670FCT: Proposed Parkin„ Fey -law for the Town of Newcastle
We have presently completed our proposed park-
ing by-law for the Town of Newcastle and are now
forwarding to the Committee for their review.
The major changes in the by-law as compared to the
three major areas of the Town of Newcastle are as
follows:
(1) We are recommending that Division Street
in Bowmanville be a one-way street. This
would be from queen Street to Church
Street. The directions woulc be as foll-
ows: Queen Street to King Street
(south bound only)
King Street to Church Street
(north pound only)
Included in our proposed by-laws are the
"Turns" wench are prohibited etc.
(2) We are recomvending that King Etroet in the
Village of Newcastle be parallel parking
only with no meters. This would cover the
area between Baldwin Street and beaver
Street on both sides of the road. The main
street in tae Village of Newcastle, Mill
Street; and the Village of Orono, slain
Street will be covered under the new Reg-
ional By-laws.
The by-law has beer set up in such a manner and in
accordance with the net,: proposed Eegional By-law
so t;at amendments will he ver; simple to make to
the new by-law. The proposed by-law also includes
many Schedules which may not be required at this
time but may be needed sometime in the future.
Therefore, we strongly recommend that you study
this by-law and make any comments.
THE CORPORATION OF TIT, TOWN OF NEWCASTLE
By-law No.
Being a by-law to provide for the regulating of park-
ing and stopping on highways or parts of highways
under the, jurisdiction of the Corporation of the Town
of Newcastle,
WHEREAS it is deemed expedient to regulate parking and stopping
of vehicles on highways under the jurisdiction of the Corporation of
the Town of Newcastle;
NOW THEREFORE, BE IT ENACTED AND IT IS HF:RFBY ENACTED, as a By-
law of the Corporation of the Town of Newcastle through its Council
ENACTS as follows:
SECTION I
I) 1. For the purpose of this by-law:
a) "Aut�lized Sign" means any sign or other device placed
or erected on a highway under the authority of this
By-law for the purpose of regulating, warning or guid-
ing traffic;
b) "Boulevard" means any part of the highway where grass
is grown or which is not intended for the use of vehi-
cles between the curb or outside edge of the shoulder
and the street line, exclusive of the area covered
by a sidewalk or foot path;
c) "Crosswalk" means,
i) that part of a highway at an intersection that
is included within the connections of the lat-
eral lines of the sidewalks on opposite sides
of the highway measured from the curbs, or, in
the absence of curbs, from the edges of the
roadway, or
ii) any portion of a roadway at an intersection or
elsewhere distinctly indicated for pedestrian
crossing by signs or by lines or other markings
on the surface;
d) "Hi " includes a common and public highway, street,
avenue, parkway, driveway, square, place, bridge, via-
duct or trestle, designed and intended for, or used by,
tine general public for the passage of vehicles;
I) 1. e) "Intersection" means the area embraced within the pro-
longation or connection of the lateral curb lines, org
if none, then of the lateral boundary lines of two or
more highways that join one another at an angle,
whether or not one highway crosses the other;
f) "Motor Assisted Bicycle" means a bicycle with an atta-
ched motor which is driven by electricity or which has
a piston displacement of not more than fifty cubic cen-
timetres and which does not have sufficient power to
enable the bicycle to attain a speed greater than
thirty miles per hour on level ground within a distance
of one mile from a standing start;
g) "Motor Vehicle" includes an automobile, motorcycle, and
any other vehicle propelled or driven otherwise than by
muscular power; but does not include the cars of elec-
tric or steam railways or other motor vehicles running
only upon rails, or a motorized snow vehicles a motor
assisted bicycle, traction engine, farm tractor, self-
propelled implement of husbandry or road -building mach-
ine within the meaning of this by-law;
h) "Earj" or "rParkine"'i when prohibited, means the standing
of a vehicles whether occupied or not, except when stand-
ing temporarily for the purpose of and while actually
engaged in loading or unloading merchandise or passengers;
i) "Pedestrian" means a person afoot and includes an invalid
in a wheelchair or a child in a carriage;
J) "Pedestrian Crossover" means any portion of a roadway,
designated by by-law, at an intersection or elsewhere,
distinctly indicated for pedestrian crossing by signs on
the highway and lines or other markings on the surface of
the roadway as prescribed by the regulations;
k) "Ye�ce Of is "includes a mayor, sheriff, deputy sheriff,
