Mercer, Kendal, Ontario, for part of Lots 15 & 169 Block "v", Hamlet of Kendal, Township of Clarke, Submission No. "B" 272-69-147 As business arising from minutes of meeting held on February 10, 1969, this application was brought forward for further consideration. At the meeting, Mr. Mercer informed the Committee that he would be admitted to the hospital shortly, so he wouldwelcome an early decision in order to enable him to settle his business affairs. Therefore, this application being urgent, Mr. K. Schoenmaker and Mr. E.F.R. Osborne visited this property on Saturday, February 15r 1969 at 11:30 a.m. They met Mr. Mercer who showed them the subject lands. It was noted that the proposed severance would have a frontage of 67.321 and an area of 15,024 square feet on a main street and the east side of the subject land abuts an unused dead end road allowance. This road allowance is 33' wide and has a length of 1651. The road is not a full 66' but this occurs in Kendal. Frontage is claimed on this street although it is not officially opened. The remaining lot, on which a house, being more than 100 years old, is situate would have a frontage of 67.32' on the Main Street and have an area of 15,024 square feet. The Hamlet of Kendal in which the subject lands are situated has been developed according to 'a certified plan of the Village of Kendal (ref. Wm. Murdock, P.L.S.) for a considerable number of years. This plan, still being in existence, allows frontages of 67.321. Owing to the fact that this original plan has never been decertified although under our present by-law 1592 with amendments theret �satggssified "Rl", the Committee felt that they had no alternative but to base their decision on the fact that this plan is still valid and is to be regarded as a guide line for the Committee. As this decision establishes something of a policy in this Hamlet it is quite possible the Clarke Township Planning Board may disagree and appeal this decision. The applicant is hereby specifically warned that this decision is subject to appeal and he should wait for the time for appeal to lapse before he deals with the land in any way. To permit lots to be sold on the old plan might eventually cause a water,and sewage problem, although, the area is very sandy and, therefore, septic tanks function extremely well.
