" to "Residential" and to establish road patterns be for•war•ded to Council for• approval. The Population Schedule is also being amended to reflect the deletion of the "Minor• Open Space". As well, minor amendments to the text ar•e being proposed to reflect the deletion of the Minor• Open Space and the removal of Adelaide Avenue, previously approved as Amendment No. 20 to the Official Plan. The amendment designates the Var•coe Road extension as a collector road. It is ther•efor•e also recommended that the Region of Durham be requested to approve the r•equir•ed amendments to the Town's Official Plan to designate the Var•coe Road extension as a collector, as shown by Attachment No. 4 hereto. b) Land use designations and a road pattern for• the area west of Var•coe Road and north of Nash Road, as well as associated revisions to the Population Schedule, have been proposed. This area was brought into the Courtice Urban Area through the partial approval of Amendment No. 22 by the ...6 ~~~ REPORT NO.: PD-217-87 Page 6 Ministry of Municipal Affairs on July 4, 1986 and, as approved, indicated a Neighbourhood Park in the southern area and a "Major Open Space" designation adjacent to Harmony Creek. A number of residents expressed concern at the Public Meeting in respect of the size of the Neighbourhood Park and its proximity to the Oshawa boundary. Concern was also given over the proposed elimination of Old Varcoe Road north of where the main road deviates from the road allowance between Lots 34 & 35. As was noted by Staff at the Public Meeting, the Neighbourhood Park is being pr•ovi ded to serve the r•esi dents of the nei ghbour•hood. Staff have r•evi sed the proposed amendment to indicate the area of the park as 2.0 ha. As well, in response to the concerns expressed r•egar•ding the closing of Old Varcoe Road, the proposed amendment has been revised to indicate the retention of the road. The Amendment also proposes minor amendments to the text to reflect the i ncr•eased area of the Nei ghbour•hood and i ncr•eased par•kl and r•equir•ements for• Neighbourhood residents. It is ther•efor•e recommended that Amendment No. 4 to the Cour•tice West Neighbourhood Development Plan, * attached hereto as Attachment No. 2, to establish landuse designations and road patterns and to revise the Population Schedtale for• the area west of Varcoe Road north of Nash Road, be for•war•ded to Council for• approval. c) It has been proposed to redesignate a Par•kette in the southern por•ti on of the Cour•ti ce West Nei ghbour•hood to a Nei ghbour•hood Park, wi th a concur•r•ent increase in area. No residents spoke to the proposed amendment at the Public Meeting. However, a petition with 18 names was submitted to the Planning Department objecting to the present designation of a "Par•kette" on the east side of Dar•1 i ngton Boul evar•d. I nfor•mati on was also pr•ovi ded to Staff indicating that, in 1968, a plan of subdivision was r•egister•ed on the lands on which the par•kette is designated and that the land owner paid his 5% in lieu of parkland contribution to the for•mer• Township of Darlington. ...7 ~~~ REPORT NO.: PD-217-87 Page 7 Staff note, as well, given the designation of the Neighbourhood Park as proposed by this Amendment, that the par•kette is no longer needed. Staff note that the Neighbourhood Park must be designated in the Town's Official Plan. It is ther•efor•e recommended that .the Region of Durham be requested to approve the neressar•y Official Plan Amendment as shown by * Attachment No. 4 hereto. It is fur•ther• recommended that the subject amendment to the Cour•tice West Neighbourhood Plan to designate the Neighbourhood Park and to delete the par•kette on Darlington Boulevard (see Attachments) be approved. 3. COURT ICE SOUTH NEIGHBOURHOOD a) It has been proposed to revise the tr•anspor•tation network in the Neighbourhood Development Plan to provide an east-west collector road system to serve the Cour•tice South area and to better facilitate connections between the future GO Station in East Oshawa and the Community Central Area. One resident objected to the proposal at the public meeting, stating that it would increase the traffic on Glen Abbey Drive. Staff note that Glen Abbey Drive is cur•r•ently designated as a collector by the Neighbourhood Plan and ther•efor•e, the proposed amendment would not change the status of the road but would certainly improve circulation patterns and benefit the neighbourhood as a whole. It is recommended that Amendment No. 5 to the Cour•tice South Neighbourhood * Development Plan, attached hereto as Attachment Flo. 3, be for•war•ded to Counci 1 for• approval . b) It has been proposed to redesignate a 0.5 hectare site at the southeast cor•ner• of Highway No. 2 and Pr•estonvale Road from "Special Purpose Commercial Node" to "Residential" in the Official Plan, and to "Convenience Commercial" in the Neighbourhood Plan. Staff note that the site is more appr•opr•i ate for• "Convenience Commer•ci al " uses given the sur•r•oundi ng ...8 ~~J REPORT NO.: PD-217-87 Page 8 residential uses and that it is already zoned "Neighbourhood Commercial (C2)" by By-law 84-63. No one spoke on the proposed amendment at the Public Meeting. I t i s ther•efor•e recommended that the Region of Dur•harn be requested to approve the r•equir•ed amendment to the Town of Newcastle Official Plan, as * shown by Attachment No. 4. It is fur•ther• recommended that the Amendment to the Neighbourhood Plan (see Attachment No. 6) be approved by Council. 