Schoenmaker, Member Mrs. Ellen M. Yeo, Secretary -Treasurer Minutes of meeting of the Committee held April 10, 1967 were approved as read on motion by K. Schoenmaker, seconded by E.R. Lovekin. Carried. The Secretary presented the following letters: (1) W. Kay Lycett B.A., Orono, Ontario, dated May 8, 1967 in which he advised that he was unable to attend the meeting to be held on Monday May 8th and listing comments in connection with the five new applications which he had submitted for the Committee's consideration. (2) Community Planning Association of Canada, 32 Isabella Street, Toronto 5, Ontario with a questionnaire enclosed, asking for information under a heading "Housing: Opinion Survey - Committees of Adjustment". The said questionnaire was perused by the Committee and completed with a request to the Secretary to return same. Application File No: 57-67 Garnet B. Rickard, Owner, R. In view of the fact that Mr. Rickard did not appear at the meeting held on Monday, May 8th, the Committee tabled this application for -Luther discussion at a meeting to be held on Monday lady 15,-.1967. The Secretary was requested to notify Mr. Rickard of this meeting, asking him to be present. Classified "T1 Application File No. 62-67 W. The Secretary reported that 13 notices of the said hearing had been mailed in accordance with Item 4 of The Rules of Procedure. Vogelfs application as follows: I "This application is based solely on the fact that Mr. Vogel received a Building Permit to build on the subject parcel prior to the time that the by=law came into effect. This Building Permit is dated November 15th, 1965. Mr. Vogel also tells me that he has expended money in respect of the subject parcel in preparing the same for building purposes. I shall see that the Building Permit in question is filed with the application prior to your meeting and apart from this I have no further comments." The Committee indicated they would view the property and with the consent of the applicant, the matter was adjourned to May 15, 1967. Classification "K" Application File No. 63-67 W. The Secretary reported that 14 notices of the said hearing had been mailed in accordance with Item 4 of The 'Rules of Procedure. Mr. Donald Gordon Henry the applicant, and Mr. Morris Kinsman, the proposed purchaser appeared in support of this application. No other person appeared in support of, or in opposition to, this applicatibh.- The Secretary -Treasurer presented the following letters to the meeting: (1) W. Kay Lycett`B.A., Barrister & Solicitor, Orono, Ontario, dated April 13, 1967; (2) W. Kay Lycett B.A., Barrister & Solicitor, Orono, Ontario, dated May 8, 1967. Mr. Lycett►s letter of this date refers to Mr. Henry+s application as follows: "I believe this application is clearly documented with the sketch I have submitted and involves the separation of a building lot from a larger parcel upon which the Grantees have their residential building. It is my feeling that careful consideration should be given to this application in view of the circumstances and nature of the properties in the immediate vicinity of the subject lands and I would request that the Committee, before making any decision in the Page 3 Meeting of Committee of Adjustment, May 8, 1967 matter, view the property and postpone the decision until a later meeting." Mr. Henry was advised of Mr. Lycett+s comments with regard to his application and the Committee indicated they would view the property and with the consent of the applicant, the matter was adjourned to May 15, 1967. The Secretary reported that 19 notices of the said hearing had been mailed in accordance with Item 4 of The Rules of Procedure. Mr. Stinson Osgoode Martin appeared in support of this application. No other person appeared in support of, or in opposition to, this application. The Secretary -Treasurer presented the following letters to the meeting: (1) W. Kay Lycett B.A., Barrister & Solicitor, Orono, Ontario, dated May 8, 1967; Mr. tycett's letter of this date refers to Mr. Martinis application as follows: "This application involves the severance of a very small piece of land from one owner to an adjoining owner to merely facilitate the existing occupational boundaries of the two adjoining properties." The Committee noted that the purpose of this conveyance was to adjust the boundary between the two properties concerned so as to accommodate the present physical features which include a hedge,and as there appeared to be no other problem, this application was granted on motion by K. "In this application, as I have already indicated in my previous letter of April 20th, 1967, a severance of the parcel in question has already been granted by your Committee. Since the resulting transaction of purchase and sale was not completed, the deed was never registered and the present transaction involves the same parcel only a different purchaser." In the absence of the owner, Mr. Oliver Knapp, and the Agent, W. Kay Lycett B.A., to give further discussion to this application, the application was tabled, therefore, for consideration at the meeting to be held on May 15, 1967. North, Orono, Ontario, for part of Lot 22, Con VII, Township of Clarke, Submission No.'H'a.j,_.r Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No. 1494 so as to permit the separation of a parcel of land approximately 640' x 3199' being approximately 45 acres in area from the applicant's land. The Secretary reported that 17 notices of the said hearing had been mailed in accordance with Item 4 of The Rules of Procedure. Mrs. Zella May Graham, the applicant and Mr. Vim. E. Reid of Orono Ontario, the proposed purchaser appeared in support of this application. No other person appeared in support of, or in opposition to, this application. Kay Lycett B.A., Barrister & Solicitor, Orono, Ontario, dated May 8, 1967; Page 5 Meeting of Committee of Adjustment,May 8, 1967 Mr. Lycett's letter of this date refers to Mrs. Grahamts application as follows: 'IT -his application involves the proposed separation of 45 acres of land from a 47 acre parcel which would leave a remnant of 2 acres, more or less, upon which two houses are presently situate. These houses have been present on the lands for a good many Mears and accordingly the proposed severance does not involve th)e •creation of a so-called building lot, especially in Griew of the fact that Mr. Reid has no intention of using the 45 acre parcel, which he will obtain, for that purpose. His sole purpose is to use the lands for farming." The Committee noted the following facts: 1. The applicant, Mrs. Zella May Graham has been a resident on the property for some 41 ,years and has been the owner for 24 years. 2. Mrs. Graham and her husband ceased agricultural production on the land some 8 years ago and rented the working land to the prospective purchaser Mr. Wm. Reid for pasture. 3. Mrs. Graham now desires to sever the two dwelling houses owned by her from the barn and agricultural lands. 4. The barn, being to the rear of the houses, the property left for the two dwellings will be approximately 2 acres. 5. The goposed purchaser, Ioir. Vim. Reid, intends to use the 45 acres for agricultural purposes only and has no intention of building a dwelling. The matter was referred back to the Agent for the Applicant, W. Kay Lycett, Solicitor at Orono, for formal submission and a further comment was made that it was noted that the son and mother had two houses in one deed. This matter was adjourned with the consent of 'the applicant for further discussion at the meeting to be held on May 15, 1967.
