SUBJECT: Sidewalk for Burk Court in the Town of Bowmanville
On July 3, 1973, the Council of the former
Town of Bowmanville passed a resolution
(#C-441-73) in regards to the sidewalk on the
east side of Burk Court to the north limit of
a Mr. P. Crapper's lot going into the subdivi-
sion. The Resolution was as follows:
"That the letter dated July 3rd, 1973, from
Mr. P. Crapper regarding the sidewalk on
the east side of the new road going into
the subdivision north of his home, be rec-
eived and that the Subdivider be req,urested
not to construct the sidewalk on the east
side of the road and that the estimated
cost of said sidewalk be deposited with the
Town to be used for other purposes in the
subdivision."
The major reasons why Mr. Crapper wanted
this section of sidewalk removed was because
it would eliminate most of his privacy plus he
was worried about the loss of several trees
along Burk Court and Concession Street.
on March 199 1976, the Town Council of Newc-
astle received a letter from a Mr. D. Barber in
regards to the property on the west side of Burk
Court owned by Cr. A. Sylvester.
His reasons for not wanting the sidewalks on
the west side of Burk Court are similar to that
of Mr. Crapper's as he wants to retain his prig-
vary, retaining or cutting of certain trees, and
he does not want to be responsible for the re-
moval of snow on this section of sidewalk.

As stated in Mr. barber's letter, several
school children use a walkway located at the
north east side of the development to set to
Central School. This route is far shorter than
by going south on Liberty Street and west on
Concession Street. Therefore many childrenuse
this route.
The road allowance going into this subdivi-
sion is only602 feet instead of there alar

66 feet. This means that the proposed side-
walk will be approximately 1 foot from the ex-
isting property lines. Since this sidewalk is
very close to these lines a definite loss in
privacy will occur to the existing hourse.
If the sidewalk were to be located on the
west side, several very large spruce trees
could be very Y g easily damaged. The west side of
Burk Court also is much higher than on the east
side plus with this difference in height several
huge limbs would be required to be cut from these
trees. Also., north of the spruce trees, there is
a mass of scrub trees which if cut would make the
privacy on the west side very poor.
Also, as according to Resolution #C-44.1-73 the,
Town was to receive payment for the deletion of
the sidewalk on the east side of Burk Court. To
date these monies have not been collected.
Therefore, I would recommend that the side-
walk be installed on the east side of Burk Court
at a location of 8 feet from the property line
and that the Town receive the monies for the,
sidewalk which would be -deleted on the west side
of Burk Court.
OR
that the sidewalk be constructed on both sides of
the road butting against the back of curb as acc-
ording to the subdivision agreement.
