No other person appeared in support of or in opposition to this application, As a matter of record the Committee visited this property on Wednesday, June 11, 1969 accompanied by Mr. O'Neill, The topography of the land was more evident than on a former visit as weather conditions in February did not permit a complete view of the property. Page 2 Meeting of Committee of Adjustment, June 30, 1969; The land proposed to be sold is bottom land and creek valley and has limited agricultural use, but could be used as land on which a resort dwelling could be constructed. The creek mentioned is ever flowing with clear water. Information learned from lifetime neighbours of Mr. O'Neill verified that this land has never been worked for croppind,being a rough wooded area. The Committee noted that the applicant has applied to sever non -arable land in an Agricultural Area, which lands are apparently to be sold to a person interested in acquiring a lot for a "resort dwelling". Groups of children would apparently hold picnics there under the supervision of the pro- posed purchaser. The creek winding through the property and the tree growth on the lands would indicate that this was suitable for such land use. 'The Committee of Adjustment is not, under The Planning Act, intended in any way to replace either the Council or the Planning Board. The Planning Board present their ideas in the form of draft or proposed by-laws to the Council who, as the elected re- presentatives of the people may either approve of them as they are presented; or make certain amendments or reject them entirely. Usually the whole future of a Planning Area, in this case, a Township, is indicated by way of an Official Plan. 'While such a plan is under consideration in the Township of Clarke, it is not presently in existence. The sole guide to what direction the Committee of Adjustment should take is the intent in restricted area by-laws 1592 and 1613 with amendments thereto which by-laws are now before the Ontario Municipal Board for approval, It is quite obvious that the Committee of Adjustment would have a much easier task if they could look to an Official Plan for some guidance. This will be the case at some future date, but now The Committee must act on the information available and the law as it now exists. Mr. O'Neill and others, however, should be clearly warned that this Committee has no jurisdiction whatsoever in the grant- ing of building permits and the fact that the land is severed does not automatically entitle the purchaser to a building permit. The question as to the entitlement to a building permit is a matter between the applicant and the Township authorities. As stated in previous minutes, the applicant's lands of approximately 100 acres is zoned in three categories. (a) Development Zone; (b) "Rl"; ,(c) Agricultural; The lands to be severed are definitely in an Agricultural Zone. The Committee. (1) Referred to the minutes of meetings February 10, March 11, March 12, March 18, April 149 May 51 June 2, 1969; (2) Recalled their former inspection of the property on Saturday February 22, 1969; and were of the opinion that the land was non -arable land that was suitable for a resort dwelling. Page 3 Meeting of Committee of Adjustment, June 30, 1969; The applicant was instructed to complete his application by submitting a prqar plan of survey, prepared by an Ontario Land Surveyor. The Committee explained to Mr. O'Neill that they would require a condition be inserted in the deed as follows: "that unless and until the land is re -zoned by due legal process to some other use; the land be used for recreational purposes only" _J This application was adjourned for further consideration at such. time as a survey in duplicate by an Ontario Land Surveyor has been received. Mr. and Mrs. Joseph H. Jilisen, the applicants appeared in,support of this application. No other person appeared in support of or in opposition to this application. The Committee: (1) Referred to minutes of meetings held on April -14, •Mav 5, and June 2, 1969; (2) Recalled their inspection of the site on Saturday April 26, 1969; o (3) Particularly noted that the land proposed to be severed by both Mr. Jilisen-and Mr. O'Neill is contiguous and the two applications have a great many matters in common; (4) Mr. Jilisen was advised that the Committee has no jurisdiction whatsoever in the granting of building permits and the fact that the land is severed does not automatically entitle the purchaser to a building permit. Mr. John Perdue, the proposed purchaser appeared in support of this application. No other person appeared in support of, or in opposition to this application. As a matter of record the Committee visited the property on Wednesday June 11, 1969 and determined from neighbors the exact location of the lands in question. The following facts were noted:. (1) A large mobile home was erected on the property and a pole had been erected to bring hydro to the trailer, but no wires were connected; (2) _Mr. and Mrs. Lambier owned the abutting land which the purchaser had apparently worked the year before for one Maurice Decoutre of Delhi;; (3) Some cattle and horses were at pasture on the lands concerned; - Based on these observations and the enquiries made, and the' evidence given by the'proposed purchaser at a former hearing, the Committee were satisfied on the following points: (1) The proposed purchaser formerly sharecropped on -abutting land to the land he proposes to purchase and -is apparently staying in the area where he believes�he can be gainfully employed in agriculture; (2) There,is no topographical reason why the lands would not be suitable for the construction of a house; The question then arises as to whether or not, onthesefacts, a severance should.be granted. The applicant's agent, Mervyn B. Kelly Esq., of Messrs. Strike & Strike, Barristers & Solicitors, Bowmanville, Ontari0 did not appear, due to absence on holidays. The Committee were of the opinion that this application should be adjourned awaiting Mr. Kelly's return and the Secretary was instructed to notify Messrs. Strike & Strike accordingly. The Committee noted the contents thereof; (2) A Plan of Survey, prepared by M.D. Brown, OLS., Bowmanville, Ontario, dated June.12, }969 and numbered 69076; As a matter of record the Committee visited the property on Wednesday June 11, 1969 and observed