sheriff's officer, justice of the peace, jailer or keeper
of a prison, and a police officer, constable, bailiff, or
other person employed for the preservation and maintenance
of the public peace, or for the service or execution of
civil process, or any officer appointed for enforcing or
carrying out the provisions of this By-law;
1) "Koad-buildin^ Machine" means a self-propelled vehicle
designed and used primarily in connection with the build-
ing or maintaining of highways and not designed or used
for carrying a load;
m) "Roadway" means the part of the highway that is improved,
designed or ordinarily used for vehicular traffic, but
does not include the shoulder, and, where a highway in-
cludes two or more separate roadway, the term "roadway"
refers to any one roadway separately and not to all of
the roadways collectively;
I) 1. n) "Self propelled Implement of $isbandry" means a self-
propelled vehicle manufactured, designed, redesigned,
converted or reconstructed for a specific use in farm-
ing;
o) "Shoulder" means that portion of the highway between the
edges of the roadway and the inside edges of the ditch,
fill slopes or the part of the highway where grass is
grown or which is not _intended for the use of vehicles;
P) "Stand" or "Standing", when prohibited, means the halting
of a vehicle, whether occupied or not, except for the pur-
pose of and while actually engaged in receiving or dis-
charging passengers;
q) "Ston" or "Stonping", when prohibited, means the halting
of a vehicle, even momentarily, whether occupied or not,
except when necessary to avoid conflict with other traffic
or in compliance with the directions of a constable or
other peace officer or of a traffic control sign or sig-
nal;
r) "Traffic Control Signal" means any device, manually, ele-
ctrically or mechanically operated for the regulation or
control of traffic;
s) "Vehicle „ includes a motor assisted bicycle, motor vehicle,
trailer, traction engine, farm tractor, road -building
machine and any vehicle drawn, propelled or driven by any
kind of power, including muscular power, but does not
include a motorized snow vehicle or the cars of electric
or steam railways running only upon rails.
I) 2. Where any expression of time occurs or where any hour or other
period of time is stated, the time referred to shall be stand-
ard time except in periods wren daylight saving time is in
effect, in which periods2 it shall be daylight saving time.
SECTION II
GENERAL
II) 1. This by-law applies only to highways under the jurisdiction of
the Corporation of the Town of Newcastle,
2. The Director of Public Works is hereby authorized to erect or
place temporary "NO PARKING" signs on any highway.
3. Section III shall not, it compliance therewith would be impra-
cticable, apply to,
a) ambulances, police or fire department vehicles, or
public utility emergency vehicles; or
b) vehicles actually engaged in works undertaken for
or on behalf of the Corporation of the Town of New-
castle or any municipal corporation; or
c) vehicles actually forming part of a funeral proces-
sion for as long as may reasonably be required for
the purpose of such funeral.
4. No person shall place, maintain or display upon or in view of
any highway, any sign signal, marking or device which purports
to be or is an imitation of or resembles an authorized sign
or traffic control signal or which conceals from view or in-
terferes with the effectiveness of an authorized sign or
traffic control signal.
SECTION III
GENERAL STOPPING AND PARKING REGULATIONS
III) 1, No person shall park or stop any vehicle on any highway or por-
tion thereof except as follows:
a) where there is a curt, on the right side of the trnv-
elled portion of the highway, having regard to the
direction such vehicle was proceeding, with its right
front and rear wheels parallel to and not more than
twelve (12) inches out from such curb;
b) where there is no curb, with the right front and rear
wheels parallel to and as near to the right-hand limit
of the highway as is practicable without stopping or
parking on a sidewalk, foot path or boulevard.
2. Where parking is permitted on the left-hand side of the travelled
portion of a highway designated for one-way traffic, no person
shall park or stop any vehicle on the left-hand side of the high-
way or portion thereof except as follows:
a) where there is a curb on the left side of the trav-
elled portion of the highway, having regard to the
direction such vehicle was proceedings with its left
front and rear wheels parallel to anO not more than
twelve (12) inches out from such curb;
b) where there is no curb, with the left front and rear
wheels parallel to and as near to the left-hand limit
of the highway as is practicable without stopping or
parking on a sidewalk, foot path or boulevard.
