As a matter of record the whole Committee inspected
this property on Monday February 19, 1973, and noted the
following facts:
1. The property is located on the north side of
County Road 49, an improved road that runs
east from Rice Lake and continues to the Village
of Kirby on Highway 4#115;

2. Access from the road to the land is on a suitable
level;
Chairman E.R, Lovekin reported that he had received a
telephone call from Mr. C.D. Fitzgibbon, agent for the applicant,
requesting the Committee's consideration of his Sworn Declaration
_ with Plan of Survey attached thereto as evidence in this case,
due to the fact he would be unable to attend this meeting.
, The Committee perused and accepted the referenced material,
referred to the minutes of meeting January 22, 1973 and concluded
that the applicant being a bona fide farmer and the area and
frontage of the lot being acceptable, this application be granted
on motion of E.F,R.Osborne, seconded by K. Schoenmaker. Carried.

this application was brought forward for further consideration.
No person appeared in support of, or in opposition to this
application.
As a.matter of record the whole Committee inspected this
property at 5:15 p.m. February 19, 1973, and in the company
of Nir. Alldred briefly reviewed his application. The following
facts were noted:
1. Mr. Alldred's landsare separated by a railway and
road allowance, Mr. Alldred mentioned these may
well be natural severances.
The Committee, as usual, refrained from expressing any opinion
on matters not directly in issue before the Committee, but
tequested Mr. Alldred to confirm that the application as made
by him was the way he wanted the land severed by the Committee.
Mr. Alldred verbally confirmed he wished the application to be
considered as submitted by him.,
2. The Committee's inspection confirmed a fact already
known to them that Mr. Alldred is a "bona fide farmer".
3. The area in question is rolling farmland with ready
access to the abutting sideroad which is a well developed
and well used road.
Mr. Alldred did not appear at this meeting and M.D. Brown OLS
of Bowmanville, Ontario,.attending on behalf of another applicant,
stated that although he was not officially named as agent in
this application he had some knowledge of the property, having
prepared the official sketch. Mr. Brown also stated that
in a conversation with Mr. Alldred, he was of the opinion that
Mr; Alldred was awating the Committee's direction to request
a formal Plan of Survey.
While the Committee do not make any formal decision in the absence
of the applicant or his agent, in this case they instructed the
Secretary to request lire Alldred to submit a certified Plan of
Survey, prepared by an Ontario Land Surveyor, at which time the
application will be further considered. Application adjourned .

Mr. W. Turansky, R.R. 41, Kendal, Ontario, as agent for
the applicant, appeared in support of this applicationl No
other person appeared in support of, or in opposition, to this
application.
As a matter of record the whole Committee inspected this
Property on Monday, February 19, 1973, and the following facts
were noted:
1. Mr. Jilisen was absent, working from home for
the week;
2. Mrs. Jilisen indicated to the Committee a fence post,
showing the boundary of the land they wished to sever;
3. The area is the same as the north -south road which
it abuts. The land in the area is quite flat;
4. The land is even with the road and drainage is to
the south and east away from the road;
S. The Committee recalled a previous application by
Mr. Jilisen, when he was still farming, for a
severance of an area of 35 acres of "agricultural
land" from "recreational" type land (ref. "B"185-69-176
July 18, 1969);
6. Mr. Jilisen is now "working out" and is not "farming"
in the proper sense of that word at this time. He wast
for many years a "bona fide farmer" and is now "semi-
retired";
Mr. Wm. Turansky, under oath, stated that he has known
Mr. Jilisen several years, and,to his knowledge, due to a
health problem Mr. Jilisen had ceased his tobacco farming
operation. Mr. Jilisen is presently employed by the Department
of Highways, and now wishes to retain 1 acre from the 35 acre
parcel for a residence and sell the remainder of approximately
34 acres.
The Committee, after due consideration of the facts presented,
instructed the Secretary to -request from the applicant the
following: (a) A Sworn Affidavit stating the number of
years he had carried on a bona fide farming
operation and the reason for this application;
(b) A -certified Plan of Survey, prepared by an
Ontario Land Surveyor;

