SUBJECT: Reconstruction of Maple Street, Haydon
DATE: August 30, 1976
The Public Works Committee on June 10th, 1976, gave
authorization to prepare the necessary agreement with
the aid of legal council. In the absence of a solicitor
some time did elapse, however, since the appointment of
a solicitor we have now prepared the necessary agreement.
Also, during that time I did submit a design criteria to
the Ministry for approval. The proposed design criteria
did conform to our needs study under the heading of roads
_built by others, and not similar to subdivision roads.
On August 13th, 1976, the Ministry returned the design
criteria not approved, stating it does not meet the
standards for subdivision roads.
On August 18th, 1976, I met with Mr. Dawson to discuss
the mentioned proposal, at which time l pointed out our
position as per By-law 2111 being that approximately `
569 feet of Maple Street is supposedly improved and
further, that the property owner would construct that
portion which is unimproved as stated in the design
criteria. Mr. Dawson stated that his concern was this
road called Maple Street is not an original allowance
for the road, therefore, it must be given or forced
which he, claims supports the action taken in not
approving the design criteria. His further comment
was that all or any portion of Maple Street should be
constructed by a developer. I pointed out to Mr. Dawson
that to my knowledge Maple Street was laid out in a -plan
of subdivision years ago, but was never developed, therefore,
there was never any need for the construction of Maple Street
beyond the existing limits.
In view of the above, I have not submitted the agreement to
anyone for consideration. A copy of the agreement is
attached and as directed by resolution #W-147-76, item #5
in the said agreement is a commitment to the Municipality,
which must be resolved prior to submitting the agreement
to anyone.
An estimated cost to construct that portion of Maple Street
being approximately 569 feet in length is $8,000.00..
