Osborne. Carried. Application File 11A119-73 Albert J. Munneke, Owner, R.R. 41, Orono, Ontario, Lot 28, Con 4, Township of Clarke, Submission 11A119-73-9 As business arising from former minutes, this application was presented for further consideration. E.R. Lovekin B.A. LL.B., Chairman, disqualified himself from the discussion on this application, having previous knowledge of this matter. Mr. Albert J. Munneke, applicant, appeared in support of this application. No other person appeared in support of or in opposition to this application. As a matter of record the Committee inspected this property on Thursday, April 19, 1973. Chairman, E.R. Lovekin, B.A. LL.B., declared his interest as Mr. Munneke's solicitor and withdrew. Messrs. K. Schoenmaker and E.F.R. Osborne, members, inspected the premises. Mr. A. Munneke, the applicant, accompanied the Committee on their inspection and stated that the present building is 6" too close to the road. He wishes to build the addition flush to the front of the existing building and extend northerly for 30' to house two additional bays, thereby creating an extra work area for garage repair; which will bring the proposed addition within 20' of the northerly limit. Mr. Munneke, being reminded that he was still under oath, confirmed the facts as discussed with the Committee at the meeting on March 26, and during the inspection tour. The Secretary -Treasurer presented a photostat copy of "Lot Inspection Application" dated March 30, 1973, signed "R.J. MacNaull". This Inspection Report replaces the report submitted by Mr. Munneke at the meeting on March 26, 1973 and approves the area applied for. Moved by E.F.R. Osborne, seconded by K. Schoenmaker that this application be granted for a reduction from sideyard requirements of 25' to 201; and a reduction from frontyard requirements of 50' to 49' under append. 2 (d) & (f) amending by-law 1653, subject to the following conditions: 1. Mr. Murray Marchant, the applicant, appeared in support of this application. No other person appeared in support of, or in opposition to this application. As a matter of record the whole Committee inspected this property on Thursday, April 199 1973 and the following facts were noted: 1. The ground slopes down off the road and away to the west; 2. Stakes had been placed on the lot showing the approximate position of the building proposed for the lot; 3. The Committee recalled that at their last meeting, the suggestion was made for 20' sideyards and all parties agreed. This compromise appeared sound and compatible with all the elements of the problem. Mr. M. Marchant, being reminded that he was still under oath confirmed that the proposed carport will be built on the south side and the sideyards will be 20' on each side. Township of Clarke, Owner, Box 219, Orono, Ontario, Wallace Boughen, Chairman of Board, Newtonville Community Hall Board, Agent, Newtonville, Ontario, Lot 8, Con 2, Hamlet of Newtonville, Township of Clarke, Submission "A"10-73-10 As business arising from the minutes of March 26, 19739 this application was brought forward for further consideration. Mr. Wallace Boughen, Chairman of the Board, Newtonville Community Hall Board, Newtonville, Ontario, as agent, appeared in support of this application. No other person appeared in support of, or in opposition to this application. As a matter of record the whole Committee inspected the property on Thursday, April 19, 1973. A key to the building was obtained from Mrs. Wallace Boughen and the property was fully inspected inside and out. The following facts were noted: 1. The Community Hall has probably served the / area for a Century or more. It is obviously a very old building but is actively used as a Community Centre; 2. To the rear, or south, there is no human habitation for 3001. The nearest building to the east is approximately 2001; Page 4 Meeting Committee of Adjustment, April 24, 1973: 3. A small house stands some 75' to the west; next to this house is the United Church which stands on the north corner of the Block on a generous lot, well grassed and cared for; 4. The southerly side of the block fronts on Highway #2. The Community Hall fronts on an East-West street that runs parallel to Highway 42. All the houses in the Block face out on to one of the 4 streets comprising the main Block in the Village. Several small barns are in the hollow centre of this Block. Obviously the pattern of living here, in the past, has been that of retired farmers moving into Town and keeping the odd cow or horse or chickens. This has meant that an extensive green area has been preserved in the middle of the Block; with no fences decimating each lot. The net effect is that a large area for septic tank drainage or wells is available; Mr. Wallace Boughen, being reminded that he was still under oath stated that the existing washroom facilities will be enlarged; a