In response to Resolution # LB -126-77 regarding
the above subject, this area, relating to concernm of back -
lot drainage, Inas inspected during the Road Inspection 'four.
on April 28th, 1977, and :lager discussed by the Public 'Works
Committee at the May 12, 1977, Meeting.
After a ge..neiraal discussion by Members of the
Public. Works Committee, laasol.ution N W--1.36--77 referred the
subject to the Legislation & By -Laws Committee.
The bacVlot draim;tge problem has apparently
existed since prior to 1974 and causes concern annually. I
have discussed the matter with Mr. Howard Right, (thief Build-
ing Inspector, and he has obtained a copy of a subdivision
agreement dated November 22„ 1963, between the Town of :Bow•-
manvil..le and. Hendry Investments. Ibis agreement pertained to
the area which is now of concern.
I attach hereto copy of an excerpt from the
agreement, namely Item 1.1, relat:i.ng, to existing and !final
grades and contours. 'E't:om my observations on April 23, 1977,
it would appear that this ;Its a Civil matter and not totally
a Municipal. concern.
