Walkey, Member H. E. Pdillson, Secretary -Treasurer In order to provide a quorum, -the meeting aforementioned, was held at the Memorial Hospital to allow 7•.7r. Lovekin to participate. It was moved by H. E. Walkey, seconded by E.R.Lovekin, that in accordance with Rule 8 of the R_zles of Procedure this meeting called for the purpose of Hearing application 4-65, 5-65, 6-65 and 7-65 is hereby adjourned to August 23, 1965, at 8 p.m. in the Council Chamber�at Orono. Carried. Report was made by the Secretary -Treasurer -in effect that all applicants had been informed of the postponement and the Council Chamber was kept open between the hours of 8 and 10 p.m. of august 16, 1965, at which time Pers. Merger t Allen and Mr. Arthur Low were also given notice of the adjourned meeting. Lovekin, Chairman H. E. Walkey, Member H. E. Millson, Secretary -Treasurer The minutes of meetings of July 7th and August 16th, 1965 were approved as read on motion by H. E. Walkey, seconded by E. R. Lovekin. Carried: The following applications were considered by the Com- mittee;- Application File No. 4-65 W. Kay Lycett, _Agent Wm. P. Irwin and Etta Irwin, Owners R.R.1 Newcastle, Ont. for part Lot 29, Con. 4 Submission No. -94-65 -j Application was made for exemption or partial exemption Page 2 - Meeting of Committee of Adjustment, continued: from provisions of Sub -Division Control By -Law No. 1306, so as to permit the separation of a parcel of land being approximately 100? by 296, 10". The Secretary reported that 15 notices of the said hearing had been mailed in accordance with item 4 of the Rules of Procedure. Messrs. I':!. Kay Lycett, Wm. P. Irwin and David H. Kil- patrick appeared in support of this application. Mrs. Velma Jakeman, a property owner within 2001 of the applicantfs property, also appeared.. For the benefit of Mrs. Jakeman and (�J� others present the Chairman gave explanation with regard to the mailing out of the Notice of Hearing. Mrs. Jakeman did not oppose the application. No other person appeared in support of, or in opposition to, this application. The material submitted by W. Kay Lycett, agent, on behalf of the owners having been studied by the Committee and it being noted that the following undertakings were given by PR . Lycett in support of the application: - a. Undertaking regarding right-of-way as set out in paragraph 4 of his letter. dated August 3, 1965., b. The •submission of a report on soil porosity from the Medical Officer of Health at Cobourg. In this regard it is noted that a septic tank installation'exists immediately east of the lot to be severed. A master plan of the area prepared by Donevan and Fleischmann, O.L.S., as Job No. 10530 was submitted to the Committee. Upon hearing Counsel for the applicants in oral argu- ment in explanation and upon hearing the material submitted it waS the unanimous decision of the Committee that this severance be granted. It was so moved by H. E. Walkey, seconded by E.R.Lovekin. Carried. The Secretary was instructed to inform the next meeting of the Committee and Pyr. W. Key Lycett whether or not the fee, under item 3 of the Rules of Procedure, is refundable when consent of the Committee is not granted to an application. Application File No. 5-65 W. Knapp and Nellie ?Miriam Knapp, Owners R.R.2 Orono, Ont. for part Lot 28, Con. 5, in the Police Village of Orono Submi sad on ''35-65 -• 2 / Application was made for exemption or partial exemp- tion from provisions of Sub -Division Control Fy-Law _Yo. 1306 so as to permit the separation of a parcel of land being approximately 60f by 2301. `Phe Secretary reported that 13 notice of the said hearing had been mailed in accordance with item 4 of the Rules of Procedure. W. Kay Lycett, Agent, appeared in support of this appli- cation. No other person appeared in support, or in opposi- tion, to this application. As a preliminary matter, Mr.`Lycett was informed that the submission of a survey was mandatory. 