well will be dug and running water installed; bathroom facilities will have a holding tank. Following further discussion the Committee were of the opinion because this is a public building of many years standing, owned by the Township, and is a continuing non- conforming public use, this application should be granted. Moved by E.F.R. Osborne, seconded by K. Schoenmaker that this application be granted, subject to the following conditions: 1. TAKE WARNING that this decision for minor variances of the Clarke Township Committee of Adjustment IS NOT FINAL AND BENDING until the time for appeal by any interested party has lapsed under the terms of the Planning Act of the Province of Ontario. Page 5 Meeting Committee of Adjustment, April 24, 1973: Application File "A117-73 As business arising from 26, 19732 this application was consideration. William Lacroix, Owner, R.R. #1 Ne;,-tonville, Ontario, Lot 9, Con 4, Township of Clarke, Submission No. "A117-73-7 minutes of meeting March brought forward for further Mr. William Lacroix, applicant, accompanied by his wife, appeared in support of this application. No other person appeared in support of, or in opposition to this application. As a matter of record the whole Committee inspected this property at 7:15 p.m. on Thursday, April 19, 1973. Mr. Wm. Lacroix, applicant, accompanied the Committee and the following facts were noted: 1. This property is located just north of the Hamlet of Crooked Creek; 2. Fir. Lacroix pointed out that this lot is 190' deep; so that even with a 50' width, a good area is available; 3. The oricinal house was a shack but an extension had been built on the rear, making the property habitable for a family, but only barely; the only sanitary facilities available were provided by an outdoor privy; 4. The applicant is married, with four children. He wishes to demolish the present dwelling and build a proper home for his growing family. There is no available abutting land for sale and this application is for a reduction in sideyards so that he may utilize the lot he now owns, having an area of 9500 sq. ft. The Committee referred to the facts presented at the meeting held on March 26, 1973 and concluded that it is quite apparent this property is a "lot of record" with an existing single family dwelling that falls far below minimal standards. To permit the applicant to rebuild would be socially, economically and aesthetically desirable. Mr. Wm. Lacroix, being reminded that he was still under oath confirmed the following facts: 1. He was unable to purchase additional land. Land might have been available to the south but the owner was unwilling to sell any land; 2. This property was purchased on May 6, 1967; and the existing dwelling has been on the property 25 years or mord the well is in "AE condition; no problem anticipated with septic installa ion; The Committee intimated that they would impose certain conditions in their decision to which Mr. Lacroix verbally agreed. Page 6 Meeting Committee of Adjustment, April 24, 1973: Moved by K. Schoenmaker, seconded by E.F.R. Osborne, that this application be granted for a reduction from side - yard requirements of 25' to 12' under append. 1, sec. 1, sub sec. (f) amending by-law 1653, subject to the following conditions: 1. The old house must be completely demolished; demolition to commence immediately upon the new house being occupied and to be completed within 6 months; 2. Side yard requirements to be reduced to 12' on either side of the new house; 3. The applicant to be aware that he must secure permission of the Haliburton Kawartha Pine Ridge District Health Unit for new septic disposal system; and he must install a completely new septic system; 4. The Building Inspector, Mr. Horace R. Best, to be given a complete "site plan" prepared by an Ontario Land Surveyor so that the new house would be accurately located; 5. It is understood that this variance is granted on the basis that abutting land could not be acquired and the existing house is below present building standards in the Township of Clarke; 6. Mason Q.C., Barrister & Solicitor, Box 129, 135 Wellington St., Bowmanville, Ontario, for part of Lot 7, Con 4, Township of Clarke, Submission No. "B"35-72-33 As business arising from former minutes, this application was brought forward for further consideration. Mr. Norman Brown, applicant, accompanied by Merrill D. Brown O1S., Bowmanville, Ontario, appeared in support of this application. No other person appeared in support of, or in opposition to this application. Mr. Merrill D. Brown OLS., under oath, and on behalf of the applicant presented the following material to the meeting: 1. Certified Plan of Survey, prepared by M.D. Brown OLS., 1106, Bowmanville, Ontario, dated April 24, 19732 File 73074, annotated "reference plan of part of Lot 7, Concession 4, Township of Clarke, County of Durham;" The