the following:: (1) The property abutts the East limits of'the Village of Newcastle and is located in a cul-de-sac abutting the south side of Highway #401 and on the East by the Canadian Pacific Railway right-of- way and on the west by the dividing line between the Village of Newcastle and the Township of Clarke; (2) Two foundations were erected in the area and a completed house is on one foundation and the other foundation is ready to have a house built on it;; (3) The character of the area has nothing to discourage the construction of houses except a noise factor from the Railway and Highway 4401; (4) Drainage and other features appeared adequate•, The Committee: (1) Perused the Plan of Survey presented and noted the area shown to be 0.85 acres.MraMcKnight explained that in making his calculation of 98.13 acres as presented in his application, he had made an arithmetical error. To obtain the square footage on the angled portion of the property, he had doubled the triangle to make it a rectangle, then forgot to halve it when figuring the total per- centage. Mr. McKnight requested permissiork to amend the application accordingly and this was granted. The Committee considered all the facts presented and were of the opinion that relief from the by-law was not required insofar as the proposed dwelling was concerned, as the dimensions met the requirements of Table 2 "R" 2 in respect to the total floor area. The minor variance of,0.85 acres as opposed to the required 1 acre minimum lot size for Estate Lots was the matter under considerationl The Committee referred to a Decision in The Municipal World April 1969, "John Pfeffer and the Committee of.Adjustment of the Borough of North York, O.M.B. P7673-68, 19th February,1969 "If you define a minor variance mathematiclly you must inevitably reach the same conclusion as the Committee of Adjustment that this is a major and not a minor Variance. Mr. Robert J. Hancock, the applicant, was absent on vacation and the proposed purchaser Mr. Walter Nanninga,.Orono, Ontario, appeared in support of this application. Mr. Arthur H. The Secretary -Treasurer presented the following material to the meetings (1) A pencil sketch of the proposed severance; As a matter of record, Mr. Russell Osborne, one of the members of the Committee of Adjustment visited this property on June 21, 1969 and noted the following facts: (1) The frontage will not be changed; (2) The drainage is good, and the property is serviced by Municipal water; A cement septic tank is located on Mr. Nanninga's property; Mr. Walter Nanninga made the following submissions: (1) Mr. Hancock owns an "L" shaped piece of land and he proposes to transfer the bottom of this "L" shape of land to himself (W. Nanninga) so that the result will be that each abutting owner will have a regular shaped rectangular lot which lot will be 7854 square feet. This is more than the 7500 square feet minimum required when Municipal water is available; r Mr. Nanninga indicated that the additional property would be useful to him in the event that he-wished,to re -locate his garage which is presently situate at the end of his property. e � The Committee informed Mr. Nanninga that a proper Plan of Survey would be rewired before further consideration can be given to this application. (5) There is, at present, an Agreement for Sale of Land between the applicants and Mrs. Armstrong making the transaction conditional on this application. The Committee instructed the Secretary to send a.copy of the following interim_decigion,to: W. Kay Lycett B.A.,'Barrister & Solicitor, Orono.,. Ontario, Dr. Charlotte Horner, Northumberland & Durham Health Unit, Box 337, Cobourg, Ontario, Mr. Horace Best, Building Inspector for the Township,of Clarke. Mrs. Dorothy Holmes, an abutting land owner to the South East of the lot in question appeared and expressed some concern over the fact that from her observation a flood plain exists in the general area,of the subject land. Wilmot Creek, otherwise known as Baldwin's Creek, runs through this property. She expressed some concern that residences in the*area with the necessary sanitary affluent facilities might create a contamination problem in the area. The Committee referred to Section 31 subsection 7 of by-law � 1592: Lands Subiect to Floodino- -In all zones the erection of buildings or structures for residential or commercial purposes shall be prohibited on land that is subject to flooding or, on land where by reason of its rocky, low-lying, marshy or unstable character, the cost of satisfactory waterworks,sewage, or drainage facilities is pro- hibitive. Nor shall any building or structure or appurtenance thereto (other than conservation or flood control projects) be installed within (1001) one hundred feet of any stream or river bank, or_in the flood plain of any water course, as determined by an Ontario Land Surveyor.” Q Page 10 Meeting of Committee`of Adjustment June 30, 1969; This iscfurther substantiated by Section 309 subsection 3 of the Planning Act, Chapter 296 Revised Statutes of Ontario which subsection would apparently indicate that the legislature of the Province of Ontario have some concern in matters such as this. The prime concern of the Committee at this time, of course, is simply whether or not a minor variance in the matter of reduction of frontage from 120, to 100' should be allowed. The Committee felt that under the circumstances they should request the applicant to.contact the officials of the Northumberland and Durham Health Unit at Cobourg to request from them an opinion as to the suitability of the area for the installation of septic facilities.. The Secretary was also instructed to ask Dr. Horner, if, in her opinion, this is a matter that should be referred to the Ontario Water Resources Commission. .The Committee noted that there were approximately 5 or 6 lots in the area which were held under separate deeds. This application was adjourned for one week to enable the Committee to visit the site. c CLASSIFICATION`"P" General Business: At the conclusion of the meeting the Committee of Adjustment met with the Reeve and members of Council in order to discuss their policy regarding the future development of the Township as to whether this Town- ship should be developed into a predominately agricultural are or whether it should be developed into a predominately urban area.
