(416)263-2231 REPORT TO COUNCIL October 9, 1979 SUBJECT: Proposed Official Plan - Amendment 25 BACKGROUND: Amendment 25 to the Regional Official Plan was discussed by the Planning and Development Committee as a matter of other business at the meeting held on Friday October 5, 1979. Staff were directed to prepare a Report for consideration by Town Council at the meeting of October 9, 1979 outlining the actions taken on Amendment 25 with a recommendation for possible future Council action. COMMENT: The attached correspondence including Amendment 25 to the Regional Official Plan was received by the Town on Thursday, September 6, 1979• By letter dated Tuesday, September 11, 1979, copy attached, additional information and time were requested in order to review the proposed amendment. On September 13, 1979, Town staff in conversation with Regional Planning Staff reiterated their concerns about Amendment 25. Town i - 2 - staff noted that the Amendment affected "Small Urban Areas" as defined in the Regional Official Plan and that the only Small Urban Area de- fined in Newcastle is the former Village. Staff noted that the designation of commercial areas in the former village would be considered through the preparation of a "District Plan" and that Amendment 25 was not of major consequence to the development of the former village. Staff share the concerns of Committee members in respect of the pro- cessing of Official Plan Amendments. Staff note that there are comprehensive procedures for the processing of Official Plan Amend- ment applications submitted by the public at large. These procedures do not apply to amendments initiated by the Region itself. On this basis, staff recommend to Council that the Region be requested to pre- pare procedures for the processing of Official Plan Amendments initiated by the Region and that these procedures be circulated to all local Munici- palities for comment prior to adoption by Regional Council. RECOMMENDATION• That the Town of Newcastle request the Region of Durham to prepare procedures for the processing of Official Plan Amendments initiated by the Region and that these procedures be circulated to all Local Munici- palities for comment prior to adoption by Regional Council. McIlroy, Town Clerk, with your request for comments by September 11, 1979. In forwarding this item to the Clerk, I assume you wish to obtain a resolution from Newcastle Town Council on the appropriate— ness of the amendment. As the amendment was received on September 6, 1979, it will not be possible to forward a Council position to you for some time. In order to adequately review the proposed amendment, could you please provide additional information as to the background to this amendment. The actual amendment makes reference to "limited" retail and personal service uses and requirements for "retail analysis". I question whether retail analysis are necessary for individual uses. What is contemplated by limited? I request that you provide us with additional information on the proposed amendment and additional time to_1orward our comments. DNS: lb c.c. J. Ul11tlIAM k1;C�1'UDIAL 1A1, PLAN PURPOSE: The purpose of this Amendment No,J25,t-o the Durham Regional Official Plan is to allow for limited retail and personal service uses to locate outside of the Main Central Areas of the Small Urban Areas subject to certain considerations. BASIS: The intention of the Plan is to consolidate all retail and personal service uses in the Main Central Areas of the Small Urban Areas, However, under certain circumstances, it may be desirable after appropriate study that certain retail uses may be permitted outside these Main Central Areas. WW".111 AMENDMENT: The Durham Regional Official Plan is hereby amended by a ding the following policy to Section 9 - Small Urban Areas: r "9.2.4 Notwithstanding the intention of this Plan to maintain and develop the character and function of the Main Central Areas as designated on Map 'A' as focal points within the Small Urban . Areas and notwithstanding any other provision in this Plan to the contrary, limited retail and personal service uses may be allowed in the Small Urban Areas as an exception, outside of the Main Central Areas, provided that: a) such uses are compatible with their surroundings; and b) a retail analysis has been undertaken which demonstrates that: (i) such proposed uses shall not cause any undue economic decline in the existing retail and personal service uses of: the Main Central Area; (ii ) se -ch proposed uses will not: be of a'si.ze as to preclude; the development of the Main Central Area in accordance with the provisions of this Plan„ INTERPRETATION: The provisions set forth in the Durham Regional Official Plan, as amended, regarding the interpretation of the Plan shall apply in regar_(i to this Amendment. i, ff I I i i I N
