Vance Allen appeared before the Committee. The matter of the anplication was thoroughly discussed. Yr. AllenTs recuest was for.the purchase of 30.,000 square feet from the applicant. PBr. Allen was asked if he had cleared the matter of an entrance permit with The Ontario Department of Highways and he declared he had not as there was an existing right of entry to the building presently on the property. Mr. Allen pointed out that the property was already in existence as a dwelling site.. Stapleton, the applicant, accompanied by his wife, appeared in support of his application. His request was for a father to son severance. It was noted that a survey of the subject land must be submitted to the Committee for their further consideration of this application. R. 4, Bowmanville, Ontario, for part Lot 35, Concession 4, Township of Clarke, Submission No. ".6 ":� 0 --E E—�z Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No. 1494, so as to permit the separation of a parcel of land being approximately 145.21 x 1501 being one half -acre from the.applicant's land. The Secretary reported that 15 notices of the said hearing had been mailed in accordance with Item 4 of the Rules of Procedure. Mr. Alan Strike, agent for Mr. Sam Bums, appeared in support of this application. He suggested one of the reasons for the application is that the subject land would be used for the construction of another residence on the Buma Farms, a considerable holding, and would assist the farm operations. Also, he mentioned, that the Darlington Committee of Adjustment has a policy whereby it allows one consent to such applications, being preferably sons or daughters of the applicants. It is, he said, not near enough to the corner to be a traffic hazard, the soil is suit- able for residential purposes, and the application is not speculative. Mr. Jacob Kapteyn, son-in-law of the applicant and prospective purchaser of the subject land, appeared in support of this application. No other person appeared in support of, or in.opposition to, this application. Letters of the agent dated April 26 and 27, 1966, were given consideration by the Committee. The Chairman suggested a postponement of this application provided Mr. Strike will make an undertaking to bring the matter of a minimum of one acre to the attention of Mr. Bums in order to discuss a policy decision with the absent member of this Committee. Mr. Strike said he would concur with Mr. Buma and notify the Secretary by letter as to the applicant's decision on lot size. Malley, Owner, Orono, Ontario. for part Lot 11, Block 1, in the Police Village of Orono, in Lot 28, Concession 5, Township of Clarke, Submission No. "43 r - L- - / Z, Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No. 1306, so as to permit 1 the separation of a parcel of land being approximately 7.38 acres, from the applicant's land. The Secretary reported that 25 notices of the said hearing had been mailed in accordance with Item 4 of the Rules of Procedure. Mr. Wm..N. Armstrong Jr. appeared in support of the application while Mr. Alfred Pigott, an abutting property;e`also appeared. Mr. Pigott had no objection to the application. �No other person appeared in support of, or in opposition to, this application. The Committee noted that the area to be conveyed was 7.38 acres and was within the limits of the Police Village of Orono. The Vendor would retain a regular sized lot with a dwelling house thereon whick lot was in excess of 15,000 square feet area and serviced with municipal water. The Committee could see no reason why this application could not be granted. Consent was thereby given on motion by H. E. Walkey, seconded by E. R. Lovekin. - Carried. Application File No. 22-66 H. M. O'Connell, Agent, Mr. Bruce Vey, Owner, Box 282, Newcastle, Ontario, for part Lot 24, Concession 1, Township of Clarke, Submission No. ' R' z z r& z 8 Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No. 1494, so as to permit the separation of a parcel of land being approximately 250' x 150' being 37,500 square feet, from the applicant's land. The Secretary reported that 15 notices of the said hearing had been mailed in accordance with Item 4 of the Rules of Procedure. Mr. Bruce Vey, the applicant, appeared in support of this application. Mr. Vey produced evidence to verify that two building permits, two entrance culvert permits, and building supplies had been purchased before the date of the registration of the said by-law. Mr. Stirling Geer, brother-in-law to the applicant, the prospective purchaser of the subject land, also appeared before the Committee in support of this application. No other person appeared in support of, or in opposition to, this application. Letter of the agent, Mr. H. M. O'Connell, dated May 41 1966, was considered and filed. In considering the application, the Committee noted that the road giving access to the property concerned was the responsibility of the Ontario Department of Highways and that the existing buildings required its maintenance as a road. The Committee, therefore, decided this consent would be considered upon submission of a survey and other necessary requirements. Application File No. 23-66 W. Kay Lycett, Agent, Mr. & Mrs. Edward C. The Secretary reported that 16 notices of the said hearing had been mailed in accordance with Item 4 of the Rules of Procedure. Mr. Wm. Wannan,.an adjacent property owner, appeared. Mr. Wannan had no objection to.this application. No other person appeared in support of, or in opposition to, this application. The Secretary was directed to tell the Agent that, in future, the agent and (or) the applicant must appear before this Committee. The deed, therefore, must be prepared similar as to grantor, to the existing property now held by the son. This application was set over for consideration at the next meeting. Allison Cowan, Owner, 58 Rollscourt Drive, Willowdale, Ontario, for part Lot 31, Concession 5, .Township of Clarke, Submission No. '6` �2*-66--/3 Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No..1494, so as to permit the separation of a parcel of land being approximately 100' x 150' being 15,000 square feet, from the applicant's land. The Secretary reported that 14 notices of the said hearing had been mailed in accordance with Item 4 of the Rules of Procedure. Mr. R. Allison Cowan, the applicant, appeared in support of his application. In his discussion, he stated the two lots left were bounded on the westerly by a steep grade which practically cuts them off at the back. If left with them, he said, it would be a hardship as•I can't do anything with them because of the landlocked situation and the ground at the bottom of the slope is quite springy but the soil condition otherwise is good. Mr. Gordon Winter, the prospective purchaser of the subjeot land, appeared in support of the application. Mrs. Kay Custer, an adjacent property owner within 200 feet of the subject land, also appeared and spoke in favour of the application. When asked by the Committee, Mr. Cowan had no objection to increasing the lot size to one acre. No other person appeared in support of, or in opposition to, this application. Mr. Cowan was agreed that if in the event he did not want the remaining lot that he would give Mr. Winter the right of first refusal in order to enlarge the subject property. It was noted that the land to be retained by the applicant would not .require a severance unless he wished to establish another lot or sell it to an abutting owner to enlarge an existing property. Also, the topography of the subject land isolates the said land. To stop the severance would not benefit the community and would be a detriment of the applicant. Upon consideration of the particular facts of this application the Committee took special note of the following: - (1) The survey submitted was dated 26 August 1960, under job number 8780, clearly indicating to the Committee that Mr. Cowan was not making application for severance of lands that was -decided upon following the passing of the by-law but to complete a matter commenced in the year 1960. (2) The committee noted the general character of the area was residential on lots of similar size. (3) The Committee noted the subject lot was abutting a well maintained Township road. (4) The lands facing the subject property concerned on the east side of the Township road were park lands owned by the Department of Lands and Forests of Ontario. (5) The sale of adjacent property and topography had the effect of isolating the subject property. (6) The Committee noted the subject lot was a minimum of 15,000 square feet. The Committee decided that the rear of the subject lot should be moved to the west so that its western boundary would be a continuation of the western boundary to the north which would give the subject lot a measurement of approximately 100' x 2001. On these reasons the Committee granted consent to this application. The Secretary was instructed to inform the Agent to draw the deed accordingly. Application File No. 25-66 K. W. H.