III) 3. No person shall on any highway stop any vehicle:
a) on or over a sidewalk or foot path;
b) within an intersection;
c) within thirty (30) feet of a crosswalk;
d) in such a manner as to interfere with the movement
of traffic or the clearing of snow from the highways;
e) on the roadway alongside of any stopped or parked
vehicle;
f) upon any bridge or elevated structure or within
any tunnel or underpass;
g) on any middle boulevard or centre strip separating
two roadways or adjacent to either side or ends of
such middle boulevard or centre strip;
h) other than a bus in a designated bus stop, except
that the driver of a passenger vehicle may tempor-
arily stop therein for the purpose of and while
actually engaged in loading or unloading passengers
when such stopping does not interfere with any bus.
4. No person who sells, offers for sale, or takes orders for goods,
wares, merchandise or produce from a vehicle shall for the pur-
pose of carrying on his business, stop the vehicle on any part
of the highway lying between two intersecting roadways for more
than thirty (30) minutes on any day or for more than ten (10)
minutes within the said thirty (30 minute period at any one
location.
5. No person shall on any highway park any vehicle:
a) in front of or within two (2) feet of a driveway
or laneway or so as to obstruct vehicles in the use of
a driveway or laneway;
b) within ten (10) feet of a point on the curb or edge
of the roadway opposite any fire hydrant;
c) within thirty (30) feet of an intersecting roadway;
d) within fifty (50) feet of any level crossing of a
railway other than a street railway;
e) for the purpose of displaying the vehicle for sale;
f) for the purpose of washing, greasing or repairing the
vehicle, except for such repairs as have been necess-
itated by an emergency;
III) 5. g) alongside the tracks of any railway ogler than
a street railway;
h) in such a position as will prevent the removal of
any other vehicle previously parked;
i) for a period longer than three (3) hours.
6. Wnere authorized signs to that effect are displayed, no per-
son shall on any highway stop any vehicle:
a) within fifty (50) feet of a pedestrian crossover
measured on each side of the highway in the direction
of travel of vehicles on that side of the highway;
b) within one hundred (100) feet of a pedestrian cross-
over measured on each side of the highway in the dir-
ection opposite to the direction of travel of vehicles
on that side of the highway;
c) other than a school bus in a school bus loading zone;
d) anytime on either side of a highway or portion of a
highway which is immediately adjacent to a school.
7. 1^'here authorized signs to that effect are displayed no person
shall on any highway a&r$ any vehicle:
a) on an intersecting, highway under the jurisdiction
of an area municipality, within one hundred (100)
feet of a Regional highway;
b) on a Regional highway within two hundred (200) feet
of an intersecting highway;
c) in front of an entrance to or exit from any building
or enclosed space in which persons may be expected to
congregate in large numbers;
d) within twenty-five (25) feet of any fire hall on
the side of the highway on which the fire hall is
located or within one hundred (100) feet of such
fire hail on the opposite side of the highway;
e) on either side of the portion of highwayy adjacent to
a school property between the hours of �j:30 a.m. and
4:30 p.m. Monday to Friday inclusive;
f) anytime on either side of a highway or portion of a
highway which is immediately adjacent to a park or
playground.
8. Nothing in this Section shall be deemed to permit the stopping
or parking of a vehicle where stopping or parking is prohibited.
SECTION IV
PE'-d,1ITTLD ANGLE PARKING
IV) 1. Angle parking in accordance with the provisions of subsection
(3) and (4) of Section 7 is permitted on the highways at the
sides and between the limits set out respectively in Columns
I7 TI and III of Schedule " " to this By-law.
2. `Pne provisions of subsection (1) and (2) of Section 4, do
not apply where angle parking is permitted under Part 7
hereof.
3. 'Where angle parking is permitted on a highway, no person shall
stop or park any vehicle except at an angle of 45 degrees from
the curb or boundary of the roadway with the front end of the
vehicle at such curb or boundary.
4. Where angle parking spaces are designated by lines painted on
the roadway, no person shall stop or park any vehicle except
within an area designated as a parking space.
