Yeo, at 3:00 p.m. Council Chamber, Orono, Ontario. LL.B., Chairman, Member, Member, Secretary -Treasurer The minutes of meeting held on November 29, 1971, were approved on motion by K. Schoenmaker and seconded by E.F.R. Osborne. Carried. Application File No. 351-71 Wm. S. Brandt, Owner, Leskard, Ontario, for part of Lots 31 & 321 Con 70 Township of Clarke, Submission No. "A"351-71..64 As business arising from minutes of meeting November, 29th, 1971, this application was brought forward for further consideration. No person appeared in support of, or in opposition to this application. As a matter of record the Committee inspected this property on Friday, December 17, 1971 at 2:00 p.m. Mr. E.R. Lovekin, chairman, having previous knowledge of this application declined to participate in this decision. Mr. K. Schoenmaker, as senior member, assumed the chair. The Secretary -Treasurer presented the following material to the meeting: (1) Correspondence from Ganaraska Region Conservation Authority, 69 King Street E.,Oshawa, Ontario, as follows: "Re Reduction in Setback from Bank of Stream tp permit the erection of a Single Family Dwelling - "This is to advise that the site of the above noted proposed dwelling has been inspected, in part of Lots 31 & 32, Con. 7. There is no flood line mapping for this watercourse so we are unable to indicate the elevation of floodwaters which could occur following the regional storm. However the site appears to be at an elevation which would not be subject to flooding. We would recommend however, that any openings into the house be at least one foot above the existing grade at the north side of the dwelling." (sgd.) "S.B. While"Resources Manager." The Committee noted that the subject lands are very close to the centre of the Hamlet of Leskard. There is an open space which apparently was a garden at one time and later a playing field for football and track type events, therefore, the site appeared suitable for the construction of a single family dwelling. Following further discussion the Committee referred to the minutes of their meeting of November 29, 1971; Lot Inspection report of approval dated November 3, 1971; the Plan of Survey presented at the said meeting and on motion by K. Schoenmaker, seconded by E.F.R. Osborne, this application was granted subject to the following conditions: Page 2 Meeting in Committee, December 17,,1971: 1. The decision by Ganaraska Region Conservation Authority " that any openings into the house be at least one foot above the existing grade at the north side of the dwelling" shall be met; 2. TAKE WARNING that this decision, for a minor variance -of the Clarke Township Committee of Adjustment IS NOT FINAL AND BINDING until the time for appeal by any interested party has lapsed under the terms of The Planning Act of the Province of Ontario. THIS TIME FOR APPEAL IS 14 DAYS FROM THE DATE that the minutes of this decision have been mailed to the Minister of Municipal Affairs of the Province of Ontario; 3. This decision should not be registered on title until the said time for appeal has lapsed when the applicant shall then register on title by way of Deposit a copy of the Form of Consent signed by the concurring members, and shall forthwith there- after forward to the Secretary of the Committee a duplicate Certificate of Deposit or a Notarial copy thereof; 4. AND FURTHER that upon receipt by the Secretary of the aforesaid document, the appropriate administrative officials of the Township of Clarke will be authorized to issue any and all necessary permits or to take any steps necessary to implement this decision. No person appeared in support of, or in opposition to these applications. As a matter of record the Committee inspected this property on Friday, December 17, 1971 at 3:00 p.m. ` The subject land was identified by one Mr. Henderson Jr., who resides on the west side of the property. The Committee noted the following facts: 1.` In spite of a light snowfall, a tongue of land with uncut grass was visible, indicating the tongue of land as shown on the Plan of Survey; this tongue of land connects the subject land to be severed which fronts the road allowance between concession 1 and 2, to the north east, and the land on which there is a dwelling and where Mr. Stacey lives, fronting #2 Highway; 2. These two parcels of land connected by the narrow strip of land obviously came into existance to qualify Mr. Stacey under the Veterans' Land Act legislation as the owner of a stated minimum acreage under that Act;; Page 3 Meeting in Committee, December 17,,1971:. 3. The property fronting on #2 Highway is 30' to 401 lower than the subject land fronting on the aforesaid road allowance to the north which runs roughly parallel to Highway #2; 4. This is clearly an artificial situation as the lots front on two different roads with a vastly different elevation. The change in topography occurs along the line of the "tongue" of land connecting -these two parcels; . The Committee noted that no Certificate from the Health Department had been presented although it had been suggested to the applicant's solicitor in a letter dated November 16, 1971 that - this should be made available. The Secretary was instructed to correspond with the agent of the applicant informing him that as soon as a certificate from the Health Department is available, further consideration will be given the application to sever and the application for a minor variance. Application adjourned awaiting the requested material. CLASSIFICATION "RR" Application File No. 356-71 H.E. No person appeared in support of, or in opposition to this application;. As a matter of record the Committee inspected this property on Friday, December 17, 1971 at 2:30 p.m. The "on site" inspection revealed that the proposed severance would regularize the shape and area of two existing municipal lots. No new buildings would be added. The Committee were of°the opinion that there was no reason why this should not be done and this application was granted on motion by K. Schoenmaker, seconded by E.F.R. Osborne. Carried. No person appeared in support of, or in opposition to this application. As a matter of -record the Committee inspected this property on Friday, December 17, 1971 at 1:30 p.m. and noted the following facts:. 1. Employees were actively packing tobacco in the barn which Mr. Eiken proposes to demolish and rebuild; 2. The existingr,parn,is 50' from the centre of the road; 3. The proposed reconstructed barn would be 59' from the centre of the road and would fill out a square of existing buildings, the eastern end being parallel to the eastern side of an existing greenhouse which is situate to the north of the barn to b; ;e -constructed; 4. The west end of the new building will be approximately in line or_behiBd the de facto building line established by the`applicant's existing dwelling and tobacco kilns; 5. The new building is to be to the south of'the applicant's house and would not obstruct the vision on the inter- section to the.north;. ` I 6: If this application were not granted, the existing two storey building would be left standing 9' closer to the road, whereas the proposed new building is to be one storey of neater appearance and an improvement to the present _ agricultural operation. The Committee, in referring to the minutes -of ,November 29, 1971 meeting, noted that there were no objections to this application and were of the opinion Lhat the proposed building is an agricultural use in an agricultural 'zone. On all the evidence presented, this variance was a r`eaonsable request and in keeping with the overall plans `for the Township. Application granted" on motion by E.F.R. Osborne and seconded by K. Schoenmak`er, subject to the following conditions: 1. Osborne and seconded by E.R. Lovekin. Carried. - The chairman, E.R. Lovekin, annoumed that due to the absence of Committee Member K. Schoenmaker, a meeting would be held at 1:00 p.m. Wednesday January 12th, in the Council Chamber, at which time any outstanding matters and decisions would be considered.' Applicants were invited to attend this meeting if they wished. The following applications were then dealt with - - - Application File 247-70 W.
