HomeMy WebLinkAbout75-161Report No. 161 INFORMATION REPORT ON APPLICATION for REZONING KING STREET. HAMPTON: - The applicant wishes to build a home on King Street in Hampton. The subject section of King Street was not classified as an improved road in the Darlington Zoning By-law because it was of insufficient width. The Darlington Zoning By-law states that "no person shall erect any building or structure in any zone unless the lot upon which such building or structure is to be erected, fronts upon an improved public street which has been opened and which has a width of 66 feet or more". bor this reason, the applicant applied for an amendment to the Zoning By-law to change the status of King Street to an improved road. On February 39 1975, the following recommendation was adopted by Councils "(i) That Mr. Jansma be requested to convey to this Munici- pality sufficient land to permit the widening to a minimum width of 66', that portion of King Street, Hampton, front- ing onto his property in Lot 18, Concession 5, and further that Mr. Jansma be permitted to place onto his property as land fill any surplus excavated material originating from future construction on the subject portion of King Street, provided that the fill so placed on his lot is in accord- ance with the regulations prescribed by the appropriate Conservation Authority. (ii) That at such time as the conveyance of the lands nec- essary for the proposed road widening of that portion of King Street fronting the property now owned by Mr. Jansma is com- pleted, the following recommendations be submitted to Coun- cils 1) The land conveyed by Mr. Jansma to the Mun- icipality be designated for the purpose of a public road. 2) The widened portion of King Street be clas- sified as an improved road within the mean- ing of By-law 2111 and amendments thereto." 2 - Since that time, the applicant has conveyed the required land. to the Town and By-law 75-44, which designates the widened portion of King Street as an improved road, has been passed by Council. It is therefore,recommended that the Map 13 of the Darlington Zoning By-law be amended to show the subject segment of King Street as an "Improved Road". Respectfully submitted, rGe�orge F.