1. Correspondence from W. K. Lycett Q.C., Orono Ontario
dated February 7, 1973; "I deposited with you
an application of my client, Charles. Reid for consent
to sever a portion of his lands comprising part of
Lot 32 Concession 4 of the Township of Clarke. Mr.
Reid at present owns approximately 100 acres and this
lot and on this property carries on two under -takings,
one a farm operation and two a sales barn operation.
It is his intention to sever the sales barn portion
and has entered into a conditional sale of the sales
barn comprising a 1.974 acre of parcel of land upon which
the sales barn is located and this application now filed
with you pertains to the severance of the sales barn
property. , In support of the application I have also
filed with you two copies of a survey prepared by
Charles F. Riley dated January 24, 1973"
2. A photostat copy of a Plan of Survey prepared by
C.F. Riley Ontario Land Surveyor, P.O. Box 375,
Newcastle, Ontario, dated January 24, 1973;
3. Correspondence from Lands and Waters Branch, Lindsay,
Ontario, dated 'February 15, 1973, signed "J.R. Gilbert"
wherein the Committee are advised "please be advised
that the matter was reviewed and we have no objection
to the proposal"
The Committee perused the Plan of Survey, read agent
W.K. Lycett's letter of February 7, 1973 and listened to his
viva voce submissions.
The Committee noted that the area as fenced and as sold is
slightly different in measurement than the zoning as set out
in Map "2" of By -Law 1653 which shows an area of 300' x 2501.
Following further discussion this application was adjourned to
enable_- the Committee to inspect the property.

As a matter of record the whole Committee viewed this
property on Monday, February 19, 1973 at 6:15 p.m. and the
following facts were noted:

1. The Committee are familiar with this property
and recalled their inspection on a previous
occasion when a severance was granted to Mrs. Hamilton
of approximately 8 acres on which is situate her
dwelling house and other buildings, leaving a remaining
parcel of approximately 16.11 acres(ref "B"110-68-113,
Aug 12, 1968);
2. The application now before the Committee is for
severance of a centre lot of approximately 3.04 acres,
one of three proposed lots, situate at the north
end of the 16.11 acres.
3. The area is located near the headwaters of Wilmot
Creek and the question of ecology should be carefully
examined;
Mr. Wm. Roth under oath, referred to the Plan of Survey presented
to the last meeting and indicated thereon the centre lot for
which a severance is requested. Mr. Roth continued to state
the following facts:
1. Mr. C. Fleischmann, Mr. Wm. Tonno and himself
were particularly interested in this application
since the severance of a centre lot would create
3 building lots. The centre lot would have an
area of 3.04 acres, the north lot an area of 2.20 acres
and the south lot 11.91 acres;
2. The Clarke Fishing and Conservation Club of which
they are members, abuts the subject land to the West
.and they would have ready access to the fishing
pond. This would be an ideal situation to have
a home and recreation nearby.
The Committee explained that they have no jurisd-i.ction to allow
severances of less than 40 acres in an Agricultural Zone.
Mr. Lycett stated that Mrs. S. Hamilton, the applicant, has an
application for an amendment to the zoning by-law for "Rural
Residential" before the Planning Board.
The Committee noted that Mr. H.R. Best, Secretary Planning Board
is away on vacation at the present time and upon his return
an enquiry will be made as to the status of the application
for an amendment.
The Committee indicated to Mr. Roth that they wished to be
satisfied on the following points:
1. Is there any intention at present of applying
for a rezoning of the area from agricultural to
rural residential:
2. If the proposed severance was granted, would there
be room on the property so created for a dwelling
to be located in such a way that would not offend
environmental requirements of the area;
3. Justification for a particular severance would have
to be made on the hearing of the application.
This application was adjourned for further consideration.

1 provisions of the Planning Act so as to permit the separation
of a parcel of land having an area of approximately 45 acres
from the applicant's land in an agricultural zone.
The Secretary -Treasurer reported that 14 notices of the
said hearing had been mailed in accordance with item 5 of the
Rules of Procedure.
Mr. Howard A. Quantrill, applicant, accompanied by his
son John Quantrill appeared in support of this application.
No other person appeared in support of, or in opposition to
this application.
The Secretary -Treasurer presented the following material
to the meeting:
1. A pencil sketch of the proposed severance;
Mr. Quantrill stated, under oath, that since submitting
this application, he had considered negotiation for abutting
land with the owner of those lands and if he were successful,
he might wish to change the boundary of the land being applied
for. He requested permission to let this matter stand,
under the circumstances, until such time that the final
arrangements could be made. The Committee granted this request
and this application is adjourned sine die to be brought on
at the instanceof the applicant or any subsequent hearing.
In the meantime the Committee will inspect the property.