Committee perused the Plan of Survey and noted that the average width was stated on the application form to be 101342" feet. Mr. Merrill Brown requested permissicn to amend the application to change the "average width" to 11639 feet" and the area of the lots to be 1148.38 acres" and "48.41 acres". Permission granted and the application form initialled by Mr. M. Brown. Mr. Norman Brown, applicant, was then sworn and upon perusal of the Plan of Survey he stated that the land had been divided as he wished. Referring to "part 3" Mr. Brown stated that this parcel of 3 acres with a house thereon was severed before he purchased the land. The Committee: 1. Referred to the minutes of meetings November 6 and December 7, 1972; 2. Recalled their inspection of this property on November 24, 1972; and following further discussion this application for severance of 48.38 acres in an agricultural zone was granted on motion by E.F.R. Page 8 Meeting Committee of Adjustment, April 24, 1973: Application 11B119-73 David Gray and Frank Gray,owners, R.R. #2, Newcastle, Ontario, for part of Lot 31, Con 2, Township of Clarke, Submission No. "B"9-73-9 Application was made for exemption or partial exemption from provisions of the Planning Act so as to permit the separation of approximately 220' x 200' being approximately 1 acre in area from the applicants' land. Mr. David Gray, applicant, appeared in support of this application. No other person appeared in support of or in opposition to this application. The Secretary -Treasurer reported that 13 notices of the said hearing had been mailed. Mr. David Gray, under oath,presented the following facts: 1. He is joint owner of this farm property with his brother Frank Gray; 2. The farm comprises approximately 125 acres and he has farmed this land approximately 43 years, in fact he was born and raised on the farm; 3. He now proposes to cease the farming operation and this application is for permission to retain a lot from the sale of the farm; 4. He has entered into an Agreement to sell the land and a Plan of Survey is being prepared of the farm as a whole and the location of the lot to be severed will be shown thereon; Following further discussion this application was adjourned to enable the Committee to inspect the property and the submission of a proper Plan of Survey prepared by an Ontario Land Surveyor. Kay Lycett Q.C., Agent, Barrister & Solicitor, Orono, Ontario, for part of Lot 17, Con 6, Township of Clarke, Submission No. "B"16-73-16 Application was made for exemption or partial exemption from provisions of the Planning Act so as to permit the separation of approximately 150' x 300' being approximately 1 acre in area from the applicant's land. Mrs. Edith May Gordon, applicant, accompanied by W. Kay Lycett Q.C., her agent, appeared in support of this application. No other person appeared in support of, or in opposition to this application. Kay Lycett Q.C., Barrister & Solicitor, Orono, Ontario, dated April 17, 1973: - "We have filed with you an application on behalf of Edith May Gordon for severance of approximately one acre of her property comprising part of Lot 17, Concession 6 of the Township of Clarke. She owns a total of approximately 83 acres which was originally farmed by her husband during his lifetime but now under the circumstances it is Mrs. Gordon's intention to sell this property and keep back a building lot for her own purposes. When you have first considered this matter at your next meeting and upon your direction, we will obtain the necessary survey of the subject lands. Yours truly, (sgd.) "W.K. Lycett" Mrs. Edith M. Gordon, under oath, stated the following facts: 1. She has lived on the property approximately 25 years; 2. There are 83 acres which were farmed by her husband during his lifetime and the main source of income was from this general farming operation; 3. She now proposes to sell the farm and retain an acre and will build a home near the road for easy access. Kraayvanger, under oath, stated the following facts: facts: 1. This application is for a severance of a strip of land of approximately 10' to be sold to an abutting owner, Mr. Boyd Kinney; 2. This is a corner lot on the Leskard Road and Taunton Road; Mr. Boyd Kinney, under oath, stated the following 1. He wishes to purchase the 10' strip to increase the driveway. His house is too far to the south to allow this and the addition of this extra land would give him a double driveway for a 2 car garage. The Committee perused the Plan of Survey and noted the position of the dwelling and garage on Mr. Kenney's property; Following further discussion this application was adjourned to enable the Committee to inspect the property. Van der Spruit, Owner, R.R. #21 Orono Ontario, for part of Lot 30, Con 6, Registrar's Compiled Plan 687, Lot 399 Township of Clarke, Submission No. "A"11-73-11 Application was made for exemption or partial exemption from provisions of sub -division control by-law 1592 as amendedby by-law 1653 to permit an existing residential garage to be partially located in the sideyard of a proposed new single family dwelling. The Secretary -Treasurer reported that 19 notices of the said hearing had been mailed in accordance with Item 5 of the Rules of Procedure. 