'Pus: Lycett requested the application be heard on the understanding•that the question of a survey be left in abeyance and the matter considered on its merits. The Committee agreed to hear the application and deal subsequentlywith the survey. Municipal water is available'to the property upon which severance is being reauested. Upon hearing oral arguments by the Agent to the appli- cation and upon perusal of the materials filed, the Committee adjourned the hearing of this application sine die and advised the agent that the following material would have to be sub- gs mitted if this arplication to receive further consideration by the Committee:- a. Plan of survey by an O.L.S. to be submitted. b. Results of a porosity test or suitable report from the Northumberland -Durham Health Unit. Kay Lycett, Agent William Daniel Hall and Victor Carlisle Hall, Owners Samuel Victor Robinson and Mary Selina Robinson, Owners all at Orono, Ont., for part Lot 27, Con. 5, Submission No. "86-65—z Application was made for exemption or partial exemption from provisions of Sub -Division Control By-law No. 1306 so as to permit the separation of a parcel of land being approximately % ',4Fby '/(,r" from Messrs. Hall together with a triangular piece abutting on the Hall Property from Mr. & Mrs. Robinson as per sketch of survey prepared by Donevan & Fleischmann, O.L.S. The Secretary reported that 20 notices of the said hearing had been mailed in accordance with item 4 of the Rules of Procedure. W. Kay Lycett, Agent, appeared in support of this appli- cation. Mr. William Daniel Hall also appeared in support of the application and informed the Committee that'an existing septic system was already in operation on the property. No other person appeared in support of, or in opposition to this application. Upon hearing the presentation of Mr. Lycett, agent for the applicants, and upon perusal of the material filed, the Committee were of the unanimous opinion that consent should be granted. It was so moved by H. E. Walkey, seconded by E.R.Lovekin. Carried. In regard to this area abuttipg on Station Street, east of Highway 115, the Committee were of the opinion that the ownership and width should be checked with the Council of the Township of Clarke for future reference. Drainage and character of the area, etc., were discussed with Counsel of the applicant. Application File No. 7-65 W. Kay Lycett, Agent William Albert Madill and Joyce Madelon Madill, Owners Orono, Ontario for part lot 11, block 7 in the Police Village of Orono in Lot 28, Con. 5, of the Township of Clarke. Submission No. "H7-65 -3 Application was made for exemption or partial exemption from provisions of Sub -Division Control By -Law No. 1306, so as to permit the separation of a parcel of land being approxi- mately 621 by 1221. The Secretary reported that 18 notices of the said hearing had been mailed in accordance with item 4 of the Rules of Procedure. W. Kay Lycett, Agent, appeared in support of this appli- cation. Mr. William Albert Madill also appeared in support of this application. Mrs. Margaret Allen, a property owner within 2001 of the applicant's property, also appeared. Mrs. Allen did not oppose the application. Mr. Harold Grant appeared in support of this application. No other person appeared in support of, or in opposition to this application. Mr. Grant explained the reason for a.severance of pert of Lot 11 to allow a sufficient,area remaining in the balance of part of Lot 11 and Lot 12 for,residential•construction and the proposed sale of the easterly part of Lot 11 to Mrs. Margaret Allen. Municipal water is available to the property upon which severance is being requested. Mr. Lycett was informed that the submissi.on•of a survey and porosity test report were mandatory. Upon hearing the Agent to the application and upon perusal of the materials filed, the Committee adjourned the hearing of this application to the next meeting and advised the Agent to make the said submissions. Mr. 17. ray Lycett, Agent on behalf of applications under Files Numbers 4-65, 6-65 and 7-65, appeared before the Com- mittee in support of the said applications. Plan of Survey by Flim and Trollope, Ontario Land Surveyors at Oshawa, in respect to application 7-65 was received and filed. As poro- sity tests in respect to the aforementioned applications had not been submitted, it was therefore moved by H. E. 7alkey, seconded by E. R. Lovekin, this meeting be and is hereby adjourned to T4onday, .August 30, 1965, at 8 p.m. in the Council Chamber at Orono for further consideration of the avn_lications on hand. Carried. Lovekin, Chairman H. E. Walkey, Member K. Schoenmaker, Member H. E. Millson, Secretary -Treasurer. The minutes of meetings of August 23rd and August 25th, 1965 were approved as read on motion by H. E. Walkey, secon- ded by E. R. Lovekin. Carried. Mr. W. Kay Lycett appeared in support of applications Numbers 4-65, 6-6.5 and 7-65. Air. Lycett was informed that fees submitted with appli- cations to the -Committee are not refundable. The decision of the Committee in the minutes of meeting held August 23, 19.65, in respect to atiplication No. 4-65 was upheld and finally authorized for the Secretary to service under Subsection (2a)(10) and (11) of Section 32b of the Planning Act and amendments thereto.
