Mr. Jerome Marvin, Orono, Ontario, the applicant, accompanied by Mr. Merrill Brown, OLS., Bowmanville, Ontario, appeared in support of this application. Perused the Plan of Survey and noted that the property was described as in the sketch of survey presented by the applicant at the meeting on December"14, 1970; 2. Referred to -minutes of December 14, 1970 and January 11, 1971; 3. Recalled their inspection of the property on Friday, January 8, 1971 and were of the opinion that the applicant had complied with the conditions imposed as evidenced in former minutes. The property could be approached from the north, but the side road running south along the west side of the property was blocked by snow about 4 mile south of the north west corner of the property. c . The Committee observed that an old abandoned railway crossing, right of way, from east to west` on lot 20 would provide a natural line of division. ° Following a discussion of all the facts the Committee considered the decision of the Ontario Municipal Board reported in the`December 1370 issue of Municipal World, O.NI.B.R.1858-70, 28th July, 1970, pane 328f (Twp, of Valley East and Lauzon). c Mr.cLycett was requested to submit a Survey and this application was adjourned at such time as a survey in duplicate by has been received. As business arising from the minutes of the past meeting, these applications were brought forward for further consideration. W. No other person appeared in support of, or in opposition to these applications. As a matter of record the whole Committee visited these properties on Saturday. March 6, 1971 at 1:45 p.m. The following facts were noted: 1.• `Mr. and Mrs. George Stapleton and their son were at home; 2. These applications were discussed and Mr. Stapleton mentioned that he could not understand why he needed a separation when the lands had been acquired on separate deeds. This and other policy matters were explained to the applicant; 3. Mr. George Stapleton is a well known and well established local farmer whose farming operationwas his main means of livelihood; 4. The proposed severances, all being agricultural land blocks of 40 acres or more, the Committee could see no reason why they should not be granted; J Page 3 Meeting Committee of Adjustment, March 8, 1971: .W. A certified Plan of Survey prepared by M.D. Brown OLS, 1106, Bowmanville, Ontario, dated March 8, 1971, #71020; The Committee: C 1. Perused the Plan of Survey submitted and noted the annotation "Caution: this plan is not a plan of subdivision within the meaning of section 26,27 or 28 of the planning act." and also that the plan is to be registered in the Registry Office, Registry Division of - ,.Durham West Riding; 2. Referred to the minutes of meeting February 8, 1971; 3. Recalled their inspection of the property; 4. Made reference to the decision reported in the Municipal World, December, 1970, page 328 (ref O.M.B.R.1858-70, 28th July, 1970;)(Twp. of Valley East and Lauzon) and following further discussion were of the opinion that this was a bona fide dissolution of a family farm. These applications were granted on motion by E.F.R. Osborne and seconded by K. Schoenmaker; upon Mr. Lycett's undertaking to file with the Committee, the details of the registration of the Plan in the Registry Office. Carried. Henderson R.R. 41 Newtonville, Ontario, for part of Lot 5, Con 111; Township of Clarke, Submission No."8"aF6-7i- L'% - Application was made for exemption or partial exemption from provisions of subdivision control by-law No. 1592 and amendments thereto so as to permit the separation of a parcel of land approximately 62 acres (with an 8 acre remainder) from the applicant's land in an agriculture zone. The Secretary reported that 24 notices had been mailed in accordance with Item 4 of The Rules of Procedure. Mr. Hendrick P. Henderson, R.R. 41 Newtonville, Ontario, the applicant accompanied by his agent -Claude Fitzgibbon Esq.,Bonneville Fitzgibbon & Good, Barristers & Solicitors, 11 Mill St. N., Port Hope, Ontario, appeared in support of this application.- Also appearing were the following persons: Mrs. Amelia Harasimowicz and Mr. Feodar Kulcycki, 197 Guelph St. Oshawa, Ontario; Mr. Robert N. The Committee noted the contents thereof; Referring to the ,Application Form the Committee noted that on page 112" the dimensions of land are given as having an area of 62 acres and - the applicant referred to the -proposed 8 acres remainder in his letter accompanying the application form. . . . . Page 4, Meeting Committee of Adjustment March 89 1971; Mr. Claude Fitzgibbon on behalf of his client, the applicant, made the following submissions:. 1. 