Two properties were inspected and a decision was given as follows: Application "A"16-72 This is an application by permit the use of her home as (c) of amending by-law 1653. W. Kay Lycett Q.C.,Agent, Barrister & Solicitor, Orono, Ontario, Margaret Lynn Haitsma,Owner, Orono, Ontario, for part of Lot 10, Block 71. Hanning Plan, Police Village of Orono, Lot 28, Con 5, Township of Clarke, Submission No. "A"16-72-23 one Margaret Lynn Haitsma to a Beauty Shop under Section 4(1) The applicant in this matter is a married woman, presently living separate and apart from her husband. In order to supplement her income she personally operates a "hairdressing" service. She has a small child to care for and would prefer, if possible, to operate the business from her home. The Committee inspected this property on Thursday, October 19, 1972 and noted the following facts: 1. Located immediately across the street from the applicant's home is a small beauty parlotr known as "Gails Beauty Shoppe" and on the house next to "Gails Beauty Shoppe" is a sign indicating that the occupant is a "Painter and Decorator". Although these signs do not completely alter the character of the area, they do indicate that, at least, two buildings in the area immediately across from the applicant's home are being used as a base of operations by self-employed persons; one as a similar type of operation, namely, a "Beauty Shop". The Committee felt that the phrase "domestic or household art" in Section 4(1) (c) could be defined so as to authorize the granting of this application with the conditions that have been included limiting the use to a "domestic or household art" category. The Committee referred to correspondence received from Haliburton,Kawartha,Pine Ridge District Health Unit, Cobourg, Ontario, under date of October 10, 1972 - "an inspection was carried out and the following are our observations and recommendations: 1)the premises comprise a single family dwelling located in the Village of Orono. 2)Although the present waste disposal system is undersized according to present day requirements, it appears to be working satisfactorily. 3)the beauty shop if approved should be so situated in the dwelling that it is separated from the living area, and capable of being locked. The main reason for this recommendation "3" is, to isolate the numerous chemicals and equipment so that no access is available to small children. (signed) "G.F. Hutchings," C.P.H.I. The Committee referred to the minutes of October 2, 1972 regarding this application, and following further discussion this application for a "minor variance" was granted on motion by K. Schoenmaker and seconded by E.F.R. Osborne to permit the applicant, residing in a dwelling, to carry on a hairdressing establishment together with the mechanical equipment required in a hairdressing establishment in accordance with provisions under section 49 subsec (1) (c) (v')-, "subject to the following conditions: 1. The conditions laid down by the Medical Officer of Health, Dr. Charlotte M. Horner, B.A., M.D., D.P.H., Medical Officer of Health, in the letter under date of October 10, 1972 are to be met; 2. Any condition laid down by the Building Inspector in regard to a safe entrance and exit; adequate electric wiring etc., to be met; 3. The type of operation to be carried on shall be rof the nature of a "domedtic or household art", namely, the arrangement of hair by the applicant householder;: and the use shall not be expanded or altered from such a personal and restricted use without further or other authority (i.e. an amendment to the Zoning By -Law) and it is,therefore, specifically drawn to the applicant's attention that should she fail to continue operating the business herself, this consent shall lapse; 4. TAKE WARNING that this decision for a minor variance of the Clarke Township Committee of Adjustment IS NOT FINAL AND BINDING until the time for appeal by any interested party has lapsed under the terms of the Planning Act of the Province of Ontario. THIS TIME FOR APPEAL IS 21 DAYS FROM THE DATE that the minutes of this decision have been mailed to the Minister of Municipal Affairs of the Province of Ontario; 5. This decision should not be registered on title until the said time for appeal has lapsed when the applicant shall then register on title by way of Deposit a copy of the Form of Consent and shall forthwith thereafter forward to the Secretary of the Committee a duplicate Certificate of Deposit or a Notarial copy thereof; 6. AND FURTHER that upon receipt by the Secretary of the aforesaid document, the appropriate administrative officials of the Township of Clarke shall be authorized to issue any and all necessary permits or to take any steps necessary to implement this decision.
