Dunham, Director of Public Works SUBJECT: Bike Riding on Sidewalks DATE: August 27, 1976 The above subject was tabled at the last Public Works Committee meeting for further information. Since that time we have obtained a copy of an existing by-law from - the City of Oshawa, a copy of which is attached. The City's By-law is self-explanatory and includes all sidewalks or foot paths, boulevards, parks, park lots, etc. Also, I note in this By-law it includes licensing of bicycles. I have discussed this matter with Durham Regional Police who would recommend such a by-law be considered for the Town of Newcastle. They, however, did not feel the need to license bicycles, providing such a by-law stated other than 20 -inch wheels and under be exempt --these apparently are classed as sidewalk bikes. In conclusion, if the Municipality is to consider such a by-law, I would recommend that it be intended for the Town of Newcastle in total. Also, I note this proposed by-law could be consolidated into the existing traffic by-law. WHEREAS The Corporation of the City of Oshawa desires to change the type of licenses issued for bicycles and the, procedure for issuing such licenses. v AND WHEREAS notwithstanding the change of the type of license to be used, it is desirable that all licenses valid on the day of passing of this by-law issued under a predecessor of this by-law shall be deemed to be valid and subsisting as if issued under this by-law. NOW THEREFORE, BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The Corporation of the City of Oshawa by the Council thereof as follows: 1. No resident in the City of Oshawa owning or using a bicycle shall use the same,upon any highway in the City unless and until he shall have first registered the same, and attached a license issued under this by-law to the bicycle, provided however that any license valid upon the day of passing of this by-law shall be deemed .to have been issued under this by-law. 2. Every application for registration shall be made on the forms provided by an authorized issuer, 3. After registration, the licesee will receive a license on which will be legibly printed the municipal registered number of the bicycle and which license will adhere to the frame of the bicycle. -2- 4.. The license must be securely attached to the bicycle. 5. Nothing in this by-law shall render invalid any license under a previous by-law which was valid on the date of passing of this by-law, and except as hereinafter set out such license shall remain in effect as if issued pursuant to the provisions of this by-law. 6.. The fee for such registration shall be One Dollar ($1.00' payable to an authorized issuer. 7. Registration shall remain in force as long as the bicycle remains the property of the licensee, 8. Upon sale or transfer of a bicycle licensed under this by-law, the new owner must make application to register the bicycle in his name, paying therefor a fee of FIFTY CENTS ($0.50). 9. When any valid registration plate issued under any previous by-law becomes damaged, the licensee must apply to the Police Department of the City of Oshawa for a license under this by-law which shall be issued upon payment of FIFTY CENTS ($0.50) and the surrender of the damaged plate. 10. When the licensee changes his address in the City of Oshawa he shall so notify the Police Department of the City of Oshawa in writing indicating the license number. 11. The City shall supply the Police Department with all necessary forms and licenses and the Chief of Police shall remit to the City Clerk from time to time all license fees collected. The Chief of Police may appoint persons as authorized issuers and shall supervise all authorized issuers and collect the license fees from authorized issuers and keep a record of all licenses issued. Authorized issuers may be paid a fee for their services to be declared by the Council from time to time by resolution. 11 4 -3- 12. This by-law shall be administered and enforced by the Police Department of the City of Oshawa. 13. Every person so licensed shall produce his license whenever it may be.demanded by the Chief of Police, by any.Justice of the Peace of any Police Officer. 14. No person shall: - (a) Deface or alter any number plate or license fur- nished by the City; (b) Use or permit the use of a defaced or altered number plate or license; (c) Without the authority of the owner remove a number plate or license from a bicycle; (d) Use or permit the use of any plate or license upon a bicycle except the one issued by the City for such bicycle; (e) Fail, within six (6) days, to forward a notice on the prescribed form to the City of the sale or purchase by or to him of a bicycle for which a license has been issued. 15. No person shall ride a bicycle or other vehicle along or i upon any sidewalk, pathway or foot path, used or set apart for the use of pedestrians and forming part of any highway or bridge, boulevard, park, park lot, garden or other place set apart for ornament or embel- lishment or for public recreation, within the limits of the City of Oshawa. 16. No person shall ride a bicycle on any pier or wharf within the City of Oshawa. - 4- 17. No person shall upon any public highway within the City of"Oshawa while riding a bicycle designed to carry one person only, carry another person on such bicycle, or carry anything thereon in such a position or manner as to prevent or interfere with full control of such bicycle. 18. No person.shall leave a bicycle lying on any public sidewalk, or park or place the same against any window, or in front of or across any door, stairs or entranceway to any building so as to obstruct or interfere with ingress to and from such building. 19. By-law Number 182=67 shall be and it .is hereby repealed. 20. Every person convicted of -a breach of any of the provisions of this by-law shall be guilty.of an offence and shall pay a penalty of not less than -Five Dollars ($5.00) exlusive of costs, for each offence.
