Upon hearing the presentation and upon perusal of the
materials filed, the committee were of the unanimous opinion that
consent should be granted. H.E.Walkey moved, seconded by K.

The minutes of the last meeting were approved as read on
motion by H.E.Walkey, seconded by K.Schoenmaker. - Carried.

As business arising from the.minutes of the last meeting,
a letter was received from W. Kay Lycett, dated April 15,
1966, in submission of a plan of survey by M,D.Brown, O.L.S..
No one appeared in support of or in opposition to this appli-
cation at this time. The committee were unanimously in favour
of viewing the subject land for further consideration at a
meeting of the said committee to be held on Monday, April 25th
next, at 8 p.m.

Mr. Wildman, of Messrs Strike & Strike, appeared on
behalf of the applicants.
The committee informed Mr. Wildman that they had inspec-
ted the property on 14th April 1966 with Mr. Hollen.
A discussion regarding Sections 75 and 76 of The Registry
Act and their effect on the validity of the deeds drawn and
executed before the,By-Law was passed but which, by reason of
inadvertence, were not registered until one week after the
B=.r-Law was registered, followed. The relevant registered
duplicate deeds were examined by the committee. The committee
decided that there was a marked possibility that the registered }
deeds could be legally acted upon without any consent by the
committee. To leave the matter in such a.state is, however,

highly unde sirable and, if possible, a satisfactory solution
should be found to settle possible questions of title.
It was pointed out to Mr. Wildman, Agent for Mr. Kasper
Hollen, that
(1) A house was being built on the property,
(2) A well was located on the unopened road
allowance,
(3) The proposed lots would probably continue
C to have access via the 22 ft. right-of-
way to the west, rather than the unopened
66, road allowance to the east, because of
existing topography.
The committee suggested to Mr. Wildman that,
(1) if the applicant would arrange for the
necessary land to widen the 221 road
allowance to 661,
(2) if land for a future turnaround at the
end of the right-of-way.could be arranged,
(3) if the 4 lots were to be added to only,
the committee would give the matter their further consideration,
as their policy has been to permit applicants to enlarge exis-
ting small holdings.
The matter was then adjourned to the next meeting when
Mr. Wildman is to supply proof of land acquisition for road
widening and turnaround use.
The committee further suggested, but did not make it a condi-
tion, that the existing unopened road allowance between Lots 2 and
3, Concession 1, be made the subject of an application for closing
by Mr. Kasper Hollen.

Mr. Wildman appeared on behalf of the applicant, 11r. James
Cecil Malley. The committee recalled their discussion concer-
ning this abplication at the last meeting. Mr. Walkey reported
he had viewed the property. Messrs. Schoenmaker and Lovekin were
familiar with the subject lands.
Since the purchaser was adding to an existing holding-, the
committee decided that in conformity with their existing policy
there was no objection to this proposed transfer. It was,
therefore, duly moved, seconded and unanimously approved.

The applicant did not appear. The Agent, having appeared
and presented his arguments on behalf of the applicant on lith
April, 1966, and this application having been set over to this
date, the committee tabled the said application for future
consideration on 25th April, 1966. No one appeared at this
meeting in support of or in opposition to the said application.
A copy of By -Law No. 1509, being a by-law to adopt the
estimates of all sums required during the year and, to strike
the rates of taxation for the year 1966, was presented showing
the budget provisions for this committee.
