TOPIC: Bowmanville Heights Subdivision

Attached is a letter from Mr. Ian Butler, a consulting engineer
from Proctor & Redfern, who are our representatives concerning
the matter of oversizing in the above-mentioned subdivision.
The reason for this arrangement was to clarify where the Town
and the developer stood in relation to the paying of lot levies
and the cost of the oversizing of services in the Waverley
Gardens area.
The major holdback is the storm sewer outfall located on the
Swartz farm east of Spry Avenue. Since the outlet has not been
constructed, it makes it very difficult to finalize the cost
sharing proposal.
Therefore, if adopted, the developer would continue to pay lot
levies until the sum of $35,928.68 is paid. At that time, the
Town would not collect any more lot levies. until all final
costs had been calculated as the lot levies would equal the
cost sharing as according to the Subdivision Agreement. The
developer is willing to enter into a supplementary agreement.in
regards to his share of the payment for the outfall.
As discussed in Mr. Butler's letter, if the expropriation of
the Swartz's properties is not approved then the storm water
will be diverted south to the Baseline Road and then to the
Bowmanville Creek. This construction will increase the cost
of the outfall from approximately $50,000.00 to approximately
$250,000.00.
At the present time, the developer's share is only $19,792.32
but the developer is willing to enter into this agreement with
the Town plus post a letter of credit in the amount of $150,000.00.
Ac according to Mr. Butler's letter, the Town should make payment
to the developer in the amount of $19,792.32. I would suggest
that this amount could be deducted from the total lot levies
owing, being $35,928.68.

Therefore, the Town could collect a total of $16,136.36 in
lot levies as building permits are issued and then later
when the final costs are obtained, these monies would be
returned to the Town in a lump sum for final payment.
Therefore, I would appreciate your comments on this
proposal.