4 Mr. A. Van der Spruit, applicant, accompanied by his wife Mrs. Van der Spruit appeared in support of this application. The following persons also appeared - Mrs. John Gower; Ms Jean Fallis, abutting owners. No other person appeared in support of, or in opposition to this application. Mr. K. Schoenmaker, member, stated that the applicant being his brother-in-law he would.disqualify himself from the discussion on this application. Chairman, E.R. Lovekin B.A., LL.B., and member E.F.R. Osborne conducted the hearing of this case. Mr. A. Van der Spruit, stated, under oath, the following facts: 1. This application is for a 4' variance so that he may retain an existing garage; 2. He wishes to demolish his present dwelling and replace with a new dwelling approximately 49' x 281. To comply with the required set back and side yards etc., the existing garage in its present location would be partially situate in the sideyard of the proposed new dwelling; 3. The new dwelling will line up with existing dwellings; Mrs. John Gower and Ms Jean Fallis perused the photostat plans presented with the application, discussed with Mr. Van der Spruit the location of the proposed dwelling and verbally stated that they would have no objection to this application. Mr. John Edward Carscadden, applicant, accompanied by his agent W. Kay Lycett Q.C., Barrister & Solicitor, Orono, Ontario, appeared in support of this application. The following persons also appeared: Mr. & Mrs. Stanley J. Weyrich, R.R. 41 Orono Ontario, Mr. McGrath and Mr. Dick Rutherford, members of the Oshawa Ski Club, Box 174 Oshawa, Ontario. Page 12, Meeting Committee of Adjustment, April 24, 1973: The Secretary -Treasurer reported that 20 hearing notices of the said hearing had been mailed in accor:ance with Item 5 of the Rules of Procedure. The Secretary -Treasurer presented the following material to the meeting: 1. Correspondence from W. Kay Lycett Q.C., Barrister & Solicitor, Orono, Ontario, dated April 11, 1973: " I am the solicitor for Mr. John Edward Carscadden who is making application on behalf of himself and his brother, in connection with severance of part of his lands comprising part Lot 17 in Concession 7 of the Township of Clarke. The subject lands in this application will comprise 40 acres parcel fronting on the road allowance to the east of the above noted Concession lot, to have irregular shape, and a frontage which is at this point not determined. Mr. Carscadden tells me that he will prepare a rough sketch of the proposed lands which I will file with the application so soon as it is received by me. The land in question I am told is not suitable for their farming purposes and they wish to dispose of the same by sale and have in fact obtained a conditional agreement to sell this property, conditional upon obtaining your committee's consent. "Re: Application File B 14-73 John Edward Carscadden Prior to submitting comments regarding the above reference, the Planning Board have requested that, if possible, a copy of the survey of the subject lands be made available to this Board for their pursual. May we thank you for your consideration in this matter." The Committee noted the contents thereof. 3. A pencil sketch of the proposed severance showing two lots outlined on the north east corner of the property; the Mr. John E. Carscadden, under oath, stated that/subject land is not suitable for farming, it is vacant marginal farm land and he has a purchaser interested in the property for a cottage. He is the owner of approximately 200 acres with the exception of a former Walter Frank Cottage and a school house on the north west corner of Lot 16. The Committee asked whether the frontage would be on a public road. Mr. Carscadden replied that frontage would be on the side road between lots 16 & 17. The Committee noted that the pencil sketch did not indicate the whereabouts of the frontage on the side road between lots 16 & 17 and during a discussion it appeared that this road is opened part way. Mr. Horace R. Best was asked as Clerk to attend by the Chairman and asked for his opinion on the condition of the road and the probable attitude of the administrative officials towards development in this area. 0 . . . 0 0 J Page 13, Meeting Committee of Adjustment, April 24, 1973: Mr. Best indicated that the policy is to adopt an attitude similar to a sub -division agreement where persons are applying for special use .roads. Mr. and Mrs. Stanley J. Weyrich and the members of the ski club, Messrs.
