Turansky, ~'gent, R.R. #1 Kendal Ontario, for part of Lot 10, Con 3, Township of Clarke, Submission No. "B"41-72-40 As business arising from minutes of former meetings, this application was brought forward for further consideration. Mr. Joseph Jilisen, the applicant, appeared in support of this application. No other person appeared in support of, or in opposition to this application. Following a general discussion and reference to former minutes regarding this application, Mr. Jilisen, under oath indicated the contents of a proposed Affidavit which he will have sworn and filed concerning his farming operations and residency on the land. A certified Plan of Survey prepared by an Ontario Land Surveyor will also be submitted, as soon as prepared. Application adjourned awaiting receipt of the referenced material. Mr. Howard A. Quantrill, applicant, accompanied by his son John Quantrill appeared in support of this application. No other person appeared in support of, or in opposition to this application. The Secretafy-Treasurer presented the following material to the meeting: 1. Hutchings" with photostat copy of report attached thereto; 2. Lovekin, Chairman, disqualified himseif from the decision on this application, having previous knowledge of this application. Mr. K. Schoenmaker, senior member, conducted the hearing on this case. As a matter of record the whole Committee visited the Quantrill family residence at 3:30 p.m. Saturday, March 17, 1973. Mr. Howard Quantrill Sr., owner and applicant, accompanied the Committee to the subject land and the following facts were noted: 1. Road conditions were generally poor with spring break-up and heavy rains. Despite this, it was noted that the road was in good shape; 2. The proposed dwelling would be in a grove of pine trees on sandy, high lands; 3. Access to the Township Road would afford a good line of vision; 4. The parcel of land to be severed being over 40 acres with 50 acres remaining, no objection to the application could be seen; S. Mr. Quantrill stated that he expected a Plan of Survey would be prepared for consideration at the meeting on March 26, 1973; 6. The Committee intimated to Pair. Quantrill that a formal decision would not be made until the Plan of Survey had been presented; The Committee perused the Plan of Survey presented at this meeting and Mr. Howard Quantrill, under oath, i"ndicated on said Plan the property he wished to sever. The Committee noted that the Plan of Survey revealed a different area than applied for and granted Mr. Quantrill permission to amend his application to conform with the actual Survey. Mr. Merrill D. Brown OLS., being reminded that he was still under oath assisted Mr. Quantrill to amend the application showing the subject land to be 45.315 acres with a remainder of 50 acres. The amendment was initialled by Merrill D. Brown OLS., and P;r. Howard A. Quantrill. Application granted for agricultural zone on motion by K. Schoenmaker. Carried. No other person appeared in support of; or in opposition to this application. The Secretary -Treasurer presented the following material to the meeting: 1. Registrar for the Registry Division of Durham West (10)" and annotated "I require this plan to be deposited under part 2 of the Registry Act, Mar 21,1973 signed 11M.D. Brown" Page 3 Meeting Committee of Adjustment, March 26, 1973: The Committee noted that the Plan of Survey revealed a different.area than applied for and granted Nr. Alldred permission to amend his application to conform with the actual survey. Mr. Brown, being reminded that he was still under oath assisted Mr. Alldred to amend th, application showing the subject land to be 40 acres with a remainder of 34.43 acres which was pointed out as being less than 40 acres but because it contained existing buildings it was assumed that the creation of such a parcel would not cause a building permit problem and the topography of the land was such that,this parcel is reasonable and not in conflict with the general spirit and intent of the by-law. Following further discussion the Committee referred to the minutes of meetings January 22 and February 21, 1973; recalled their inspection of the property on February 19, 1973 and this application for severance of 40 acres in an agricultural zone was granted on motion by E.F.R. Osborne, seconded by K. Schoenmaker. Carried. CLASSIFICATION 10 "A" Application File "A"5-73 Richard E. Wicha, Owner, 256 Grooms Avenue, Oshawa, Ontario, for part of Lot 31, Con 2, Township of Clarke, Submission "A"5-73-5 As business arising from the minutes of meeting February 217 1973 this application was brought forward. Mr. Richard E. Wicha, applicant appeared in support of the application. No other person appeared in support of, or in opposition to this application. The Secretary -Treasurer presented the following material to the meeting: 1. Correspondence from Ministry of Transportation and Communications, Box 150 Port Hope Ontario, dated March 13, 1973; from 1201 Wilson Ave. East Building dated March 7, 1973;.and also from 1201 Wilson Ave. East Building, dated February 21, 1973, Toronto, Ontario. The Committee noted the contents thereof. This application being cancelled, the Departments concerned will be notified accordingly. Summary The applicant originally presented an application for a minor variance in regard to set back and/or rear yard requirements at the meeting held on February 21,.1973. Following a discussion with the Committee, the applicant arranged to purchase additional land from abutting owners, namely Frank Gray and David Gray. This would enable him to comply with the set back requirements of amending by-law 1653 and also the set back required by the Ministry of Transportation and Communications. The Committee were of the opinion that the applicant had inadvertently presented an incorrect application in the matter and on motion by K. Schoenmaker and seconded by L.F.R. Osborne the Secretary -Treasurer was instructed to credit the $35.00 fee received from the minor variance application on a new application for severance. carried. This application for a minor variance is, therefore, cancelled and the facts will be considered under application for a severance File "B"11-73-11 - Frank and David Gray. The Secretary -Treasurer reported that 12 notices of the said hearing had been mailed in accordance with Item .5 of the Rules of Procedure. Mr. Frank Gray, as applicant and agent, accompanied by Mr. Richard E. Wicha the proposed purchaser appeared in support of this application. It has been the policy of this Committee to allow the enlargement of an existing property where there has been no objection from the abutting owners and ..here the addition of land to the existing property would be of benefit to the Community at large in that it would enhance the existing property. The Committee believes that this application falls squarely within this general policy. Mr. Frank Gray and Mr. Richard Wicha, under oath, indicated on the Plan of Survey the land intended to be sold and added to Mr. Wicha's existing property. Following further discussion this application for a severance of 0.19 acres to an abutting ol,ner was granted on motion by E.F.R. Osborne, seconded by K. Schoenmaker. Carried. Mr. Joseph G. Stephenson, applicant, accompanied by his nephew Mr. James Lewis Stephenson proposed purchaser, appeared in support of this application. No other person appeared in support of, or in opposition to this application. The Committee reviewed the following facts of this application before proceeding to finalize this matter: 1. The application was originally presented on September 15, 1971; 2. The application was adjourned awaiting a report on a proposed re -zoning launched before the Planning Board; 3. The minutes of a meeting held on the 13th of October, 1971 contain all the correspondence pertaining to the application. The matter was adjourned at that meeting to await the final disposition of the matter by the Planning Board; 4. The Committee noted that the Plan of Survey on file was annotated "preliminary" and requested Mr. M.D. Brown.QLS., to submit a certified Plan of Survey identical to the preliminary Plan of Survey but duly certified. The Chairman E.R. Lovekin instructed the Secretary -Treasurer to prepare the decision and send a copy to the applicant upon receipt of the requested certified Plan of Survey from M.D. Brown ,ULS. Robert Manina and Owners, Alma Manina, P.O. Box 532, Acton, Ontario, for part of Lots 3 & 4, Con 4, Township of Clarke, Submission No. "B"7-73-7 Submission No. "B"8-73-8 Applications were made for exemption or partial exemption from provisions of the Planning Act so as to permit the separation of two 40 acre parcels from the applicants' land. The Secretary -Treasurer reported that 27 notices of the said hearing had been mailed in accordance with Item 5 of the Rules of Procedure. Mr. and Mrs. Robert Manina, applicants appeared in support of this application. An abutting owner Mrs. Marjorie Westheuser also appeared. No other person appeared in support of, or in opposition to thi application. Mr. Robert Manina, under oath, presented the following facts: 1. He owns approximately 197.3 acres which he purchased August 28, 1968; 2. He lived on the property approximately 18 months and was then transferred to Italy for 11years, for business reasons. He is now living and working in [=lest Toronto; 3. The farm is presently rented to one James Phillips; 4. These applications are for two severances of approximately 40 acres each, which in fact, will create multiple severances; vir. Manina presented a pencil sketch of the property and indicated on the sketch the workable area. There are no buildings to the north. The house, driveshed and barn are located on that part of the farm .rented by Mr. Phillips. Following a lengthy discussion with the Committee, Mr. Manina requested permission to amend application "B"8=73 so that the proposed severance would contain the existing buildings with an additional 22 acres of land for a total of 62 acres with 1060' frontage, thus leaving the pond and bush area in one area. This request for amendment was granted and the application initialled accordingly. Page 7 Meeting Committee of Adjustment, March 26, 1973: Mrs. Marjorie- Westheuser, an abbuting owner appeared at 9:45 p.m. and the Committee reviewed the applications with her to enable her to consider the facts and make her representations. Mrs. Marjorie Westheuser, under oath, stated th.t she was concerned that the severance would be of the bushland abutting her property and that it might interfere with a private bird sanctuary located on her abutting property. The Committee indicated the proposed severances on the sketch submitted by the applicant and asked Mrs. Westheuser if she wished to submit any formal objection. Mrs. Westheuser replied she would have no objection to these applications as presented and that her interest in the area is in preserving the ecological nature of the area -and possibly having it posted as a "game preserve". These applications were adjourned to enable the Committee to inspect the property. CLASSIFICATION 10 "A" Application "B"10-73 Mrs. Margaret Allen, Owner, Mill St. Orono Ontario, Merrill D. Brown GLS., Agent, 121 Queen St., Bowmanville, Ontario, for part of Lot 9,10,11 Block 7, 10,11 Block Z Police Village of Orono, Lot 28, Con 5, C.G. Hanning's Plan, Township of Clarke, Submission No. "B1110-73-10 Application was made for exemption or partial exemption from provisions of the Planning Act so as to permit the separation of an area of 257.071x2551x1601, an area of approximately 0.92 acres from the applicant's land. The Secretary -Treasurer reported that 23 notices of the said hearing had been mailed in accordance with Item 5 of the Rules of Procedure. Mrs. Margaret Allen, applicant, accompanied by her agent Merrill D. Brown CLS., Bowmanville, Ontario, Mrs. Harold Hooey, daughter of the applicant;;Mr. Elgin Heard, the proposed purchaser appeared in support of this application. The following persons also appeared - Mr. and Mrs. James Middleton and Mr. Russell Major all of the Village of Orono. No other person appeared in support of, or in opposition to this application. The Secretary -Treasurer presented the following material to the meeting: 1. Direction, dated 8th March, 1973, signed "Mrs. Margaret Allen" authorizing Merrill D. Brown 'OLS., to act as agent "for me and on my behalf before your Committee"; Mr. Merrill Brown OLS., under oath, stated the following facts: 1. The proposed purchaser Mr. Elgin Heard has title to a parcel of land 66' x 8212' in instrument 411496. Through some error in description it appears that Mr. Heard's dwelling is not within his lands, as shown on Plan of Survey, dated Nov 2, 1972 "r.visions Mar 1291973 file 72149, prepared by M.D. Brown OLS;. Page 8 Meeting Committee of Adjustment, March 26, 1973: 2. Mr. Heard had entered into an Agreement of Sale with Mrs. M. Allen to increase the size of his parcel and realizing that a Plan of Survey would be required to complete this application, I was retained. 3. The surveying of this land has revealed quite a few boundary problems. The Harining Plan shows several lots, namely 8 to 12 in Block 7 that have a plan depth of 4 chains or 264ft. The situation here is the persons on these lots have been in possession of the lands to the rear of these lots for a considerable number of years. Mr. Brown then indicated on the Plan of Survey a cedar hedge on Mr. Heard's property which had been used as a line of possession. This does not agree with the legal description in the deeds. The lands owned by f•'irs. Allen are outlined in "Black" which in- cludes a 16.5' right-of-way, to get to the lot at the,south, located north of one Carl Wilkins. Mr. Brown stated that he followed a natural line of possession. The severance applied for is shown inside the "black" outline. Mrs. Margaret Allen was then sworn and confirmed the facts as presented by Mr. M.D. [.sown GLS. The Committee explained to the applicant Mrs. M. Allen and to her daughter Mrs. Harold Hooey that the Committee of Adjustment did not verify or certify title but merely gave permission under the Act for a deed to be registered. Mr. Brown proceeded to point out that part of the property was a public street allowance to which title would have to be obtained. He further pointed out that building lines would be affected by the properties owned by the following persons: (a) Lot 11 - Derek Newman; (b) Lot 10 - Margaret Haitsma; (c) Lot 11 - a portion thereof - Eric Barrett; Mr. Brown explained to the Committee that he proposes to obtain a new deed to the property described on the Heard building line shown on the Plan of Survey which is attached to the application. This is a simpler method of description by adding to the existing lands. Mr. Brown asked Mrs. M. Allen some questions regarding the remnants of a former fence line. Mr. Brown also explained to all the parties present, the proposed new deed line on the Plan of Survey. The Committee asked everyone if they had any objections to Mr. Brown's proposal and no one objected, indicating they were satisfied to have the boundaries corrected. Application adjourned to enable the Committee to inspect the property. CLASSIFICATION"R1" Page Meeting Committee of Adjustment, March 25, 1973: Application file "A'7-73 William Lacroix, Owner, R.R. 41 Nei✓tenville, Ontario, Lot 9, Con 4, Township of Clarke, Submission No. "A"7-73-7 Application was made for exemption or partial exemption from provisions of sub -division control by-law 1592 as amended by by-law 1653 for a reduction from required 25' sideyard to a 12' sideyard. The Secretary -Treasurer reported that 16 notices of the said hearing had been mailed in accordance with Item 5 0£ the Rules of Procedure. Nir. William Lacroix the applicant appeared in support of this application. No other person appeared in support of, or in opposition to this application. Mr. Frank Overloop accompanied Mr. Lacroix as an observer. i°ir. Lacroix under oath stated the following facts: 1. He has owned the subject land since 1967; 2. The area of the lot is approximately 50' wide and 190' deep; 3. The existing dwelling is badly in need of repair as well as being too small for a growing family. He now wishes to demolish the said dwelling and build a new home; 4. He is unable to purchase land from abutting owners to enlarge the lot and is, therefore, requesting relief from sideyard requirements under amending by-law 1653. The request is for 12' sideyards on each side so that he can build a full basement, 1 storey dwelling, 26' wide and 48' long; 5. The existing dwelling is situated to one side of the lot having a 5' sideyard and a 30' sideyard. The new dwelling will be in the centre of the lot, allowing 12' sideyards as requested. Application adjourned to enable the Committee to inspect the property. Bowmanville, Ontario, Lot 29, Concession 2, Township of Clarke, Submission No. 118"-73-8 Application was made for exemption or partial exemption from provisions of sub -division control by-law 1592 as amended by by-law 1653 for a reduction from required sideyard of 25' to a 15' sideyard. The Secretary -Treasurer reported that 18 notices of the said hearing had been mailed in accordance with Item 5 of the Rules of Procedure. Dir. Murray Marchant, the applicant, appeared in support of this application. Mr. Kenneth Stubbingon, Box 223 Newcastle, Ont,,rio, an abutting owner also appeared. No other person appeared in support of, or in opposition to this application. Mr. Murray Marchant, under oath, stated the following facts: 1. This is a vacant lot, purchased January 13, 1973 on which he proposes to build a 3 bedroom bungalow 1206 sq ft. with Attached carport 12' wide x 20' long. Page 10 Meeting Committee of Adjustment, March 26, 1973: 2. He proposes a sideyard of 25' on the north boundary of the lot and requests a reduction to 50' on the south side of the lot; 3. The proposed carport is not enclosed, but merely for the protection of the car; 4. Mr. Marchant presented a photostat copy of a Plan of Survey prepared by Pierrill D. Brown Limited, Land Surveying & Enginerring, 121 Queen St. Bowmanville, Ontario, dated March 6, 1973-#73040 annotated "note this plan not prepared for registration purposes"; 5. The Committee perused the Flan of Survey and discussed with the applicant the location of the proposed dwelling and the carport. Mr. Marchant stated that he has spent a lot of money on fill and feels that this would enhance the property, as well as the carport being a "see through" construction this would not block the view as a garage would; The Secretary -Treasurer presented the following material to the meeting: 1. Correspondence under date of March 26, 1973 - "We oppose the consent of this minor variance as we feel the 25 foot sideyard requirements now in effect gives a better sense of privacy, We moved to the country to get away from crowded neighbourhoods and we'd like to see you uphold the present by-law. signed "Stanley Lawson" "Mrs. Kathleen Lawson" 2. Correspondence under date of March 26, 1973 - "We oppose this change also, for the reason of crowding" signed "Julia M. Stubington" Following further discussion with the applicant, he stated that he would be willing to amend his request for 20' sideyards on each side of the lot. Mr. Kenneth Stubbington, under oath, having heard Mr. Marchant's suggestion stated that he attended the meeting to represent Mr. & Mrs. Lawson. He would not argue with the proposed amendment and was of the opinion that Mr. and Mrs. Lawson would be in agreement with the central location of the proposed dwelling. The lawson property is situated to the south of the subject land and the vacant land to the north is owned by one Mr. McBride. To Mr. Sutbbington's knowledge, Mr. McBride has no plans to build a house at the present time. The property is presently used for a horse paddock. However, this application did concern Mr. and Mrs. Lawson. As for himself, he had no objection. There being no further discussion the Committee granted Mr. Marchant's request to amend the application to 20' sideyards on each side and initial same. Munneke Proposed Owner, R. R. #1, Orono, Ontario, Lot 28, Con 4, Township of Clarke, Submission "A'9-73-9 Application was made for exemption or partial exemption from provisions of sub -division control by-law 1592 as amended by by-law 1653 for a reduction from sideyard requirements of 25' to 20' and a reduction from frontyard requirements of 50' to 49'. The Secretary -Treasurer reported that 16 notices of the said hearing had been mailed in accordance with Item 5 of the Rules of Procedure. Mr. Albert J. Munneke, the applicant, appeared in support of this application. No other person appeared in support of, or in opposition to this application. Mr. Munneke, under oath, stated as follows: 1. He is the proposed purchaser of this property and will take possession on March 30, 1973; 2. He wishes -to add an extension to an existing Sunoco Service Station for an extra work area for garage repair, classified as 2 bays; 3. The proposed addition would be approximately 30' x 50' and will be bu.lt in line with the front of the existing building; The following material was presented to the meeting:' 1. A photostat copy of a Plan of Survey, prepared by M.D. Brown GLS., 1106, dated July 6, 19709 070066. Mr. Munneke indicated the location of the proposed addition; 2. Photostat copy of Lot Inspection Application, from Haliburton, Kawartha, Pine Ridge District Health Unit Box 337, Cobourg, Ontario, signed "R.J. MacNaull", dated February 26, 1973; Mr. Munneke stated that since the property had been inspected by R.J. MacNaull for an addition of 25' x 651, he now proposes to have the repair shop with a frontage of 30' wide and 50' deep with the sideyard requirement as applied forJt. Munneke indicated that he would contact Mr. MacNaull and request a second inspection for presentation to the Committee. Application adjourned to enable the Committee to inspect the property. Photostat copy of Plan showing location of the Community Hall and proposed location of new washrooms; Mr. Wallace Boughen, under oath, stated that he is Chairman of the Neo✓tonville Community Hall Board and is in charge of renovating the existing building which will contain public wash- rooms. The Community Hall is used on an average of once a week and the enlargement of washrooms is necessary for the use of the buildino for recreational purposes etc. Application adjourned to enable the Committee to inspect the property.