'Mr. Henderson owns approximately 70 acres and wishes to retain approximately 8 acres, leaving ` a remainder of approximately 62 acres, the subject of this application;, 2. He is presently living in the dwelling house on the property with his family; J. 3. The land is not prime farmland, being swampy in many places; Mr. Henderson was then sworn and he submitted the following, facts: 1. He and his wife came from the Province of Quebec; 2. He .purchased the property on or about the year 1969 and is presently living there with his wife and`3 children; 3. He wishes to continue living in the vicinity. For economic reasons he is not able to continue farming. The land is poor farmland requiring too great an investment'to make a success of the venture. Under the circumstances it seemed reasonable to continue living on the property with less land to care for and an area of 8 acres was chosen because it fits in with a natural ridge of land and would create a natural separation; 4. Considerable money has been spent in renovating the farmhouse`which was a shell of a house when purchased. In ali he has invested approximately $129000.00 in the house and'$7,000.00 for farm equipment. `5. A smaller acreage would allow him to establish a small fruit and vegetable farming operation and also remain in hiss home; 6. The 62 acres fronts an improved road, in fact the school bus travels this road and the 8 acres fronts a well travelled road; Mr. Robert N. Stewart, 401 East Avenue, West Filly Ontario was then sworn and following a discussion he stated that his objection was impersonal. He simply considered it very bad planning to sever the property so as to create two parcels of 62 acres and 8 acres. Mrs. Amelia Harasimowicz and Mr. Feddar Kulczycki were inter- viewed and they were concerned about the mortgage they hold, jointly, on the property.. They expressed concern that a severance could be granted and a clear deed given before an existing mortgage was paid off. The Chairman of the Committee explained that this Committee had no authority'to require payment of a mortgage, but no clear deed could be given until a mortgage was paid. Mrss. Amelia Harasimowicz declined to sign the request form for a copy of the final decision stating that she wished her Solicitor, G.S. Boychyn Q.C., of Humphreys, Boychyn & Hillman, Oshawa, Ontario, to receive any and all communications regarding this application. The Secretary was instructed to send Mr. Boychyn copies of all minutes pertaining to this matter. This application was adjourned to enable the Committee to inspect the property. Box 65, Toronto -Dominion Centre, Toronto 111, Ontario; Barton S. Ellis Owners, William A. Cobban, c/o Cobban, Woolley & Dale, P.O. Box 65, Toronto Dominion Centre, Toronto 111, Ontario, for part of Lot 31, Concession 9, Township of Clarke, Submission Application was made for exemption or partial exemption from provision's of subdivision control by-law No. 1592 and amendments thereto so as to permit the separation of a parcel of land approximately 12320'x30300' being approximately 100 acres from the applicants' lands in an agriculture zone. The Secretary reported that 22 notices had been mailed in gccordance with Item 4 of The Rules of Procedure. Mr. Merrill Brown, OLS, of Bowmanville, Ontario, acting as agent for the applicants appeared in support of this application. Other persons appearing were:, Mr. Emerson Ough, 118 New Port Ave. Toronto Ontario and Mr. Cecil E. Simmons, Box 96, Oshawa, Ontario. No other person appeared in support of or in opposition to this application. The Secretary -Treasurer presented the following material to the meeting: 1. Correspondence from Cobban, Wooley & Dale, Barristers and Solicitors, Toronto Dominion Centre Toronto 111, Ontario under dates of February 4, March 2nd, January 29th7 1971. The Committee noted the contents thereof; 2. A sketch of the subject land, prepared by M.D. Brown OLS, Bowmanville, Ontario, dated February 99 1971.and annotated "Note: Plan not prepared for registration purposes. Mr. E. Ough of Toronto appeared before the Committee and expressed concern over future possible land use, if the property is severed. The Chairman explained that the application before the Committee was not in regard to land use but for a severance. The Secretary reported two inquiries from adjacent owners - Mr. Carleton Wi.lson, 1869 Yonge St. Toronto and Mr. Jack Syer, 39_Horsey St. Bowmanville, Ontario. These persons were concerned about the pollution to the Wilmot Creek .and the intended use of the property. No specific written representations were received from these two persons. The Committee are fully conscious of the fact that the ecology of Wilmot's Creek, the home of Canada's first fish hatchery, is of prime importance, but in the absence of specific -evidence threatening that ecology, thought the matter not of prime importance. The Committee, in reviewing the correspondence from Messrs. Cobban, Wooley & Dale, as agents, there is no indication as to the future use of the land, in fact, on the application form the"purpose for which the subject land is intended to be used, if known" is stated "not known". The Chairman stated that although land use is under the jurisdiction of the Planning