MINUTES Resolulion #GPA-163-01 Moved by Councillor Rowe, seconded by Councillor Trim THAT Ihe minutes of a regular meeting of the General Purpose and Adminislration Committee held on March 5, 2001 be approved. "CARRIED" PRESENTATION (a) Dominic Iafrate, Site Vice President, Gene Preston, Chief Nuclear Officer and Phil LeSauvage, Public Affairs Manager, Ontario Power Generalion Station made a presenlation demonslrating Darlington Nuclear Performance in 2000. Mr. Maher advised that the preference of the residents is to be wilhout a sidewalk but, if sidewalks must be inslalled, Ihey should be constructed as shown on the original plan, which is around the court and not through it. Councillor Schell chaired this portion of the meeting. Pursuant to the Planning Act, the Council of the Municipality of Claringlon, through its General Purpose and Adminislration Committee, is holding a Public Meeting for the following application: (a) Rezoning Applicalion Applicant 1138337 Ontario Limited (Kaitlin) Port of Newcastle, Lots 28/29, B, F. Concession, Former Township of Clarke -1138337 Onlario Limiled (Kaitlin) The Clerk's Department sent public notice for the rezoning applicalion by first class mail on or before February 23, 2001 to all property owners within 120 metres of Ihe subject property in accordance wilh the latest municipal assessment record. In addition, notices were also posted on the sites prior to February 23, 2001. This notice procedure is in compliance with Ontario Regulalion made under the Pianning Act (a) Report PD-026-01 - 1138337 Ontario Limited (Kaitlin) - the purpose and effect of the application is to: i) Rezone Block "A" from "Holding - Urban Residenlial Exception ((H)R4-18)" to an appropriate zone to permit Ihe development of 40 townhouse units; ii) Rezone Block "B" from "Holding - Urban Residential Exception ((H)R4-19)" to an appropriate zone to allow the development of 12 townhouses in addition to other uses permitted in the R4-19 Zone; iii) Rezone Block "C" from "Holding - General commercial exception ((H)C1-23)" to an appropriate zone 10 permit the development of 12 townhouses in addilion to other uses permitled in the C1-23 Zone. 3 rQ 2 G.P. & A. The following individuals advised that they had not received nolification by mail: Candace Parsons, 75 Beacham Court, Newcastle, L1 B 1 N1 Chris Muscat, 7 Waterview Lane, Newcastle, Dave Pallerson, 93 Carveth Cres., Newcastle, L 1 B 1 N4 Samuel Jones, 35 Carveth Cres., Newcastle, L 1 B 1 N4 Douglas Badgers, 48 Carveth Cres., Newcastle, L 1 B 1 N4 requested thai, since this is a small community, all residents be advised of a public meeling. Rick Law, 208 Shipway Avenue, Newcastle, L 1 B 1 M9 circulaled a pelilion of persons opposed 10 this projecI and advised that residents were not told when Ihey purchased their home that the plan of subdivision conlained lownhouses, condominiums or apartments. He see ked clarification on how ownership or renlal of a unit is affected by the zoning of Ihe land. Samuel Jones, 35 Carveth Cres., Newcastle, L 1 B 1 N4 noled thai, at the time of purchasing his home, he asked Ihe agent on the site if townhouses or condominiums were included in Ihe plan of subdivision and was advised that they were not. Had he known this information, he would not have purchased property at this location. . Anita Ray, 70 Carveth Cres., Newcastle, L 1 B 1 N4 advised that she gave up her business in Toronlo to move 10 a small, friendly community and advised that she has losl faith in the builder. She concurred with the comments made by previous speakers. She expressed concerns pertaining to increased traffic and apartment renlals being allowed in this subdivision. Michael Hoos, 45 Carveth Cres., Newcastle, L 1 B 1 N4 fears that he will lose his beautiful view and concurred wilh the previous speakers. Dave Pallerson, 93 Carveth Cres., Newcastle, L 1 B 1 N4 referred to his correspondence dated March 23, 2001 to the Municipality wherein he and his spouse expressed concerns pertaining to their dissatisfaction and quality of their new home. He advised that some of the informalion given by the builder was erroneous and that the developer has not lived up to his promises. Mary Beth Gibbon, 45 Port of Newcastle Drive, Newcastle, L 1 B 1 M8 expressed objection to this developmenl on the basis that the perspective purchases were not fully informed of future development and were told Ihat a golf course would be developed, not a putting green. No one spoke in support of Ihe application. . Kelvin Whalen, The Kaillin Group, 1029 McNicolI Avenue, Scarborough, M1W 3W6 advised that there will be no rentals conslructed on this site. He noled Ihat Ihe map which was displayed at the sales pavilion reflected Ihat there would be future residential development. "CARRIED" Resolution #GPA-195-01 Moved by Councillor MacArthur, seconded by Councillor Rowe WHEREAS the Officers of our Animal Services Department are hampered in their ability to perform their duties by nol having the appropriate legal protection; and WHEREAS such legal prolection is offered to Humane Society Officers through the advised Slatutes of Ontario, Chapter 0.36, Sections 11 - 19, Ontario Society for the Prevention to the Cruelty of Animals Act; and WHEREAS our animal Services Officers are working towards the same goals and offering the same services, protection and sheller for animals as is the Humane Society; NOW THEREFORE BE IT RESOLVED that the Provincial Legislature be asked to extend the legal protection offered by the aforementioned Slalules to our Municipal Animal Services Officers in Clarington and in the rest of the Province.
