SUBJECT: Revised By-law for Bowmanville Cemetery=
DAM: February 17, 1976.
Further to our memo of September 24, 1975, the subject
by-law has been reviewed by Mr. McNeely and while the
basic intent and purpose of the by-law have been retained
certain revisions were suggested by Mr. McNeely and ;have
been incorporated into the By-law.
With reference to the George Shaw Co., M=. McNeely advises
that this Company is still an active Company in satisfactory
financial standing and continuing to hold annual meetings
the last being held in ?March, 1975.
With respect to Section 62 of the Cemeteries Act and the fact that
the George Shaw Company still exists and can be found, This
in fact means that the owner (The Corporation) is not required
to maintain the mausoleum.
In considering Mayor Ricicerd's concern over injury sustained
to persons or property directly relating to the Mausoleum,
we have a situation wher4ya. company owns a building situate
on P4uniciTal pro-erty without the benefit of a lease. if
there is any doubt on the -)art of the Insurance CompaAy in
deterainin- liability, ezw such claim for damages might well
be the subject of a judicial decision.
The major revisions are sunmarized as follows-
?) All reference to the mausoleum has been deleted from
the By -lata.
2) All excerrts, including penalties, euoted from the Regulations
made under the Cemeteries Act have been deleted. This means
that no genaities are provided under the revised Cemetery
By-law of The Town of yewcastle. However, the aenalties
imposed under The Cemeteries Act will remain in force and
in effect.
We would recommend that an copy of the Cemeteries Act and
the Regulations made thereunder, be provided to administrative
personnel (i.e. Director, Superintendent, Secretaxy-Treasurer
etc.)