Board, it is helpful if the applicants would state the proposed purdhaser's intentions regarding the severance. Page 6 Meeting Committee o£'Adjustment, March 8, 1971: Mr. Merrill Brown OLS., was then sworn and made the following submissions: 1. The applicants had appointed him to act as their agent to act on their behalf and represent them at the meeting, as evidenced by correspondence feceived'from Messrs. Cobban, Wooley & Dale, Barristers & Solicitors, Toronto, Ontario, dated March 2, 1971;` " c 2: This application.is for severance of a 100 acre `parcel with a 100 acre remainder; 3. To his knowledge from a Crown Grant until approximately 1913 the 200 acre parcel was held under separate ownership. At that time Mr. Ephraim White became the owner of"both properties and they merged under his ownership. The applicants acquired title to the whole of Lot 31, Con. 9 from Mr. White.on or about 1954. 4. The land is marginal agriculture land, there are no. buildings of any worth; there is no hydro,, 5. The applicants have entered into an agreement for purch ase,and sale for. the north one-half of lot 31 and the Committee's approval is required under the Planning Act; c Mr. Cecil E. Simmons was then sworn and he made the following submissions: 1. He is he owner of approximately 10 acres in lot 30, concession 97 immediately adjacent to this property to the east; 2. He has, since the purchase of his property, had access to his property over an existing roadway across the subject lands. He is concerned whether his rights of access will be affected by a new owner. Mr. Simmonsfurther stated that he had previous knowledge of this property and that the easement existed when he tested trucks in this area in the year 1940 for General Motors of Canada. The Committee requested Mr. Brown to check the matter of this apparent easement with his principals and advise the committee as to what disposition the owners wish to make of this matter. Mr. Brown was also informed that the Committee would inspect the property and this application was adjourned to enable the Committee to do this. CLASSIFICATION 10 "A" Application File No. 288-71 W. Kay Lycett B.A., Agent, Barrister & Solicitor, Orono, Ontario, William Perry Irwin Owners, Etta Irwin, for 'art of Lot 29, Con 1V, Township of Clarke, Submission No. Application was made for exemption or partial exemption from provisions of subdivision control by-law No. 1592 and amendments thereto to permit the separation of a parcel of land approximately 1181x128' being approximately 15,104 square feet in area from the applidants'land in an agriculture zone. Grander, OLS, said plan prepared by Donevan & Fleischmann Land Surveying & Engineering, 11 Ontario Street Oshawa Ontario under date of January 17, 1969, Job No. 17544; revised April 14, 1969; Revised January 4, 1971 Job #19988; This plan shows the position of the subject land in the proposed plan of sub -division; W. Kay Lycett B.A., as agent for the applicants made the following submissions: 1.� On the Plan of Survey presented with the application the street shown on this survey as Irwin Road and on the west side of the property shown as Sissons Road and amended to Irwin Road comprise lands that have now been'deeded to the Township of Clarke;it is understood that the Council for that Corporation has by By-law dedicated these lands as a public highway named Irwin Road. Accordingly, the only parcel which Mr. and Mrs. Irwin will retain on the severance of the said lands in this transaction will be the lot shown to the west of the subject lands also having dimensions of 1181x128' which Mr. Irwin intends to develop as well by erecting a dwelling house thereon; Following a discussion, the Committee noted these facts: 1. A severance had been granted on a lot situate within the Irwin proposed subdivision under Submission No. "B"154-68-138. At that time the" subject land was within an "R1" zone; 2. The application before the Committee now concerns a lot within the Irwin proposed subdivision, the difference being that the subject land is in an Agricultural Zone, Sec 10 "A" of by-law 1592 as amended. The Committee indicated to Mr. Lycett that this application would require further consideration and also the Committee wish to inspect the site. Hale, R.R. 41, Newtonville,`Ontario, for part of Lot 12, Con 111, Township of Clarke, Submission No."it 2sy "7 Application was made for exemption or partial exemption from provisions of Subdivision Control By -Law No. 1592 as amended so as to permit the separation of a parcel of land approximately 24.71 acres in area from the applicahts' land in an agriculture zone. The Secretary reported that 22 notices of the said°hearing had been mailed in accordance with Item 4 of The Rules of Procedure. W. The Committee noted the contents thereof. 2. Kay Lycett B.A., Barrister & Solicitor, on behalf of the applicants made the following submissions:. 