4. COURTICE NORTH NEIGfiB0URH00D It has been proposed to amend the Town's Official Plan and the Cour•tice North Neighbourhood Development Plan to delete the collector road system in Neighbourhood 3B. Due to the site char•acter•istics of the Neighbourhood and existing approvals, the deletion of the collector system would provide Staff with gr•eater• flexibility in dealing with individual development applications. No one spoke at the Public Meeting in respect of the proposed amendment. It is ther•efor•e recommended that the Region of Durham be requested to approve the r•equir•ed amendment to the Town of Newcastle Official Plan, as * indicated by Attachment No. 4 hereto. It is fur•ther• recommended that the amendment to the Neighbourhood Development Plan be approved and the actual amendments for•war•ded to Council for• approval at such time as the Region has approved the pr•er•equisite Official Plan Amendments. BASIS: This Amendment is based upon the review of a development proposal for the northern portion o~f Neighbourhood la. ACTUAL AMENDMENT: The Courtice West Neighbourhood Development Plan is hereby amended as follows: 1. Section 2.4.2 is amended by deleting the last three sentences of the Section in their entirety. 2. Section 2.6.1(i) is amended by deleting the following words from the first sentence "and at some time in the future by a proposed extension of Adelaide Avenue, also a Type B Arterial, along the northern limit the Neighbourhood". 3. Schedule 1 entitled "Land Use Structure Plan" is hereby amended as indicated by Schedule "X-1" to this Amendment. 4. Schedule 2 entitled "Population" is hereby amended as indicated by Schedule "X-2" to this Amendment and by making the associated change to the Total Population Figure for the Neighbourhood. 5. Appendix A entitled "Student Generation" is hereby amended by increasing the figure for 'Estimated Total Population' by 370 persons, and by making the associated revisions to the other figures in Appendix A. Schedules "X-1" and "X-2" attached hereto shall form part of this Amendment. IMPLEMENTATIOPJ: The provisions set forth in the Courtice West Neighbourhood Development Plan, as amended, regarding the implementation of the Plan shall apply in regard to this Amendment. BASIS: This Amendment is based upon the expansion of the Urban Area to the west of Varcoe Road. ACTUAL AMENDMENT: The Courtice West Neighbourhood Development Plan is hereby amended as follows: 1. Section 1.3 is amended by replacing the number "165" in the second line of the third paragraph with the number "205". 2. Section 2.15 is amended by replacing the number "4300" in the second line with the number "5800". 3. Section 2.3.2 is amended by replacing the numbers "5.0" and "3.5" in the Fourth line with the numbers "8.5" and "5.0". 4. Schedule 1 entitled "Population" is hereby amended as indicated by Schedule "X-2" to this Amendment and by making the associated change to the Total Population Figure for the Neighbourhood. 5. Schedule 2 entitled "Population" is hereby amended as indicated by Schedule "X-2" to this Amendment and by making the associated change to the Total Population Figure for the Neighbourhood. 6. Appendix A entitled "Student Generation" is hereby amended by increasing the figure for "Estimated Total Population" by 1000 persons, and by making the associated revisions to the other figures in Appendix A. BASIS: This Amendment is based upon the need to provide a continuous collector system to serve the Cour•tice South Neighbourhood and to provide a more direct connection to Townline Road South and the proposed new GO Station in East Oshawa. ACTUAL AMENDMENT: The Cour•tice South Neighbourhood Development Plan is er•e y amended as follows 1. Schedule 1 entitled "Land Use Str•uctur•e Plan" is hereby amended as indicated by Schedule "X" to this Amendment. Schedule "X" attached hereto shall form part of this Amendment. IMPLEMENTATION: The provisions set forth in the Cour•tice South egg bour•hood Development Plan, as amended, r•egar•ding the implementation of the Plan shall apply in r•egar•d to this Amendment.
