Meeting of Committee 6f .,djustment, August 26, 1968:
The Secretary reported that 22 notices of the said hearing
had been mailed in accordance with Item 4 of The Rules of Procedure.
Mr. Otto Coatham, on behalf of his wife and accompanied by
the agent W. Kay Lycett B.A., Barrister & Solicitor, of Orono,
Ontario appeared in sup, -ort of this application. Also ap.earing
were Mr. & Mrs. James Middleton, Orono, Ontario. No other person
appeared in support of, or in opposition to this application.
The Secretary -Treasurer presented the following material to the
meeting:
(1) Correspondence from W. Kay Lycett B.A., Barrister
& Solicitor, Orono, Ontario, dated August 15, 1968.
The Committee duly noted the contents thereof;
(2) A pencil sketch of the proposed severance prepared by
Mrs. Hilda Hazel Coatham.
Pir, W. Kay Lycett, as agent for the applicant, made the following
submissions:
(1) Mrs. Coatham presently owns'a duplex dwelling house
facing Mill Street in the Village of Orono and this
property also fronts on a side street shown on Hannino's
Plan of the Police Village of Orono.
(2) Mrs. Coatham proi:oses to sever the rear portion cF her
present holding so ac to retain 10,000,square feet
of the front portion o- the property upon which is situate
the durlex dwelling and the subject property to be separated
is to be composed of the balance of her holding which she
would like to convey to her husband for the erection of a
dwelling house thereon and this subject property will front
on the unnamed street to the north.
Mr. Coatham was invited to make his submissions which were as
follows:
(1) He owns a farm on Lot 20, Concession 5, in the
Township of Clarke and is presently living there with
his wife;
(2) He wished to terminate his farming operation, move into
Orono and build a new house. The large lot at the rear
of the diplex dwelling seemed a logical solution for this
purpose.
(3) Municipal water is available.
The Committee considered the facts as presented and this applicat-
was adjourned to enable the Committee to visit the site on Thursd ,
August 29, 1968.

on motion by E.F.R. Osborne and seconded by K. Schoenmaker. Carried.

As a matter of record the Committee visited the following
properties on Thursday, August 29, 1968:

As business arising from minutes of August 26, 1968 this
application was presented for further consideration.
The Committee noted that the 1)reperty concerned was located
on the East side of a North South asphalt surfaced road which
runs North from No. 2 Highway, one mile East of Newcastle.
Five houses on large sized lots line the East side of the
road le ving a space of 3161from the last severed home to the
South edge of the old farm house owned by the applicant.
The subject land is the Soutnerly portion of this frontage.
One house sits on the "vilest side of the road in a North Westerly
direction from the subject land. This house is owned by one
Perry William Allin who appeared at the previous hearing (ref.
minutes August 26, 1968) to bring up the matter(f drainage. At
this point water flows North on the East side of the road and then
at the North side of the Allin property the water flows Westerly
under the road through a culvert followi.nn a natural run off near
the pond built by Mr. Allin.
The Committee examined the topography of the land and the
condition of the pond. Mr. Percy William :Min was not home but
in his absence, lair. Allin's father-in-law showed the Committee how
they had bulldozed a ditch to the North of the mond so the run off
did not enter the spring filled recreational pond.
The Committee could see no existing evidence of pollution and
were of the opinion that any pollution had apparently been corrected
and that the erection of one more house in this are-, would be an
infilling operation in keeping with the general character of the
area.
There being no reason why the proposed lot would not fit the .
area category of "R2" and bearing in mind the property was to be
conveyed to Federal :authority, the Committee were of the opinion
that this application should be granted.
Application granted on motion by E.F.R. Osborne, seconded by
K. Schoenm,�ker. Carried.

The Committee visited this property on August 29, 1968 and
the applicant's daughter was the only one home and she showed
the Committee the relevant surveyor's markings.

The particular facts of the case -were most important here.
The position c° the buildings and the orchard trees and the
rond made the proposed line of division the only feasible
division.
The Committee:
(1) Referred to the minutes of meeting of August
26, 1968; and
instructed the Secretary to require Mrs. Gibson to supply a
Sworn Affidavit signed by Gerald Gibson verifying all relevant facts
and in particular that the son was assisting her with the fruit
farming operation.
This applicati:_�n war, adjourned until such time as the Sworn
Affidavit is presented to the Committee for their formal decision.

this application was presented for further consideration.
The Committee visited this property on Mill Street on Thursday
August 29, 1968 and observed the following facts:
(1) A two storey white house of generous proportions
faced the street;
(2) A large white barn was attached to the rear of the
house which looked like an old carriage house. Also
at the rear was a cement casing which appeared to
be a well top.
(3) A road allowance ran along the North side of the
Coatham pro.erty and was almost completely overgrown
with grass, and as the road did not lead to anywhere
it was obviously used by an abutting owner as an
access driveway but was not in public use as a street.
(4) The property sloped away to the East and then at a
point 40' or 50' behind the buildings, drooped off
sharply into a low lying meadow which would be too
low for building purposes.
(5) The Committee were of the ouinion that it would be both
possible and feasible to build a house at the rear of the
existing duplex, particularly, if the old barn was -
demolished.
The Committee were of the opinion that no final decision should
be taken in tliis matter without.fully appraising the Trustees
of the Police Village of Orono of all relevant facts and the
Secretary was therefore instructed to correspond with Mr. E.R.
Woodyard, the Secre'tarv-Treasurer with regard to two problems:
(1) Did they regard this "unnamed street" as a thoroughfare;
would theNr improve it?
(2) 4ould a house at the rear be above any pronescd sewage
or drainaoe works?
