HomeMy WebLinkAbout75-183Report No. 1$3 REPORT ON PROPSOED REDESIGN:ITION OF PJ? 940INV ILE R0.1D > - This,report arises from the application of Mr. Carcone for an amendment to the Darlington Zoning By-law to redesignate the portion of Prestonvale Road in front of his lot as an improved road. On June 5, 1975, the following recommendation was reviewed by the Public Works Committee and referred to the Planning Ldvisory Committee. "Until such time, that the necessary lands are ac- quired to make the entire southerly portion a 66 foot right-of-way, it will remain unchanged. I feel that if the status of this road is -to be changed, then the necessary land must be acquired across the entire section and not one lot at a time as has been sug- gested.". The attached letter from D.G. Biddle, engineer for Mr. Carcone was referred to the Committee by Council In order to deal with this request, we made reference to Cou- ncil's approved policy for the designation of an improved road and obtained maps from the .Assessment Office to ascertain the app- roximate width of the road allowance. The Criteria for designation of an Improved Road are restated below. Criteria for Designation of an Imoroved Road le Title to Road Allowance- Clear and undisputed title must be vested in the Province of Ontario, the Region of Durham, Town of Newcastle, or the Town of Newcastle and an adjacent munic- ipality in the case of a boundary road. 2. Maintenances The road must be actually maintained and kept open on a year round basis by the road authority having jurisdiction. 3. Standards: The road must meet or exceed the following minimum standards for the average annual daily traffic being carried according to the latest Road Needs Study. MINIMUM 0-50 A, 11. D. T. Road 4�llgwance; The road allaance must have a minimum width of 66 feet except where the section of road is already built up on more than * its frontage cr is already carrying an ann. ual average daily traffic of more than 200 vehicles in which case the road must still meet all the above criteria. 5. actual Condition: The road must be generally passable to normal vehicular traffic at all times of the year. Prestonvale Road appears to comply with criteria 1 and 2 above that the Town has only a right of occupancy on the portion which is forced road. The road has a surface width of 18 feet, a shoulder width of 3 feet$ a total platform width of 24 feet., and a surface of low cost bituminous construction. The road was considered a semi -urban section in the road needs study and was therefore not assigned a safe speed. Thus Prestonvale Road appears to meet criteria 3 as well. The road meets criteria 4 and 5 as well since the annual average traffic volume is presently 423 vehicles. The road needs study shows Prestonvale road to be deficient now, although not below the minimum tolerable standard and recommends early reconstruction to an urban standard. The mapping supplied by the assessment Office, which is not an accurate survey, indicates that the present road right of way varies from approximately 56 feet to 58 feet. Our topographic mapping indicated that, within the portion of the road which is presently zoned residential, infilling could permit a max- imum of approximately 20 additional dwellings including 5 which abutthe portion of the road already designated as an improved road. There are presently 55 dwellings having access to Prestonvale Road including those abutting Phair Avenue. We note that under the provisions of the new Section 35(a) of the Planning Act it will be possible in the new zoning by-law to obtain road widenings where required as a condition for the issuance of future building permits. In conclusion, we recommend that - (a) Prestonvale Road should be designated as an improved road in the new zoning by-law. (b) The Town Solicitor register a quit claim deed for that portion of the road which is a forced road to guarantee the Town's title to it. (c) That road widenings to 33 feet from the existing centre- line be obtained as a condition of any future building permits which may be issued prior to reconstruction. Respectfully submitted, pr.
