Scioenmaker, seconded by E.F.R. Osborne. Carried. Application "B"21-73 Robert L. Bullen, Owner, 1�'R. #1, Kendal, Ontario, for part of S11 Lot 6, Con 9, N pt. Lot 6, Con 8, Township of Clarke, Submission No. "B" 21-73-21 As business arising from the minutes of meeting June 11, 1973, this applic-ation was brought forward for further consideration. Robert L. Bullen, owner and applicant, appeared in support of this application. No other person appeared in support of, or in opposition to this application. The following material was presented to the Committee: 1. Draft Plan 10R, certified,by 1II.D. Brown OLS., Bowmanville, Ontario, dated July 13, 19732 File #73159; Mr. Bullen was reminded that he was still under oath, and he indicated on the said Plan the proposed severance he wishes. This is shown to be an area of 40.03 acres and he will retain approximately an area of 160 acres of land to the north. The Committee referred to the minutes of meeting June 11,1973; recalled their inspection of the property on June 12, 1973 and following further di'scussicn this application for severance of 40.03 acres in an agricultural zone was granted on motion by K. Mr. Robert G. Allin, applicant, appeared in support of this application. No other person appeared in support of, or in opposition to this applice:tion. The following material was presented to the Committee: 1. Draft Plan 10R, certified by M.D. Brown OLS., Bowmanville, Ontario, dated July 17, 1973, File #73156; Page 2 Meeting Committee of adjustment, July 23, 1973: Mr. Allin, reminded by the Committee that he was still under oath from his previous application, indicated "part 1" with an area of 10.03 acres to be the severance he is applying for. Mr. Allin also stated that the Plan of Survey revealed the area he wishes to sever to be 10.03 acres rather than the 12 acres applied for. The Committee perused the Plan of Survey and granted Mr. Allin permission to amend his application to conform to the area revealed by the Plan of Survey. J The Committee then asked Mr. Allin if he had any knowledge of the future use of the remaining 138.44�anashe replied, to the best of his knowledge,this would be used for agricultural purposes and the proposed purchaser may build a barn on it. The Committee explained to the applicant that the decision from this Committee is only for a severance and does not affect the land use. The Committee recalled their inspection of this property on June 15, 1973, referred to the minutes of meeting June 20, 1973 and on motion by E.F.R. Osborne, seconded by K. A draft Flan 10R, certified by M.D. Srown,OLS., Bowmanville, Ontario, dated July 12, 1973, file 73157; Miss C.,:. Stewart, under oath, indicated on the Plan of Survey the area of 40.01 acres to be severed (part 1) and stated that the area remaining would be approximately 70 acres. Air. Wm. L. Hoy was then sworn and he confirmed the following facts: 1. He has farmed the subject land for approximately 10 years and has rented the land during this time; 2. He now wishes to purchase the 40.01 acre parcel and it is his intention to add this land to his existing farming operation located directly Last of the proposed severance; 3. He will continue to use the land for agricultural purposes in conjunction with his existing 50 acre parcel; the Committee reviewed the minutes of meeting June 11, 1973 recalled their inspection of the property on June 12, 1973 and on motion by K. Schoenmaker and seconded by E.F.R. Osborne the application for severance of 40.01 acres in an agricultural zone was granted. Carried. W. Kay Lycett Q.C., Agent, Fars. Edith May Gordon applicant, Mr. and Mrs. Donald Gordon appeared in support of this application. No other person appeared in support of, or in opposition to this application.. The following material was presented to the meeting: 1. Correspondence from W. Kay Lycett Q.C., Orono, Ontario dated July 100 1973: "further to our telephone conversation yesterday we enclose herewith E.D. Brown sketch of the lands owned by Edith May Gordon indicating at the bottom of the survey the lot which she intends to retain on the sale of the lands to her son, John Gordon. The amount to be retained has a frontage of 150 feet by a depth of 300 feet. On this sketch, Mr. Brown has shown subject lands of 40 acres at the north end which may be the subject of a further application by the son, but, for the present time the sketch is only produced for the purposes of the pre::ent application showing the lot to be retained by Mrs. Gordon. Kay Lycett Q.C., that he submit an R.D. Plan and the matter was adjourned sine die to be brought up on notice when the.requested R.D. Plan is filed with the Committee. Lycett informed the Committee that the applicant, Boyd Harris, is now deceased and he requested that the Committee give this application further consideration. Following a review or thfa facts of this application, it was submitted that the agent 'a. Kay Lycett Q.C., should revise the. application by amending the designation of the applicant to read "Myrtle Irene Harris, Executrix of the Estate of Boyd Harris." Page 4 Meeting Committee of Adjustment July 23, 1973: The Committee were of the opinion that Boyd Harris, having terminated farming activities; his widow stands in his place and is entitled to retain a lot upon the sale of the farm. The Secretary was instructed to request the agent to submit a proper Plan of Survey, of the proposed severance and this application was adjourned awaiting receipt of the requested material. Yeo, Secretary -Treasurer The meeting of the Committee of Adjustment re -convened on Tuesday, July 24, 1973. The following applications were brought forward and the oral representations on same, as submitted at the meeting held on Monday, July 230 1973 were duly reviewed and recorded. Application File No. "B"30-73 E.C. Copping, Owner, R.R. 41 Orono Ontario, for part of Lot 21, Con 6, Township of Clarke, Submission No. "B"30-73-30 Application was made for exemption or partial exemption from provisions of the Planning Act so as to permit the separation of 150' x 290' approximately 1 acre in area from the applicant's land. The Secretary reported that 20 notices of the said hearing had been mailed in accordance with Item 5 of The Rules of Procedure. Mr. E.C. Copping, applicant; accompanied by his son and daughter- in-law Mr. and Mrs. Robert Copping appeared in support of this application. The Secretary -Treasurer presented the following material to the meeting: 1. Correspondence from Robert A. Edmunds, P. Eng., Counties' Engineer and Road Superintendent, Cobourg, Gnta.rio, dated June 26, 1973. The Committee noted the contents thereof; 2. Report from Haliburton, Kawartha, Pine Ridge District Health Unit, P.O. Box 337, Cobourg, Ontario; Mr. Copping, under oath, stated the following facts:
