Osborne, Member The Committee inspected properties on Saturday, March 17, 1973, from 2:00 p.m. until 4:30 p.m., following which a meeting in Committee was held in the office of E.R. Lovekin S.A. LL.B., Chairman, to discuss the applications concerned. Decisions were made on the following applications: Application No. "A"1-73-1 Gary Ford, Owner, No. "A"2-73-2 Gwen Ford Owner, 11o. "A"3-73-3 1036 Willowdale Avenue, No. "A"4-73-4 Oshawa, Ontario, for part of Lot 30, Con 6, Township of Clarke, Plan 687 Lots 8,9,10,11, Submission "A111-73-1 Submission "A112-73-2 Submission "A"3-73-3 Submission "A114-73-4 As a matter of record the whole Committee inspected these properties at 2:30 p.m. Saturday March 17, 1973. The following facts were noted: 1. The houses already constructed were observed; 2. The land was too flat - to make basement garages feasible; 3. To maintain 25' sideyards on 75' lots tends to make the houses look too small; a slightly wider house would look much better from the road; 4. The lots are previously existing lots of 75' and a house can be built on them, so it is not a matter of a house or no house, it is a matter of the style and type of house that will be built; 5. Having viewed the existing houses; the lots; the character of the area, the Committee agreed with the contentions of the applicant; Following further discussion, the Committee recalled the facts presented by Mr. Gary Ford, under oath, at the last meeting on February 21, 1973 and the applications for minor variances were granted on motion by E.F.R. Osborne, seconded by K. Schoenmaker as requested: Lot 8, Gary Ford, "A"1-73-1 - to permit erection of 351 home with 20' sideyard on each side; Lot 9, Gwen Ford "A"2-73-2 - to permit reduction in sideyard from 25' to 19' for single car garage; Lot 10, Gary Ford "A"3-73-3 - to permit reduction in sideyard from 25' to 19'6" for erection of carport Lot 11, Gwen Ford,"A"4-73-4 - to permit erection of 37' home with 19' sideyard on each side; SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the carport and garage abut each other on the common boundary so as not to obstruct the view from each house; 0 Page 2 Meeting in Committee, March 17, 1973: 2. TAKE WARNING that this decision for minor variances of the Clarke Township Committee of Adjustment IS NOT FINAL AND BINDING until the time for appeal by any interestc,d party has laps:d under the terms of the Planning Act of the province of Ontario. THIS TIME FOR APPEAL IS 21 DAYS FRIM THE DATE that the minutes of this decision have been mailed to the Minister of Municip,=1 Affairs of the Province of Ontario; 3. This decision should not be registered on title until the said time for appeal has lapsed when the applicants shall then register on title by way of Deposit a copy of the Form of Consent and shall forthwith thereafter forward to the Secretary of the Committee of Adjustment a duplicate Certificate of Deposit or a Notarial copy thereof; 4. AND FURTHER that upon receipt by the Secretary of the aforesaid document, the appropriate administrative officials of the Township of Clarke shall be authorized to issue any and all necessary permits or to take any steps necessary to implement this decision. K, Orono, Ontario, McComiskey & Atkinson, Agent, 233 King Street E., Bowmanville, Ontario, for part of Lot 32, Con 7, Township of Clarke, Submission "B"4-73-4 Submission "B"5-73-5 The Committee inspected these properties at 3:00 p.m. on Saturday, March 17, 1973. There was nothing on the site to change the Committee's opinion. The re -zoning having been granted; the Committee could see no reason why these applications should not be granted. The Committee recalled the minutes of meeting February 21, 1973 at which time all the facts of the re -zoning by-law were duly recorded. Moved by K. Schoenmaker, seconded by E.F.R. Osborne that the applications for consent be granted, permitting said land to be used as 2 residential building lots as set out in restricted area by-law 1729, passed and approved on the 7th day of March, 1972 and entered as "O.B. No. S2, Folio No. 40, January 19, 1973 K.C. Andrews, Secretary Ontario Lunicipal Board". CLASSIFICATION "RR 1" CARRIED. [;ox 17, Ne�,tonville, Ontario, for part of Lot 8, Con 2, Township of Clarke, Submission No. "A116-73-6 As a matter of record the whole Committee inspected this property on Saturday March 17, 1973 at 2:00 p.m. The applicant was a,_,sent and the Committee spoke to the neighbours, F,r. and i"rs. K. Lane, who stated they had received a Hearing Notice of this application and they verbally agreed that they had no objection to the proposed extension of the building, which would be made to increase the size of the existing kitchen. No substantial alteration in the appearance of the area would be affected by the proposed addition and the effect of the decision is no more than to sanction the enlargement of an existing nen-conforming small residence.(ref. minutes Feb 21,1973). Moved by K. Schoenmaker, seconded by E.F.R. Osborne that this application for minor variances be granted;as follows: (a) permission for the construction of an addition to a single family dwelling less than 25' from side lot line and less than 110' from centre line of Highway 42; (b) permission for a sideyard variance of 10' from required 25' (c) permission for a set back variance of 10' from required 1101; (d) permission for an existing residential garage in a sideyard, variance of 5' from required distance of 10' from the main building; SUBJECT TO THE FOLLCIVING CONDITIONS: 1.
