Meeting of Committee of Adjustment, June 12, 1967:
The Secretary -Treasurer presented the followine letter to
the meeting:
(1). W. Iay Lycett B.A., Barrister & Solicitor, Orono,
Ontario, dated J,_i.ne 1, 1967:
Mr. Cowan referred to a former decision given by the Committee
at a meeting of the Committee of Adjustment held on May 31, 1966
under Application File No. 24-66 and stated that this is the last
lot which is out off from the farm lands to the West by the existence
of a deep ravine and swampy arca.
The Committee took special note of the following:
(1) The survey presented was dated August 26, 1960.
The lot shown on that Flan of Survey has now
beer extended from 1501 depth to 2001 depth.
(2) The Committee studied the survey, the location
of houses in the area; and the topography of the region
was discussed. It was noted that.lVr. Cowan still
has approximately 1631 frontage,
Mr. Cowan was asked if the Department of Lands and Forests had
approached him regarding the "purchase of any of these lands and
he stated they had not, although, several years ago, they had
approached his father.
Mr. W. Kay Lycett, agent, pointed out that neither abutting
owner was present and apparently not interested, in that the owner
of the north lot, Mr. Gordon Winter was ill, and the neighbour
to the south already. has 387► frontage.
The Committee were of the opinion that this application fell
under classification_ TTJ" Infilling Operation, and stated they
will visit the property before giving their final decision.
This matter was adjourned with the consent of the applicant.

The Secretary -Treasurer presented the Building Permit
received from Mr.;Wilson?s son-in-law Mr. Douglas A. Rahme and
the following information was recorded:
"Permit No. 3363, dated June 22, 1963,
Township of Clarke Building Permit,
Lot No. 21, Concession 2, issued to
Douglas A. Rahme, 93 Ontario Street
Bowmanville, to erect a dwelling on
the north side of Highway�2 at the
above number.

The Committee visited this pro-oerty on Friday, June 23, 1967
and considered the following facts:
(1) The subject land is a large lot, located on
the north side of King's Highway ,2; there
is a good entrance to the property from the
said Highway; the house is in the process
of being completed this summer and appears to be
.well built.
(2) There were no indications of any obvious septic
tank problem, the soil being Guerin Sandy
Loam with fair drainage and porosity. The area
was flat and a drainage problem could develop,
but an extensive field drain was under con-
struction.
(3) This is a father to daughter and son-in-law
transaction where the father promised the lot
to his daughter approximately seven years ago.
He held the land under Veterans Land Act and,
of course, a deed from The Director, Veterans
Land Act is necessary in such cases.
(4) The building permit was obtained prior to the
time that the bylaw came into effect. (therefore,
prior documentary evidence supporting alleged
intention available)
On all these facts, permission to sever was granted on motion
by K. Schoenmaker, seconded by E.R. Lovekin. Carried.

The Committee visited this nrop_erty on Friday, June 23, 1967,
and considered the following facts:
(1) The subject land, to be severed, is not suitable
for agricultural purposes. To the west of the
house the ground is not level in that there is
a deep ravine with a small stream winding around
to the north. The frontae_e is to the east and
extends down to the road. This,is the entire
frontage, less an access lane to the pasture.
To the south there is ground suitable for a
large garden.
(2) The main part of the house has been on the
property, well over 50 years and is built of
stone. The son, who is the occupant, has
renovated this house by installing plumbing;
heating; and adding a very attractive addition
consisting of a large living room and bedrooms.
The committee considered this a very well
appointed house and noted that it was well back
from the road. There is good drainage for the
septic tank, the soil being Clarke loam.
(3) This is a father to son transaction, for natural
love and affection.
(4) The son has been in possession of this property
for several years; and the father previously
drew a Will leaving the property to the son
(documentary evidence).
On all these facts, permission to sever will be given further
consideration when a survey has been prepared and presented to the
Committee.

The Committee visited this property on Friday, June 23, 1967,
and considered the following facts:
(1) The subject land is near the Police Village
of Orono.
(2)The lands facing the subject property concerned
were park lands owned by the Department of Lands
and Forests of Ontario. No housing would be
developing there.
(3) The Committee noted the subject lot was abutting
a well maintained Township road.

(4) The subject land is shown on a previous plan
of survey dated August 26, 1960, prepared by
Donevan & Fleischmann, Land Surveying & Engineering,
<Oshawa, Ontario, under Job a8780. The applicant
clearly had the intention to develop the area as
it has developed since 1960.
(5) The Committee noted the general character of
the area was residential lots of similar size
and felt that this could be classified as "J"
Infilling Operation". The application would not
be granted as an extension of an area, but only
on an "Infilling" basis.
On all these facts, permission to sever was granted on
motion by K. Schoenmaker, seconded by E.R. Lovekin. Carried.

Application was made for exemption or partial exem_otion from
provisions of Subdivision Control By -Law No. 1494 so as to permit
the separation of a parcel of land containing three lots, each
lot approximately 100, x 200T, being approximately 20,000 square
feet in area from the applicant's land.
The Secretary reported that 16 notices of the said hearing
had been mailed in accordance with Item 4 of The Rules of
Procedure.
Mr. Luther Brown, the applicant, accompanied by his grandson
Pis. LarryUmbel, Lot 15, Concession 8, Township of Hamilton, Fostal
Address R.R. -,L11 Cobourg, Ontario, appeared in support of this
application. No other person appeared in sur -port of, or in
opposition to this application.
