SUBJECT: BY-LAW 76-52 AMENDING BY-LAW 2111
DATE: SEPTEMBER 28, 1976
The above subject was referred by Council to the Works
Committee after receiving its first reading. At the September
9th, 1976, Works Committee meeting, it was tabled pending it
further report. To my knowledge, the Planning Department
recommended this amendment to Council.
I have some concern in the terminology of the proposed
amendment, whereby, it states, Class "A" Public Street.
In relating to the Highway Traffic Act, section 71, subsection
(f) states, Class "A" Highway means a highway designated as
such by the Minister. Again, section 71, subsection (g) states,
Class "B" Highway means a highway not designated by the
Minister as a Class "A" Highway. Therefore, I would recommend
prior to Council passing any by-law using this terminology
that it be checked by our solicitor.
The subject road is an'orginal allowance for a road between
Lots 16 & 17, Concession 1, ,former Darlington. This road
south of No. 2 Highway has always been maintained for a
distance of approximately 1600 feet. In 1971, the subject road
was improved somewhat but not reconstructed. No doubt, there
are numerous roads throughout the Town of Newcastle where
re-classification should be considered. However, I would
recommend that roads of this status be all considered during
the preparation of the new zoning by-law, and be in ep-ordination
with proposed development etc.
Attached,is a copy of the proposed by-law amendment and the
schedule which consists of a map showing the geographic
location.