SECTION VV
NO PARKIN�C
V) 1. Where authorized signs to that effect are displayed, no per-
son shall park a vencile on any highway at the side and between
the limits set out respectively in Columns I, II and III of
Schedule " " to this By -.law during the prohibited times or days
set out in Column IV of the said Schedule.
SECTION VI
N0 STOPPING
VI) 1. Where authorized signs to that effect are displayed, no person
small stop a vehicle on any highway at the side and bekwn'on
the limits set out respectively .in Columns 1, II and III of
Schedule " " to this fay -law during the prohibited times or
days set out in Column IV of the, said Schedule.

LUADING AND UNLOADING ZONES
VIII)1. Where authorized sins to ti;at effect are displayed, and
notwithstanding the provisions of Section 69 subsection
(5) hereof, vehicles actually engaged in the loading and
unloadingt delivery and receipt of goods, wares or mer-
chandise to adjoining premises may be parked during such
time as the said loading, unloading, delivery or receipt
is actually taking, place on any highway at the side and
between the limits set out respectively in Column I, II
and III of Schedule " " to this By-law.
SECTION In
PAhKING ILTERS
IK) 1. Where in this By-law a fee is stipulated for a given
parking period in a parking space, the fee shall be paid
for that period or any portion thereof, and the period
shall be as measured by the parking meter controlling
such parking space.
2. The erection„ maintenance and operation of parking meter
zones on the hi;hways, at the sides and between the limits
set out respectively in Columns I, II and III of Schedule
11 it to this by-law for the purpose of controlling and
regulating parking during the days and hours set out in
Column IV of the said Schedule and the designation of
parking spaces in connection with such meters, is hereby
authorized
3, notwithstanding the provision of any other By-law, where
parking meters have been erected under the authority of
Subsection (2) of this Section, no person shall park any
vehicle in a parking space on any highway, at the side and
between the limits set out respectively in Columns I, II

5. Where parking meters have been installed under the authority
of subsection (2) of this Section:
a) If parallel parking is permitted, no person shall
park a vehicle in a parking space unless the front
wheels of such vehicle are opposite to the parking
meter provided for such space except that, in any
case when two meters are mounted on the same stan-
dard, the rear of the forward vehicle shall be
opposite to or as elose as is practicable to the
forward parking meter and the front of the rear
vehicle shall be opposite to or as close as is pra-
cticable to the rear meter;
b) If angle parking is permitted, no person shall park
a vehicle in a parking space unless the front of
such vehicle is as close as is practicable to the
parking meter for such space;
c) If a parking space has been designed by lines
painted on the roadway, no person shall park any veh-
icle in such a manner that it is not wholly within
the area designated as a parkin:, space unless such
vehicle is of such length as to render it impossible
to park it in one parking space in which case the
adjoining parking space shall, in addition, be used,
and the necessary deposit of coins shall to made in
the parking asters provided for both parking spaces.
6. No person shall deposit or cause to be depoLited in any park-
ing meter any slug, device or other substitute for a coin
of tl.a Dominion of Canada or of the United States of ;Merica.
7. No person shall del -ice, conceal, injure, tam:;er with, oven
or willfully break, destroy or impair the usefulness of ary
parking meter erected under the authority of this Ley -law,

SECTION X
STANDS IUR TAXICABS
1. a) No taxicab$ while waiting for hire or engagement$ shall
be parked on any highway except at a stand authorized
and assigned for taxicabs by subsection (2) of this
Section and marked as a taxicab stand by an authorized
sign,
h) No vehicle other than a taxicab waiting for hire or
engagement shall be parked at any stand referred to in
subsection (l. a)) of the Section marked as a taxicab
stand by an authorized sign.
2. Stands for taxicabs are hereby authorized and assigned on
the highways at the sides and at the locations set out
respectively in Columns Ij II and III of schedule " " to
this by-law for the number of taxicabs permitted set out
in Column IV of the said Schedule for use between the hours
set out in Column V of the said Schedule.
SECTION XI

XI) 1. Treffic control signals shall be

penalty of not less than ten (;;10.00) dollars and not more
than twenty-five (•;25.00) dollars, exclusive of costs.
4. Any person viol-ating any of the provisions of this By-law
may pay to an authorized person on duty at the Town of

Village of Newcastle; OR Orono Public Utilities office, Park
