Meeting Committee of Adjustment July 22, 1971:
The applicant would not be issued a building permit on the
basis of this severance but would have to apply for and be
granted minor variances of the frontage requirements before any
permit can issue.
Following further discussion the Committee:
1. Referred to meetings April 5, May 10, May 31,
July 5, July 12;
2. Recalled their inspection of the property
on April 24, 1971;
3. Perused the Plans of Surveys presented;
and :;ranted this application for a severance on motion by
E.F.R. Osborne, seconded by E.R. Lovekin, Carried.

The minutes of the following meetings were approved on
motion by K. Schoenm:ker and seconded by E.F.R. Osborne -
July 12, 1971; Meeting in Committee July 13, 1971; Meeting in
Committee July 22, 1971. Carried.

Application was made for exemption or partial exemption from
provisions of amending by-law 1653 to permit a minor variance from
the requirements of :appendix 1 (b).
The Secretary reported that 28 notices of the said hearing
had been mailed in accordance with Item 4 of The Rules of Procedure.
Mr. J.R.K. Erdley, husband of the applicant, appeared in
support of this application. No other person appeared in support
of, or in opposition to this application.
The Chairman of the Committee, E. Richard Lovekin, stated
that he hod previous knowledge of this applicnti_on as he had
represented Mr.. Eardley when the land had been purchased. He, J
therefore, withdrew with the members' consent and Mr. K. Schoenmaker,
as senior member assumed the chair.

Mr. Eardley was sworn and submitted the following facts:
1. On October first, 1969, the Committee of Adjustment
granted a severance of a parcel of ].and 120' x 212.68'
approximately 25,516 sq. ft. which complied with the
requirements of by-law 1592 in an "R1" Zone -
(ref "B"209-69-180);
2. He understood that one had a period of one year to
register the decision, which he did, approximately
11 months later;
3. During this period, in fact, only 11 days from the
mailing of the decision of the Committee, an amending
by-law 1653 was passed re -zoning the area to "RR"
and requirincq a lot area of 1 acre (Appendix 1 (b);
the resultbeing that the lot cannot be classified as
a"lot of record"(ref. sec. 3.15) and now I am applying
for a minor variance in order to comply with the
present amending by-law.
The Committee were of the opinion, although this severance
technically is not a "lot of record", the fact that they approved
this severance during the time this area was zoned "R1" under
by-law 1592, they feel the applicant should not be penalized due
to the fact he did not register a deed immediately after his
application had been granted.
The Committee reviewed their former decision in this matter;
perused the Plan of Survey presented at that time, prepared by
M.D. Brown 469085, daL-ed June 30, 1969 (Additions Aug 13, 1969)
and were satisfied that the facts of the case were as submitted
by Mr. Eardley.
This application granted on motion by E.F.R. Osborne and seconded
by K. Schoenmaker subject to the following conditions:
1. TAKE IJARNING that this decision, for a minor_ variance
of the Clarke Township Committee of Adjustment IS NOT
FIiJAL AND BINDIDIG until the time for appeal by any
interested party has lapsed under the terms of The
Planning :.ct of the Province of Ontario. THIS TIML' FOR
APPAL IS 14 DAYS FROM THS DATE the.t the minutes of
this decision have been mailed to the Minister of
Municipal :`.ffair_s of the Province of Ontario.
2. This decision should not be registered on title
until the said time for appeal has lapsed when the
applicant shall then register on title by way of
Deposit a copy of the Form of Consent signed by the
concurrinc members, and shall forthwith thereafter
forward 'L -o the Secretary of the Committee a duplicate
Certific^:te of Deposit or a Notarial copy thereof.
3. AND FURTHEi: that upon receipt by the Secretary of the
aforesaid document, the appropriate administrative
officials of the Township of Clarke will be authorized
to issue any and all necessary, permits or to take any
steps necessary to implement this decision. CARRI:-'D.