Mr. Brown, under oath, stated that Solicitor D.J.
Atkinson, B.A. LL.B., resided in the City of Toronto and
was unable to attend this meeting, therefore, he had been

The Committee accepted the appointment of the agent by the

Mr. Brown then referred to the Plans of Surveys and
indicated the lots to be severed. These lots fronton
the Leskard Road which is the main travelled road in
the area. The subject lands have no value as part of
the farming operation of the applicant Jerome Marvin.

Mr. Gary Ford, under oath stated as follows.
1. He is a building contractor;
2. He purchased 11 building lots in the area
from Messrs. Charles and Everett Stapleton;
3. He has built 7 houses on 7 of these 11 lots;
4. The 4 most northerly lots have not been built on;;
Of the 7 houses constructed all have 25' sideyards
and are 25' in width, of these 7 houses, 4 have
basement garages and the other 3 houses have no
covered accommodation for motor vehicles;
He wishes to construct a house slightly wider than
25' on each of the 4 lots under discussion which
he maintains would be aesthetically more pleasing;
f'E In answer to a question regarding the 3 houses with no covered
accommodation for motor vehicles, Fir. Ford stated that in his
opinion detached garages could be built in the rear yards.

5. The 4 houses to be constructed are not uniform
and are of various shapes; the sideyards as
proposed vary from 19' to 201; the toography is
not suitable for basement garages; the road falls
back from the road;
6. Mr. Ford then presented to the Committee for their
perusal part of a Plan on which is outlined the 4
lots and the position of each house to be con-
structed;
Mr. Ford stated that he had discussed the plans for these
houses with the building inspector Mr. H.R. Best. Mr. Best
had suggested that the carport and garage abut each other on
the common boundary so as not to obstruct the view from each
house. Since these houses have not been built, as yet, Mr.
Ford is agreeable with this suggestion, if the Committee wish.
Applicati.ons adjourned to enable the Committee to inspect
the properties.

The Secretary -Treasurer reported that 23 notices of the said
hearing had been mailed in accordance with Item 5 of the Rules

Mr, Frank G. Stapleton, applicant, appeared in support of
this application. No other personappeared in support of,
or in opposition to this application,
Mr. Stapleton under oath, stated that his house is the
first located East of Burley's Garage on the crest of the
Hill on Highway #2;
This applic.=^tion is for permission to build an additional
room to enlarge the kitchen area as well as for the possibility
of a future bedroom. No bathroom facilities will be installed
in the addition. This addition will be added to the north of
the existing house, the present porch will be demolished to
allow for this. There is presently an existing single car
garage located near the west lot line, and in Line with the
rear of the house. If and when the proposed addition is
constructed, the existing garage will be located in the west
sideyard, therefore, a variance is required concerning the situation
of the,existing garage.
Mr. Stapleton indicated on a pencil sketch the location
of the proposed addition, the porch to be demolished and the
existing single car garage®

The Treasurer has asked me to express his pleasure to learn
from your letter of January 24, 1973 that the Committee of
Adjustment members have decided to withdraw their resignations
as previously reported in your letter of January 10, 1973.
The Committee's task is a difficult one and it is reassuring
to you, I am sure, thatthe new Council for the Township has
given you a unanimous vote of confidence.
I should say that I was somewhat puzzled by the reports in your
letter of January 10, 1973 since, under the provisions of the
Planning Act, an occasion where all committee members have to be
reappointed at the same time should not arise. I understand that
Miss Darrell of the Plans Administration Branch did discuss this
with you and you clarified that, while it is not necessary, the
Council follows an annual practice of 'endorsing' the Committee.
I understand that the members of your committee have been serv-
ing in this capacity for some time. Their experience should be
invaluable to the Township and I am pleased that they will continue
to serve in this capacity.
