Best, Secretary S=ECT: Renaming of Lycett Street, Bowmanville DATE: February 18, 1976• We refer to resolution No. W-500-75 as recorded in the minutes of the meeting on December 18, 1975 and relating to the erosion on Simpson Avenue at Soper Ores%. Said resolution as follows - 'That the Director of Public Works and the Chairman of the Works Committee proceed with the acquisition of the 11m. Lyeett lands in part of lot 10, Concession 1, Bowmanville, in accordance with the terms as set out in W. K. Lyeett's (Solicitor for Wm. Lycett) letter of November 26, 1975'. We note the following condition as set forth in the afore- mentioned letter - 'It is to be understood as well that the Street now named Lycett Street in the Town of Bowmanville will be renamed and that such Street or any pert or parts thereof will no longer be known or designated as Lycett Street'. Pursuant to the foregoing we have prepared the draft of a by-law to rename Lycett Street (copy* attached). We also note the excerpt, as folkows, from Section 354, 8.0•(97) of the Dhmicipal Act. 'A by-law for changing the name of a highway in a city or town shall state the reason for the change, and shall not be finally passed until it has been approved by a judge of the County or District Court of the County or District in which the municipality is situate'. In the preparation of this by-law, ore have endeavoured to state the reasons for renaming Lycett Street. s - 2 - The name "Mutton Court" was suggested by Mr. and ries. Harold Mutton, the only persons with the address of hycett Street (No.. 1 hycett Street). We concur with their suggestion as we understand the Mutton family have been residents in Boomianville for several generations. The Region must approve of the Street name and to this end we have obtained their oral approval of the name "Mutton Court". This approval was given by Mr. Matt Mazuryk of the Current Operations Branch of the Regional Planning and Development leepaxtment. We would also suggest that written approval of the change in name from Lycett Street to Mutton Court, be obtained from Mr. and Mrs. Harold Mutton prior to submitting the by-law to the County Court judge for his approval. We request the Committee's approval in princinle of the draft as written or as revised by the Committee. Due to the fact the by-law must be approved by a judge, we feel it necessary that the bi,*-law be written in proper legal terms and would therefore recommend that prior to presenting same to Council, the draft or revised draft be submitted to the Town's Solicitor for further refinement. Respectfully submitted, ad Qg T014N OF NEWCASTLE BY-LAW NO. 76- A By-law to re -name Iyoett'Street, Bowmanville. 14hereas By-law No. 1877, passed by the Council of the former Town of Bowmanville on the 28th dey of Hay, 1963, described certain lands as a public street to be known as Lycett Street and Whereas By-law No. 75-37, passed by the Council of The Town of Newcastle on the 5th day of May, 1975, stopped up and closed part of the public street 'mown as Lycett Street and Whereas that part of Lycett Street from Simpson Avenue to Baseline Road has been erroneously but commonly ?mourn as Simpson Avenue for some consider- able time and it is felt that the changing of the name to Simpson Avenue will avoid confusion of said portion of Lycett Street. Whereas W. K. Lycett, Solicitor for William L. Lyoett, the grantor of the lands described as Lycett Street in By-law No. 18779 has by letter dated November 26, 1975, requested that the Street now named Lycett Street, in the Town of Bowmanville, be re -named so that such Street or any part or parts thereof will no longer be known or designated as Lycett Street and Whereas the remaining or north portion of Lycett Street has been plrjoically separated from the portion commonly !mown as Simpson Avenue by reason of the closing up of a part of Lycett Street and it is deemed desirable to re -name said remaining portion. as Mutton Court, thereby granting 111r. Iycett's request. - 2 - Whereas the Council of The Town of Newcastle now deem it advisable to re -nacre those parts of Iycett Street not stopped up by By-law No. 75-37. NO'i+i THERIM'ORR The Council of The Corporation of The Town of Newcastle pursuant to The Municipal Act,R.S.O. 1970, Chapter 282:9 Section 354 (1)(97), Hereby Enacts as follows 1) That lycett Street as shown on Registered Plan No. 6529 be re -named Mutton Court. 2) That part of Lycett Street extending southerly from the south limits of that part of Iycett Street closed by By-law No. 75-37, to the north limits of the Baseline Road, be re -named Simpson Avenue.
