HomeMy WebLinkAbout75-118REPORT NO.118 ZONING APPLICATION FOR'J.C. TAMBLYN 1. History of the Application: On May 279 19749 Mr. J.C. Tamblyn submitted an application for rezoning for his lot, located on the northwest corner of Durham Road 4 and the road between lots 26 and 279 Clarke. He owned an existing vacant building which was of an industrial or commercial type but which could riot be used because it was zoned agricultural. On September 239 a report was approved by the P.A.C. which contained the following paragraphs. I feel that the use of this property for industrial purposes would be acceptable9 given that it contains an existing industrial build- ing, provided that the following conditions were maintained: (a) The coverage permitted was restricted to the existing building area plus a minor extension (say 20%). (b) Access were restricted to one entrance at the far south west corner of the lot. (c) Industrial uses were restricted to those which produced no industrial wastes or pollution and used water only for normal "domestic" purposes. (d) No open storage were permitted. (e) Uses were restricted to those which would not be likely to generate high traffic volumes entering and leaving the premises. (f) Any additions to or replacements of the existing building met all the usual setbacks and other requirements of the zoning by-law. Page #2,..,,.. In conclusion, I would recommend that Municipal Planning Consultants be authorized to draw up an amending by-law and site plan agreement to permit the use of the applicant's land for industrial purposes under the above conditions with the cost of this work to be charged to the applicant. These documents should be circulated to the Regional Works Department and the Health Unit when they are completed. Municipal Planning Consultants started work on these documents but before they were completed, a Mr. Neil Dekoker advised us verb- ally that he had purchased the property and wished to establish a meat cutting business therein. We informed him that this use did not conform with the present by-law nor with the amendment as it had been approved in principle by the P.A.C. He was advised that his porposal would require a new application. Mr. Dekoker expressed a desire to speak to the P.A.C. directly on this matter and he was listed as a delegation to appear at the following meeting. However, he did not appear and has not contacted us since that time. On April 39 19759 we wrote to Mr. Tamblyn advising him that we were informed that he had sold the property and unless we heard to the contrary, we would consider the applica- tion abandoned and close the file on it.
