Best, Secretary SUBJECT: Mr. C. ,laUe and request for road closing between lots 8 and 9, Concession 69 Clarice. DATE: February 1£, 1976. We refer to Resolution No. 14-26-76 in the minutes of the Januar,, 23, 1976 meeting wherein the Committee stated that they have no objection to proceeding with closing the subject road and conveying same to abutting landowners provided that the Region approve of same. We are attaching hereto a co7T of our letter to Mr. MoIllullen, Regional llor::s Department, together with a cony of Mr. Miullen's reply. In commenting on this situation it would appear that a problem eF.ists regarding Mr. W. E. Reid's property in lot 9, Concession 6, comprising some 20 acres of pasture land, which land would be denied access onto a road allowance if the subject road were to be stopped up and closed. I+4r. M. D. Brown, O.L.S. has suggested the following solution, Quote "As the closing of this road allowance might deprive 11r. Reid of access or frontage on an improved road, it is suggested that Tor. Reid agree with Mr. Wage to release his claim for Part 9 in return for conveyance from 1,1r. Ways for Part 7 and Part 14. As Part 14 is Part of Mr. Ways's property, as application to the Land Division Committee would be necessary to effect this exchange". _ With reference to Mr. Broem's suggestion, it is our opinion that f mr. Ways were to apply to the Land Division Committee for consent to sever Part V! from his property, he would be required to ')resent document=y evidence to the Committee that the Municipality intend to proceed with closing the subject road provided Mr. )lays 's alpiication for severance ro.*ere a;�nrovad by the Land Division Committee. 2 - In this respect it would seem reasonable for the Land Division Committee, if they approved of the severance, to impose a condition that the severance be granted only if the I�Tunici-nality were to stop up and close the said road. In conclusion, we would recommend as follows - 1) If the Public Works Committee approve of the Region's request for a revision of the east boundary of Part I, that Mr. M. D. Broim, O.L.S. be requested to revise the -elan of survey in accordance with the Region's request. 2) That this. Committee recommend that Council proceed to stop up and close the subject road allovazzce provided that Part 1!; can be severed from Mr- Wye's property and conveyed to Mr. Reid, thereby providing Mr. Reid with frontage and access onto Region Road No.18. Best Secretary, Public Works Committee Dear Sir: RECEIVED FEB 17 1976 TOWN OF NEWCASTLE Re; Proposed Closing of Road Allowance between Lots 8 & 9, Concession 6 in the former Township of Clarke Further to your request of February 2, 1976, we have reviewed the proposed road closing. There is one minor access problem relating to landowner Mr. W.E. Reid. Part 14 on the plan is not a good location for access to Regional Road 18. A steep upward 3rade to the south creates a sight restriction, however, since the owner, Mr. Reid, has established use of driveway in this area now, and assuming we cannot deny that landowner access to an improved road we would approve of the proposed closure. The only condition the Region would request, with respect to the proposed road closure,is a small road widening at the north limit on the east side of Lot 1. I have enclosed a drawing which outlines the lands in question. Res Proposed closinc of road allowance between Lots 3 and 9, Concession 69 in the former Township of Clarke Further to our conversation of even date pertaining to the above reference, we are pleased to enclose herewith a copy of a plan of survey, prepared and certified on October 8, 1974. by M. D. Bswwn, O.L.S., together with a letter of transmittal from Mr. Brown. We are also enclosing a copy of a recommendation from the Public Works Committee to the Council. We would greatly appreciate receiving your general comments relative to the proposed Closing of the subject road prior to our proceeding any further in this matter.