1. This application is for severance of a 24.71 acre parcel fpom their lands composed of part of Lot 12 in the third concession of the Township of Clarke; 2. The applicants have entered into a conditional sale of these lands to Vaclav Prosek and Agnes Prosek who are presently the owners of adjacent lands as shown on the said Plan of Survey; 3. The purpose of the application and the resulting transaction of purchase and sale is to enlarge the present holding of Mr. & Mrs. Prosek; 4. Messrs. Hale will retain a further parcel in' Lot 12, concession 3 lying adjacent to the south, having an estimated acreage of 135 acres more or less; Mr. Lycett directed the Committee's attentidn to the Plan of Survey which shows the two parcels adjoin for the spaceor length of 78.22 feet. After due consideration the Committee noted the following facts: 1. This is an application to transfer 24.71 acres from a father and an uncle as owners to a daughter and son-in-law as purchasers; 2. This will be the second addition to property owned by the purchasers, the original parcel of 1.982 being acquired in instrument No. N18308 and an additional 2.08 acres in instrument No. N34887; Page 9 Meeting Committee of Adjustment, March 8, 1971: 3. As this is no more than a transfer of'land from one abutting owner to another, both vendors and purchasers being related, the Committee could see no reason why the proposed transfer of land should not be approved. The number of dwelling buildings will not be increased or decreased and the number of parcels of land being held by the prospective owners will not be increased,or decreased; The Committee indicated to Mr. Lycett that they will require a restriction that the deed be registered in the names of the present owners, Vaclav Prosek and Agnes Prosek, so that the parcels merge. The Secretary reported that 22 notices had been mailed in accordance with Item 4 of The Rules of Procedure. Mr. and Mxs. James Imlach, the applicants, accompanied by their agent W. Kay Lycett B.A., appeared in support of this application. No other person appeared in sup -.-)ort of or in opposition to this application. The Chairman instructed the Secretary to include, the relevant facts from this correspondence in the minutes of this meeting - "The Imlachs have been farming this property comprising 137 acres more or less in partnership but now Mr. Imlach Sr. has come to the age where he wishes to retire from the farming business and allow his son to carry on the full responsibility of the farming operation. It is proposed that a building lot be separated from the property for the purpose of Mr. and Mrs. Imlach Sr. erecting a dwelling house thereon and residing therein. He has owned his farm since 1945; 2. He is a milk shipper, carrying on a dairy operation and the gross production exceeds 17,000 pounds per month; 3. He has a herd of approximately 75 head of cattle, comprising 23 milk cows and some beef cattle; 4. During the period 1969 to 1970 he shipped approximately 233,000 pounds of milk; The Committee informed the applicant that they would inspect the property and this application was adjourned pending their report. Mr. Peter Polny, the applicant, accompanied by his wife Mrs. Polny, appeared in support of this application. No other person -appeared in support of, or in opposition to this application. Correspondence from Mr. & Mrs. Polny dated February 22, 1971 showing an outline of the proposed severance; Mr. Peter Polny was sworn and made the following submissions: 1. He is the owner of a 100 acre farm and has farmed this land for approximately 20 years; 2. Due to ill health he now wishes to retire and would serer approximately 90 acres, leaving a remainder of approximately 10 acres; 3. If a severance is granted it is his intention to build a retirement home on the proposed 10 acres and sell the remaining acreage; 4. The farm land fronts two roads; The Committee informed the applicant that they would inspect the property and this application was adjourned pending their report. The Secretary was instructed to include the relevant facts from this correspondence in the minutes of this meeting - "Messrs. Stapleton own in one parcel of land approximately 120 acres composed of the north parts of lots 29 and 30 upon which is situate the dwelling house in which Mr. Charles Stapleton resides with his wife. It is the intention of the Stapleton brothers at the.present time to retire from the farming business and Mr. Charles Stapleton is desirous of retaining the dwelling house in which he resides together with possibly one or one and a half acres of land. For the assistance of your Committee, I have endeavored to prepare a rough sketch of the property in question which I enclose herewith showing the parcel intended to be retained outlined in red. You will note that the subject parcel is to have approximately a width of 156' and a depth of 300' and will leave a 66' opening to the balance of the farm lands owned by the Stapleton brothers." 2.
