HomeMy WebLinkAboutEngineering Memo 79-76MEMORANDUM #79 TO: Bruce Tink, Chairman of the Public Works Committee FROM: John Ferguson, C.E.T., Engineering Department TOPIC: Subdivisions - Time Limits DATE: October 28, 1976 The Town of Bowmanville entered into many subdivision agreements between the Town and the developers in 1972 and 1973. Under the terms of all of the agreements, a time limit was stipulated for work to be completed. In many of these agreements, the work has been completed and the subdivisions have fulfilled the terms of their own contracts. In other agreements, these terms have not been complied with, and under the terms of the subdivision agreement, this constitutes a breach of contract. There are many reasons why the work has not been completed but all of the developers have full intentions of completing the required work. Therefore, I would recommend that extensions be given to several of the agreements as detailed on the attached chart. The subdivisions which require extensions to the time limit are as follows: Lamers Bros., 696 18 months Waverley Gardens, Phase II, 702 18 months Bowmanville Heights, Phase II, 705 36 months Bowmanville Heights, Phase I11, 707 36 months Cean Investments, 708 36 months
