Hosmar, the applicant, appeared and informed the Committee that he was aware that the Ganaraska-Region Conservation Authority, 69 King St. E., Oshawa, Ontario, were making certain requirements regarding these lots in their correspondence addressed to Mr. H.R. Best, Secretary -Treasurer, Clarke Planning Board, under date of October 29, 1971. The Secretary was instructed to make a copy of the referenced correspondence for the files and these applications were adjourned awaiting further instructions from the applicant. No person appeared in support of, or in opposition to this application. Page 2 Meeting Committee of Adjustment, November 1, 1971:. The Committee referred to their registered letter under date of October 21, 1971 addressed to Mrs. Harold F. Brown, Kendal Ontario, at which time Mrs. Brown was advised "that the Committee of Adjustment will dispose of this matter at their next meeting to be held on November 1, 1971, whether or not anyone is in attendance." The Chairman, E.R. Lovekin advised the Committee that he had also orally spoken to Mr. Wilfred A. Day, Solicitor for the applicant, informing him that this matter would be dis- posed of at the said meeting, unless representations were made for postponement or extension. No one appearing, it was moved by Mr. K. Schoenmaker and seconded by Mr. E.F.R. Osborne that this matter be dismissed. Carried. Stapleton, Owners, R.R. #2, Orono, Ontario for part of Lot 31, Con 6, Township of Clarke, Submission No. "B"349-71-254 As business arising from minutes of meeting October 13, 1971, these applications for exchange of property between abutting owners were brought forward for further consideration. No person appeared in support of, or in opposition to these applications. As a matter of record the Committee visited the property and noted the following facts: 1. There were two yellow survey markers and survey pins at the north end of the"lane-way" or "easement" to the east on the property owned by Mrs. Prust; 2. The "laneway" or "easement" had a rail fence built across it and the vegetation indicated it has had little or no recent use as small cedar trees were starting to grow in and along the "right-of-way"; 3. A new wire fence had been erected across the "laneway" closer to the creek;. 4. Further across the creek there were survey stakes so that the boundaries of the lands under discussion were clearly indicated; Mr. M.D. Brown OLS., Bowmanville, Ontario, presented the following material to the meeting: Page 3 Meeting Committee of Adjustment, November 1, 1971: 1, A Plan of Survey, certified by M.D. Brown OLS,, dated November 1, 1971; File 71038-C described as part 4 (four) according to R.D. Plan filed in the Registry Office for the Registry Division of West Durham as Number 1OR91; T The Committee noted that on the Plan of.Survey, the area to be conveyed from Mrs. Prust to Charles E. anq Everett G. Stapleton was outlined in "black",.and is a portion of her land -to the West. The,"right-of-way" of 45' to be,conveyed from..Charles E. and Everett G. Stapleton to Mrs. Prust is shown on the over-all Plan of Survey, Plan 1OR91 of the Stapleton lands and is the eastern boundary of,Mrs.,Prust's property. The Committee referred to the minutes on these two applications at meeting October 13, 1971;, recalled their inspection of the property on Saturday, October 30, 1971 and were of the opinion that these applications were simply to regularize an existing user of lands and to square off property held by abutting owners. The granting of these applications would not place any additional burden on the -,Municipality by way of additional services or for any other purpose. Application No. 348-71 Mrs. Doris Prust and Miss Lynn Prust - Application No. 349-71 Charles E. and Everett G. Stapleton - granted on motion by Mr. K. Schoenmaker, seconded by Mr. E.F.R. Osborne, Carried. t CLASSIFICATION 10 "A" General Business - An informal interview was granted to Mr. and Mrs. Brandt regarding their property in Leskard from which a lot had been severed (ref. "B"322-71-249, Sept. 15, 1971). The Committee advised that they were of the opinion that an application for a minor variance would be required before a building permit could be issued. Mr. Dennis Mackey accompanied by Mr. M.D. Brown OLS appeared to discuss an application for a minor variance granted on October 13, 1971 (ref. "A"347-71-61) and the,type of house he wishes to build on his property. Several items of correspondence were '.attended to; a number of Forms of Consent and deeds were signed by the Committee; and this being all the business at this time, meeting adjourned at 11:00 p.m. Secretary-Treas VIer Chairman
