HomeMy WebLinkAbout1864THE CORPORATION OF THE TOWN OF BOWMANVILLE BY -LAW NO. � 2 �"< A By -Law authorizing the carrying on of a community programme of recreation within the meaning of the regulations under the Department of Education Act. WHEREAS the carrying on of a properly organized programme of recreation is conductive to the well -being of a community and to the advantage of its inhabitants, collectively and individually, AND WHEREAS the provisions of adequate opportunities for recreation demands that constant thought and attention be given to the planning and maintenance of areas and facilities for recreation in addition to the promotion, organization and supervision of recrea- tional activities. AND WHEREAS the Council is authorized to carry on such a pro- gramme and to place the same in charge of a recreation committee, THEREFORE the Council of the Corporation of the Town of Bowmanville enacts as follows: 1. There is hereby authorized and established for the municipality a community programme of recreation which includes cultural, educational, physical and social activities, within the meaning of the regulations under the Department of Education Act and the same shall be carried on for the well -being of the community and for the use, benefit and advantage of the inhabitants. 2. The community programme of recreation shall be in charge of and be conducted by a recreation committee to be known as "The Bowmanville Recreation Committee" hereinafter referred to as the t1Committee." 3. The Committee shall be composed of not less than seven nor more than 12, two of whom shall be members of Council. The Committee shall be appointed annually by Council, and shall hold office for a term of two years or until their successors are appointed. (b) The two members of Council, shall remain in office until December 31st of the year of their appointment or until their successors are appointed; and all persons appointed to the said i - Page 2 - Committee after December 31st, 1963, Council appointees excepted, shall hold office for a term of two (2) years. `fir (c) The Council shall, as often as the office of a member of the Committee becomes vacant, shall appoint a successor thereto, who shall hold office for the remainder of the unexpired term of the said member. 4. It shall be the duty of the Committee and the Committee shall have power to conduct in the municipality the community programme of recreation, and without limiting the generality of the foregoing, the Department may: (a) Elect officers from among its members. (b) Incur expenditure to the extent provided in the estimates approved by Council and to enter into contracts in its own name for *%4"" the purpose of its business. (c) Recommend to the Municipal Council the appointment and discharge of a director and to fix his or her powers, duties and responsibilities. The Director to be an employee of the municipality participating in the privileges as designed in the terms of employment. (d) To appoint from time to time such other personnel as it may deem necessary to conduct and carry out the community programme of recreation and to fix and pay the salaries of said personnel. (e) Makes rules and regulations for the conduct of the community programme of recreation or any part therof and to govern vim,, the conduct of all person who in any way participate in or be in attendance at any part of the programme. (f) Prescribe fees for participating in or admittance to any part of the community programme of recreation. (g) Appoint as it deems necessary such committees to act in an advisory capacity to the Department. (h) Solicit or receive gifts or bequests of money or any donations to be applied in furtherance of the community programme of recreation hereby established. M %*W r - Page 3 - 5. Not withstanding anything to the contrary hereinbefore contained, all by -laws, rules and regulations of the Committee shall be subject to the approval of Council. 6. In carrying out the provisions of this By -Law, the Committee shall at all times be the agent of the Town of Bowmanville, and while acting bona fide within the limits of the authority of this by -lawj neither the Committee nor any members thereof shall incur any liability by reason of anything done or left undone by the Committee, provided however, that nothing in this pararaph con- tained shall authorize or empower the Committee to incur any debit, liability or obligation for which the Town of Bowmanville shall become liable without p zVviously obtaining the consent of the 'Ceuncil, .7.
